SHAH\n\t\t\n\t\n\n \n\nDate\n: 20\/06\/2008 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\nappellant Gujarat Housing Board, constituted under the Gujarat<br \/>\nHousing Board Act, 1961 has preferred the present First Appeal under<br \/>\nSection 96 of the Code of Civil Procedure against the judgment and<br \/>\ndecree passed by the learned City Civil Court No.15, Ahmedabad in<br \/>\nCivil Suit No. 2452 of 1980 of dated 25.09.1987, whereby the learned<br \/>\nJudge has decreed the suit by partly allowing the suit declaring the<br \/>\nGujarat Housing Board Service Classification and Recruitment<br \/>\nRegulations, 1981 as illegal, void and inoperative so far as the<br \/>\nallocated employees of the Gujarat Housing Board are concerned. The<br \/>\nlearned Judge has also granted the permanent injunction restraining<br \/>\nthe Gujarat Housing Board from implementing aforesaid Regulation so<br \/>\nfar as allocated employees of the Gujarat Housing Board are<br \/>\nconcerned.\n<\/p>\n<p>2.\tThat<br \/>\nthe original plaintiff instituted aforesaid Civil Suit No. 2452 of<br \/>\n1980 in the City Civil Court, Ahmedabad for the relief of declaration<br \/>\nthat the service rules and regulations moved for sanctioned before<br \/>\nthe State Government are arbitrary, unconstitutional and passed<br \/>\nwithout giving an opportunity of hearing to the plaintiff-Gujarat<br \/>\nHousing Board Employees Association and therefore, be declared bad<br \/>\nand void. It was the case on behalf of the original plaintiff that it<br \/>\nis registered trade union registered under the Indian Trade Union<br \/>\nAct, 1947 and was recognized as trade union by the Gujarat Housing<br \/>\nBoard. That on bifurcation of State of Maharastra into State of<br \/>\nGujarat and State of Maharastra Housing Board in existence had come<br \/>\nto end and employees in the Bombay Housing Board were allocated to<br \/>\nthe Gujarat and they constituted as employee of the Gujarat Housing<br \/>\nBoard. That in view of the provision contained in Section 86(2) of<br \/>\nthe Gujarat Housing Board Act, 1961, service condition of the<br \/>\nallocated employees cannot be altered to their disadvantage etc. It<br \/>\nis the case on behalf of the plaintiff that there was award of the<br \/>\nIndustrial Tribunal in (I.T.) No. 96 of 1973 which was accepted by<br \/>\nthe Housing Board and there were other Reference (IT) Nos. 7 of 1974<br \/>\nand 18 of 1974 to the effect that without previous sanction of the<br \/>\nState Government service rules cannot be altered as contemplated<br \/>\nunder Section 86(2) of the Act. The sum and substance of the<br \/>\ncontention on behalf of the plaintiff was that the Gujarat Housing<br \/>\nBoard had no right to frame service  rules and regulation for<br \/>\nallocated employees and they stand governed by own rules only and no<br \/>\nadvantage get nor any movement for approval of Government sanction<br \/>\ncan be made by the Board and consequently Board again fill up the<br \/>\npost by merit person on deputation from other department. It was the<br \/>\ncase on behalf of the plaintiff that approval taken by the Board in<br \/>\nits meeting dated 9.5.1980 for revise service rules be declared null<br \/>\nand void, without jurisdiction, incompetent and colourable exercise<br \/>\nof powers and illegal. It was also the case on behalf of the<br \/>\nplaintiff that finalizing the rules without taking the union and<br \/>\nplaintiff into confidence is violative of principles of natural<br \/>\njustice and mala fide. It was also contended that rules are hit by<br \/>\nSection 115 of the State Reorganization Act. Plaintiff therefore,<br \/>\ngave statutory notice dated 7.5.1980 that suit is required under<br \/>\nSection 71 of the Act and according to the plaintiff as nothing was<br \/>\nheard in reply, they were constrained to file aforesaid suit. As per<br \/>\nthe plaintiff the cause of action arise on 29.4.1980 when plaintiff<br \/>\nprotested against said proposed rules and when Civil Suit No. 1509 of<br \/>\n1980 was filed and that notice was served on 7.7.1980 and when<br \/>\nstatutory rules were produced on 10.09.1982, in the suit. The<br \/>\nplaintiff ultimately prayed that Gujarat Housing Board Service<br \/>\nClassification and Recruitment Regulation 1981 are illegal and void<br \/>\nso far as allocated employees are concerned and in so far as they<br \/>\nprovide for taking deputation from foreign department.\n<\/p>\n<p>3.\tSuit<br \/>\nwas resisted by the Gujarat Housing Board by filing written statement<br \/>\nat Exh. 8. It was contended that the suit is false, bad and malafide.<br \/>\nIt was further contended that suit is required to be dismissed for<br \/>\nnon joinder of State as party. It was also contended that suit was<br \/>\nbarred by limitation in view of provision of Section 71 of the Act.<br \/>\nIt was also further contended that under  powers conferred to board<br \/>\nby Section 74(c) of the Act, it was competent for board to frame<br \/>\nregulation as it did. It was also further contended that at the<br \/>\nrelevant time the suit was premature since the regulation required<br \/>\nsanction of the Government. It was further ascertaining that Section<br \/>\n86(2) was implicitly clear to spell out the power of the board to<br \/>\nmake rules subject to sanction from State Government. That the<br \/>\nlearned trial Court framed the issues at Exh. 38  of dated 14.3.1984<br \/>\nand re-cast on 27.11.1984. After hearing the parties, the learned<br \/>\ntrial Court held issue Nos. 1 to 6 in negative and issue No. 7 to 9<br \/>\nin affirmative and decreed the suit and granted the injunction as<br \/>\nprayed by the plaintiff against the present appellant. Hence, being<br \/>\naggrieved and dissatisfied with the judgment and decree passed by the<br \/>\nlearned City Civil Court, Ahmedabad passed in Civil Suit No. 2452 of<br \/>\n1980, the appellant -original plaintiff has preferred the present<br \/>\nFirst Appeal.