(ORAL)\n<\/pre>\n<p>                 Counsel for the petitioner has contended that a sum<\/p>\n<p>of Rs.1800\/- per month, awarded as maintenance pendente lite while<\/p>\n<p>disposing of an application under Section 24 of the Hindu Marriage<\/p>\n<p>Act, filed by the respondent, the trial Court has even observed that<\/p>\n<p>there is no definite evidence available on the record regarding the<\/p>\n<p>income of the petitioner.\n<\/p>\n<p>                 On the other hand, counsel for the respondent has<\/p>\n<p>contended that father of the petitioner has got 10 acres of<\/p>\n<p>                               &#8230; 1<br \/>\n C.R.No.2025 of 2009<\/p>\n<p>agricultural land whereas counsel for the petitioner contends that<\/p>\n<p>vide notice dated 29.10.2006, father of the petitioner has disowned<\/p>\n<p>him.\n<\/p>\n<p>                  After hearing the counsel for the petitioner and<\/p>\n<p>respondent, at length, I am of the opinion that, no doubt, the income<\/p>\n<p>of the petitioner has not been established, the trial Court presumed<\/p>\n<p>his income on the basis of, he being an able bodied person awarded<\/p>\n<p>a sum of Rs.1800\/- per month as maintenance pendente lite.<\/p>\n<p>                  In view of the absence of any material on the record<\/p>\n<p>indicating the actual income of the petitioner, the sum of Rs.1800\/-<\/p>\n<p>awarded per month may be on higher side but at the same time, it<\/p>\n<p>cannot be presumed that the petitioner is not earning anything.<\/p>\n<p>                  Without interfering in the interim order, it is ordered<\/p>\n<p>that the trial Court will dispose of the divorce petition within a period<\/p>\n<p>of one year after the next date of hearing.<\/p>\n<p>                  Disposed of.\n<\/p>\n<\/p>\n<p>                                                (M.M.S.BEDI)<br \/>\n                                                   JUDGE<br \/>\nSeptember 03, 2009.\n<\/p>\n<p>rka<\/p>\n<p>                                 &#8230; 2\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Rajesh Kumar vs Jasbir Kaur on 3 September, 2009 C.R.No.2025 of 2009 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH C.R.No.2025 of 2009.
