1.\tRule.\n<\/p>\n
Mr. Dabhi, learned APP, waives service of notice of Rule on behalf of
\nthe respondent-State.\n<\/p>\n
2.\tHeard
\nMr.Shakeel Qureshi, learned advocate for the applicant and Mr.Dabhi,
\nlearned APP for the respondent-State.\n<\/p>\n
3.\tThis
\napplication seeking regular bail under section 439 of the Code of
\nCriminal Procedure, 1973 has been preferred by applicant in
\nconnection with the offence registered with Valsad Police Station
\nbearing I-C.R.No.33 of 2011 for the offence punishable under sections
\n26(1)(f), 41(2)(b) of the Indian Forest Act and under sections 3 and
\n7 of the Damage to Public Properties Act.\n<\/p>\n
4.\tMr.Qureshi,
\nlearned advocate for the applicant has submitted that the applicant
\nhas been falsely involved in the case as the applicant. He has
\nsubmitted that the goods involved in the theft as alleged to have
\nbeen committed by the applicant, have already been recovered and
\nthere now nothing remains to be recovered. He has submitted that
\nlooking to the age of the applicant of 20 years and considering the
\nfact that the applicant is prosecuting his studies and has to secure
\nadmission in F.Y.B.A., and also the fact that the charge sheet has
\nbeen filed and the investigation is over, present applicant may be
\nreleased on bail.\n<\/p>\n
5.\tThe
\napplication is opposed by Mr.Dabhi, learned APP, who has submitted
\nthat the applicant has committed the alleged offence which is serious
\nin nature and that therefore the application deserves to be rejected.\n<\/p>\n
6.\tHaving
\nheard the learned counsel for both the sides and considering the
\nfacts and circumstances of the case as well as the material produced
\non record of this case, the gravity of the offence, the quantum of
\npunishment, the allegations against the applicant, the manner in
\nwhich the applicant is allegedly involved in the case as per the
\nallegation of the prosecution, role attributed to the applicant, the
\nage factor of the applicant accused, coupled with the fact that
\ncharge sheet has been filed and investigation is over, I am of the
\nview that the applicant accused deserves to be released on bail, I am
\ninclined to allow this application and release the applicant.\n<\/p>\n
7.\tHence,
\nthis application is partly allowed. It is directed that the present
\napplicant accused in connection with I-C.R.No.33 of 2011 registered
\nwith Valsad Police Station be released on bail, in respect of the
\noffences alleged against him in this application, on his executing
\nand furnishing a bond of Rs.10,000\/- (Rupees: Ten Thousand Only) with
\none solvent surety of like amount, by the concerned Police Officer,
\nand on condition that he shall:-\n<\/p>\n
\t(a)\tnot
\ntake undue advantage of or abuse the liberty;\n<\/p>\n
\t(b)\tnot
\nact in manner injurious to the interest of the\tprosecution;\n<\/p>\n
\t(c)\tmaintain
\nlaw and order;\n<\/p>\n
\t(d)\tnot
\nleave the State of Gujarat without prior permission of \tthe Sessions
\nCourt concerned;\n<\/p>\n
\t(e)\tfurnish
\nthe address of his residence at the time of execution \tof bond and
\nshall not change the residence without prior \tpermission of the
\nSessions Court\/this Court;\n<\/p>\n
\t(f)\tsurrender
\nhis passport, if any, to the lower court within 4 \tdays from the date
\nof this order;\n<\/p>\n
\t(g)\tmark
\nhis presence at Valsad Police Station initially on 25th
\n\tJune, 2011 and thereafter on every first and fifteenth day of \tevery
\nmonth, between 11.00 a.m. to \t3.00 \tp.m.;\n<\/p>\n
\t(h)
\nnot enter the revenue limit of Valsad Taluka till the trial is over
\n\tand for 6 months shall not enter revenue limit of \tNavsari district
\n\twithout prior permission of the Sessions Court, but for \tmaking his
\n\tpresence and attending the Court in connection with this case \tthe
\n\tapplicant will be free to enter the limits for a period to the
\n\textent necessary and will leave the limits of Valsad district
\n\timmediately after the case is adjourned;\n<\/p>\n
8.\tThe
\nauthorities will release the applicant only if he is not required in
\nany other offence for the time being.\n<\/p>\n
9.\tIf
\nbreach of any of the above condition is committed the Sessions Judge
\nconcerned will be free to issue warrant or take any appropriate
\naction in the matter.\n<\/p>\n
10.\tBail-bond
\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n
11.\tAt
\nthe trial, the trial Court shall not be influenced by the
\nobservations, which are purely, prima facie, tentative and
\npreliminary nature and have been made only for the purpose of
\nexamining prayer for bail pending the trial. The Court shall arrive
\nat its own conclusion independently on the basis of the evidence and
\nother aspects of the case.\n<\/p>\n
12.\tRule
\nis made absolute to the aforesaid extent. Direct Service is
\npermitted.\n<\/p>\n
