No.265 of 2009\n              --------------------------------------\n         Dated, this the 11th day of February, 2009\n\n                            ORDER\n<\/pre>\n<p>          In this Revision filed under Section 397 read with<\/p>\n<p>401 Cr.P.C., petitioners who are accused Nos.1, 2, 3, 5, 6<\/p>\n<p>and 8 to 11 in C.C.No.533 of 1998 on the file of the Judicial<\/p>\n<p>First Class Magistrate Court-I, Neyyattinkara challenge the<\/p>\n<p>conviction entered and the sentence passed against them<\/p>\n<p>for offences punishable under Sections 143, 147, 148, 427<\/p>\n<p>and 447 read with Section 149 IPC.\n<\/p>\n<p>     2.   The case of the prosecution can be summarised as<\/p>\n<p>follows:-\n<\/p>\n<p>          On 8-7-1997, at about 9.15 p.m. eleven accused<\/p>\n<p>persons out of their         enmity towards         PW1 formed<\/p>\n<p>themselves into an unlawful assembly with armed weapons<\/p>\n<p>such as chopper, stones, short stick etc. at Aankode in<\/p>\n<p>Crl.R.P.No.265 of 2009\n<\/p>\n<p>                               &#8211; 2 &#8211;\n<\/p>\n<p>\nPerunkadavila village and criminally trespassed into the<\/p>\n<p>compound of PW1 and committed mischief by smashing the<\/p>\n<p>window glasses and by disconnecting the telephone etc.<\/p>\n<p>causing a total loss of Rs.15,000\/- to PW1.<\/p>\n<p>      3.     The conviction recorded by the trial court for the<\/p>\n<p>aforementioned offences has been confirmed in appeal by<\/p>\n<p>the         learned       Additional     Sessions       Judge,<\/p>\n<p>Thiruvananthapuram. Hence, this revision.<\/p>\n<p>      4.     Pending this revision, the injured de facto<\/p>\n<p>complainant         has purported    to compound      all  the<\/p>\n<p>aforementioned offences committed by the petitioners<\/p>\n<p>herein      and      a joint petition  has   been    filed   as<\/p>\n<p>Crl.M.A.No.1370 of 2009. The petitioners place reliance<\/p>\n<p>upon the decision of the Apex Court in <a href=\"\/doc\/1442974\/\">Madan Mohan<\/p>\n<p>Abbot V. State of Punjab<\/a> [2008(4) SCC 582] in seeking to<\/p>\n<p>compound the offences by invoking Section 482 Cr.P.C.<\/p>\n<p>Crl.R.P.No.265 of 2009\n<\/p>\n<p>                               &#8211; 3 &#8211;\n<\/p>\n<\/p>\n<p>      5.     Having regard to the facts and circumstances of<\/p>\n<p>the case, I am not inclined to hold that the occurrence arose<\/p>\n<p>out of strictly private dispute between the parties so as to<\/p>\n<p>press into service Madan Mohan Abbot&#8217;s case.<\/p>\n<p>      6.     The offences which are compoundable are those<\/p>\n<p>punishable under Sections 427 and 447 IPC. The other<\/p>\n<p>offences namely Sections 143, 147, 148 and 149 are not<\/p>\n<p>compoundable offences. Hence, the joint petition can be<\/p>\n<p>allowed only so far as it relates to the offences punishable<\/p>\n<p>under Sections 427 and 447 IPC. The petition so far as<\/p>\n<p>those     offences     are concerned  is  allowed   and   the<\/p>\n<p>composition is recorded. It will have the effect of an<\/p>\n<p>acquittal of the revision petitioners with regard to the<\/p>\n<p>offences punishable under Sections 427 and 447 IPC in view<\/p>\n<p>of Section 320(8) Cr.P.C.\n<\/p>\n<p>Crl.R.P.No.265 of 2009\n<\/p>\n<p>                              &#8211; 4 &#8211;\n<\/p>\n<\/p>\n<p>      7.     In view of the composition of the offences<\/p>\n<p>punishable under Sections 427 and 447 IPC, it cannot be<\/p>\n<p>said that an unlawful assembly was formed for committing<\/p>\n<p>mischief and criminal trespass. If so, the conviction<\/p>\n<p>recorded for offences punishable under Sections 143, 147,<\/p>\n<p>148 and 149 cannot be sustained and is accordingly<\/p>\n<p>dislodged.
