I-425 of 2009 has been registered with Sector &#8211;<br \/>\n7 Police Station, Gandhinagar.\n<\/p>\n<p>4.\tThe<br \/>\napplicant accused had also filed Criminal Misc. Application No. 11995<br \/>\nof 2010 which was withdrawn with a liberty to file fresh application<br \/>\nafter filing of the charge-sheet and therefore present application<br \/>\nhas been filed.\n<\/p>\n<p>5.\tLearned<br \/>\nAdvocate Mr. Jasani submitted that the applicant is a female and as<br \/>\nnow the charge-sheet has been filed, considering the nature of<br \/>\noffence and role, present application may be allowed.\n<\/p>\n<p>6.\tLearned<br \/>\nAPP Ms. ML Shah has resisted the application.\n<\/p>\n<p>7.\tIn<br \/>\nview of the rival submissions, it is required to be considered<br \/>\nwhether the present application can be entertained or not.\n<\/p>\n<p>8.\tIt<br \/>\nis well accepted that the Court is not required to appreciate and<br \/>\nscrutinize the evidence in detail at this stage. However, considering<br \/>\nthe prima facie case, relevant aspects like, nature of offence, role<br \/>\nattributed, etc., are required to be considered.  In the facts of the<br \/>\npresent case, considering the fact that the charge-sheet is filed and<br \/>\ncase is based on the documentary evidence, without any further<br \/>\nelaboration as regard the prima facie involvement, the present<br \/>\napplication is allowed only on the ground that the applicant is a<br \/>\nfemale.\n<\/p>\n<p>9.\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with FIR<br \/>\n\tbeing C.R.NO. I-425 of 2009<br \/>\n\tregistered with Sector &#8211; 7 Police Station, Gandhinagar<br \/>\n\ton her executing a bond of Rs.5,000\/- (Rupees Five Thousand Only)<br \/>\n\twith one solvent surety of the like amount to the satisfaction of<br \/>\n\tthe lower Court and subject to the conditions that she shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of her liberty or abuse her liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of her residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nher residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nher passport, if any, to the lower Court, within a week.\n<\/p>\n<p>10.\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>11.\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>12.\tRule<br \/>\n\tis made absolute to the aforesaid extent.
