SINGH.\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>B.P.SINGH, J.\n<\/p>\n<p>\tThis appeal by special leave is directed against the judgment<br \/>\nand order of the High Court of Punjab and Haryana, Chandigarh<br \/>\ndated 24th January, 2001 in LPA No. 216 of 2001 whereby the<br \/>\nappellate Bench dismissed the appeal preferred by the appellants-<br \/>\nUnion of India and others upholding the claim of the respondent to<br \/>\ndisability pension under Regulation 53 of the Pension Regulations.<br \/>\nEarlier a learned Single Judge of the High Court had allowed the<br \/>\nwrit petition of the respondent herein upholding his claim for<br \/>\ndisability pension under the aforesaid Regulation 53 as also under<br \/>\nRule 4 of the Entitlement Rules for Casualty Pensioners Awards,<br \/>\n1982 (hereinafter referred to as &#8216;the Entitlement Rules&#8217;).  The<br \/>\nlearned Judge accordingly directed the appellants to release the<br \/>\ndisability pension of the respondent according to Rules and<br \/>\nRegulations.\n<\/p>\n<p>\tThe facts of the case are that the respondent was<br \/>\ncommissioned in the Indian Army in May, 1964.  He served the<br \/>\nIndian Army for many years and ultimately superannuated from<br \/>\nservice on 31st August, 1994 holding the rank of Lieutenant<br \/>\nColonel.  The respondent suffered a heart attack on 11th August,<br \/>\n1994 and had to undergo a bye-pass surgery.   He also suffered<br \/>\nfrom Open Angle Glaucoma in both eyes.\tIn these circumstances,<br \/>\non 3rd September, 1997 he claimed disability pension which was<br \/>\nrejected by the appellants compelling him to file a writ petition<br \/>\nbefore the High Court for a direction to the appellants to pay him,<br \/>\nin addition to his service pension, disability pension to which he<br \/>\nclaimed to be entitled in accordance with the Rules.  It is also not<br \/>\nin dispute that the respondent was examined by a Medical Board<br \/>\nconsisting of three members on 31st August, 1994.  The Board<br \/>\nfound that the respondent had suffered disability to the extent of<br \/>\n60% on account of (1) IHD (Angina Pectoris) (40%) and (2)<br \/>\nPrimary Open Angle Glaucoma in both eyes (20%).\t The Medical<br \/>\nBoard was also of the opinion that neither of these diseases were<br \/>\neither attributable to or aggravated by military service and that the<br \/>\ndiseases were constitutional in nature.\n<\/p>\n<p>\tRegulation 53 of the Regulations provides as follows :-\n<\/p>\n<p>&#8220;Officers compulsorily retired on account of age or<br \/>\non completion of tenure.\n<\/p>\n<p>53.\tAn officer compulsorily retired on account<br \/>\nof age or on completion of tenure, if suffering on<br \/>\nretirement from a disability attributable to or<br \/>\naggravated by military service and recorded by<br \/>\nservice medical authority may at the discretion of<br \/>\nthe President, be granted in addition to retiring<br \/>\npension admissible, a disability element as if<br \/>\nhe\/she had been retired on account of disability,<br \/>\naccording to accepted degree of disablement at the<br \/>\ntime of retirement.&#8221;\n<\/p>\n<p>\tRule 4 of the Entitlement Rules reads as follows :-\n<\/p>\n<p>&#8220;4.\tInvaliding from service is a necessary<br \/>\ncondition for grant of disability pension.   An<br \/>\nindividual who, at the time of his release under the<br \/>\nRelease Regulations, is in a lower medical<br \/>\ncategory than that in which he was recruited will<br \/>\nbe treated as invalidated from service.\t JCO\/OR<br \/>\nand equivalents in other services who are placed<br \/>\npermanently in a medical category other than &#8216;A&#8217;<br \/>\nand are discharged because no alternative<br \/>\nemployment suitable to their low medical category<br \/>\ncan be provided, as well as those who having been<br \/>\nretained in alternative employment but are<br \/>\ndischarged before the completion of their<br \/>\nengagement will be deemed to have been invalided<br \/>\nout of service.&#8221;\n<\/p>\n<p>\tThe learned Single Judge who heard the writ petition<br \/>\naccepted the contention of the respondent that apart from<br \/>\nRegulation 53, under Rule 4 of the Entitlement Rules, an<br \/>\nindividual, who at the time of his release under the release<br \/>\nregulations, is in a lower medical category than that in which he<br \/>\nwas recruited, is treated to be invalidated from service.  He,<br \/>\ntherefore, held that the moment an officer is reduced to the inferior<br \/>\ncategory in the medical chart, it automatically amounts to<br \/>\ninvalidation and consequently he would be entitled to disability<br \/>\npension in addition to the regular service pension.\n<\/p>\n<p>\tWe may observe that this finding of the learned Judge has<br \/>\nnot been approved by the Division Bench in appeal, but the<br \/>\nDivision Bench was of view that in any event the respondent was<br \/>\nentitled to disability pension under Regulation 53.   Even before us<br \/>\nthe claim of the respondent was not sought to be justified on the<br \/>\nbasis of Rule 4 of the Entitlement Rules.  We have also considered<br \/>\nthe aforesaid Rule 4 of the Entitlement Rules and we are also of<br \/>\nthe view that in the facts and circumstances of the case, the said<br \/>\nRule was not applicable to the case of the respondent.\n<\/p>\n<p>\tThat leaves for consideration Regulation 53.  The said<br \/>\nRegulation provides that on an officer being compulsorily retired<br \/>\non account of age or on completion of tenure, if suffering on<br \/>\nretirement from a disability attributable to or aggravated by<br \/>\nmilitary service and recorded by service medical authority, he may<br \/>\nbe granted, in addition to retiring pension, a disability element as if<br \/>\nhe had been retired on account of disability.  It is not in dispute<br \/>\nthat the respondent was compulsorily retired on attaining the age of<br \/>\nsuperannuation.\t The question, therefore, which arises for<br \/>\nconsideration is whether he was suffering, on retirement, from a<br \/>\ndisability attributable to or aggravated by military service and<br \/>\nrecorded by service medical authority.\tWe have already referred<br \/>\nto the opinion of the Medical Board which found that the two<br \/>\ndisabilities from which the respondent was suffering were not<br \/>\nattributable to or aggravated by military service.  Clearly therefore,<br \/>\nthe opinion of the Medical Board ruled out the applicability of<br \/>\nRegulation 53 to the case of the respondent.  The diseases from<br \/>\nwhich he was suffering were not found to be attributable to or<br \/>\naggravated by military service, and were in the nature of<br \/>\nconstitutional diseases.  Such being the opinion of the Medical<br \/>\nBoard, in our view the respondent can derive no benefit from<br \/>\nRegulation 53.\tThe opinion of the Medical Board has not been<br \/>\nassailed in this proceeding and, therefore, must be accepted.\n<\/p>\n<p>\tLearned counsel for the respondent sought to sustain the<br \/>\norder of the High Court on the ground that the President, in the<br \/>\nmeantime, has been pleased to decide and hold that the disabilities<br \/>\nsuffered by the respondent, which he was found to be suffering at<br \/>\nthe time of his release from service, be regarded as attributable to<br \/>\nmilitary service, and the degree of disablement has been assessed<br \/>\nat 60%.\t The issue has therefore become academic. This<br \/>\nsubmission is misconceived.  Annexure P-2 is a communication<br \/>\naddressed to the Chief Controller of Defence, Accounts (Pensions),<br \/>\nAllahabad by the Under Secretary to the Government of India and<br \/>\nis dated 18th October, 2000.  The letter refers to the order of the<br \/>\nHigh Court of  Punjab and Haryana dated 10th July, 2000 and<br \/>\nproceeds to state that the President has sanctioned the<br \/>\nimplementation of the above said order of the High Court.  The<br \/>\nauthority was accordingly requested to work out the amount<br \/>\ninvolved during the period of award and intimate the same to the<br \/>\nMinistry so that ex-post-facto sanction may be accorded.<br \/>\nParagraph 4 of the communication clearly states that the sanction<br \/>\nunder the letter was, however, without prejudice to the final out<br \/>\ncome of the LPA to be filed before the Division Bench of the High<br \/>\nCourt.\tIt would thus appear from Annexure P-2 that after the<br \/>\njudgment and order of the learned Single Judge the President was<br \/>\npleased to sanction payment of disability pension to the respondent<br \/>\nwith a view to implement and in obedience to the order of the High<br \/>\nCourt, and accordingly directions were issued to work out the<br \/>\namount involved during the period of award.  The sanction was,<br \/>\nhowever, without prejudice to the final out come of the Letters<br \/>\nPatent Appeal to be filed before the Division Bench.  The sanction<br \/>\nclearly appears to be tentative and without prejudice.\tEven the<br \/>\nrelevant part of the final order passed, which is Annexure R-1,<br \/>\ndated 17th November, 2000 states as follows :-\n<\/p>\n<p>&#8220;Accordingly, Col. Dhir Sngh Chhina IC-21830-K<br \/>\nis sanctioned subject to usual condition the<br \/>\ndisability element of pension @ Rs.450\/- (Rs. Four<br \/>\nhundred fifty only) P.M. for 60% disablement<br \/>\nw.e.f. 31.8.94 till further order.&#8221;\n<\/p>\n<p>\tIt would, thus appear that the disability element of<br \/>\npension has been sanctioned till further order.\t This again<br \/>\nmakes it quite clear that the sanction is tentative and subject to<br \/>\nthe pending proceedings.  A reading of Annexure R-1 and<br \/>\nAnnexure P-2, therefore, leaves no room for doubt that in view<br \/>\nof the order passed by the High Court, tentative sanction was<br \/>\ngranted for payment of disability element of pension but the<br \/>\nsame was without prejudice to the final out come of the Letters<br \/>\nPatent Appeal.\tIt was only in obedience to the order of the<br \/>\nCourt that such a sanction was granted, but without prejudice to<br \/>\nthe rights and contentions of the appellants who had challenged<br \/>\nthe order of the Court.\t We, therefore, cannot accept the<br \/>\ncontention of the counsel for the respondent that in view of the<br \/>\ndecision of the President of India sanctioning the disability<br \/>\npension, nothing remains to be considered by the Court.\t The<br \/>\nsanction clearly is tentative and till further order.  This was<br \/>\nnecessary since the proceedings were still pending before the<br \/>\nCourt and the appellants could not predict the out come of the<br \/>\nlegal proceedings.\n<\/p>\n<p>In these circumstances we find no substance in the<br \/>\ncontention of the respondent that he was entitled to disability<br \/>\npension under Regulation 53.  We accordingly allow the appeal,<br \/>\nset aside the order of the learned Single Judge as affirmed by<br \/>\nthe Division Bench in LPA No. 216 of 2001 and hold that the<br \/>\nrespondent is not entitled to disability pension under Regulation\n<\/p>\n<p>53.   However, in the facts and circumstances of the case any<br \/>\npayment made by way of disability pension shall not be<br \/>\nrecovered from the respondent.\tIn the facts of the case there<br \/>\nshall be no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Union Of India And Others vs Dhir Singh China, Colonel (Retd.) on 4 February, 2003 Author: B.P.Singh Bench: N.