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate for the respondent-original defendant has remained absent<br \/>\nand this being old appeal of 1988, this Court has no other<br \/>\nalternative but to proceed further with the same ex parte.\n<\/p>\n<p>5.\tShri<br \/>\nYF Mehta,learned Advocate has appeared on behalf of the<br \/>\nappellant-original defendant. It is submitted by Shri Mehta, learned<br \/>\nAdvocate for the appellant that the impugned judgment and decree<br \/>\npassed by the learned trial Court is absolutely illegal which<br \/>\ndeserves to be quashed and set aside. It is submitted that learned<br \/>\nJudge has materially erred in not properly appreciating the relevant<br \/>\nprovision more particularly, Section 71 of the Gujarat Housing Board<br \/>\nAct, 1961. It is submitted that the learned Judge ought to have<br \/>\ndismissed the suit on the ground that no legal and valid statutory<br \/>\nnotice as contemplated under Section 71 of the Act of 1961 was given<br \/>\nby the plaintiff before filing the suit and within six months of<br \/>\narising of cause of action.\n<\/p>\n<p>6.\tIt<br \/>\nis further submitted that learned Judge ought to have appreciated<br \/>\nthat at the relevant time when the suit was filed it was absolutely<br \/>\npremature as at the relevant time there was no sanction by the State<br \/>\nGovernment and at the relevant time there were proposed regulation.<br \/>\nIt is further submitted that even otherwise the learned trial Court<br \/>\nought to have appreciated the fact that the Gujarat Housing Board was<br \/>\nwell within its power to frame the recruitment rules and regulations.<br \/>\nIt is further submitted that even otherwise the impugned judgment and<br \/>\ndecree passed by the learned trial Court quashing and setting aside<br \/>\nthe statutory regulation is without jurisdiction. It is further<br \/>\nsubmitted that the learned Judge has not at all examined the factum<br \/>\nof the rules at all and as to how they are arbitrary and illegal. It<br \/>\nis submitted that the learned Judge has failed to appreciate the fact<br \/>\nthat admittedly the plaintiff has submitted his objection of dated<br \/>\n26.12.1980 and the rules were framed and published on 26.5.1982,<br \/>\nthere was sufficient compliance of principles of natural justice. It<br \/>\nis further submitted that the learned Judge ought to have appreciated<br \/>\nthat framing of the rules of governing the employees is a matter of a<br \/>\npolicy and only on limited ground of the legislation competence it<br \/>\ncould have been questioned. It is submitted that the learned trial<br \/>\nCourt ought not to have examined legislation competence since it is<br \/>\nnot a Court under the Constitution of India but Court under the Civil<br \/>\nCourt Act.\n<\/p>\n<p>7.\tShri<br \/>\nMehta learned advocate for the appellant has heavily relied upon the<br \/>\nfollowing decision in support of his above submissions and in respect<br \/>\nof his request to quash and set aside.\n<\/p>\n<p>SCC<br \/>\n\t2005(4) 613.\n<\/p>\n<p>AIR<br \/>\n\t1995 SC 1715.\n<\/p>\n<p>AIR<br \/>\n\t1968 SC 292.\n<\/p>\n<p>AIR<br \/>\n\t1971 SC 1828.\n<\/p>\n<p>AIR<br \/>\n\t1974 SC 259<\/p>\n<p>AIR<br \/>\n\t1976 SC 888.\n<\/p>\n<p>AIR<br \/>\n\t1998 SC 2276.\n<\/p>\n<p>8.\tHeard<br \/>\nthe learned Advocate Shri YF Mehta on behalf of the appellant and<br \/>\nhaving considered the impugned judgment and decree passed by the<br \/>\nlearned trial Court and record and proceedings of the case. It<br \/>\nappears to the Court that learned trial Court has materially erred in<br \/>\ndecreeing the suit and by quashing and setting aside and declaring<br \/>\nthat the Gujarat Housing Board Service and Classification Recruitment<br \/>\nRules, 1981 in so far as the allocated employees of the defendant<br \/>\nboard are concerned, as illegal, void and inoperative. First of all<br \/>\nit is to be noted that when the suit was filed the recruitment rules\/<br \/>\nregulation were at draft stage only and were sent to the State<br \/>\nGovernment for its sanction. It is also required to be noted that at<br \/>\nthe relevant time the objections were raised against said draft<br \/>\nrules. It is also not in dispute that during the pendency of the<br \/>\nsuit, the draft rules have been sanctioned by the State Government<br \/>\nand they were produced on record. Once the draft rules have been<br \/>\nsanctioned by the State Government and the same are published<br \/>\nthereafter so far as Civil Court is concerned, the Civil Court would<br \/>\nhave a very limited scope to consider the legality and validity of<br \/>\nthe same. On considering the entire judgment and decree passed by the<br \/>\nlearned trial Court, it appears that there is no finding given by the<br \/>\nlearned trial Court how the recruitment rules are arbitrary and \/ or<br \/>\nillegal. The learned Judge has not addressed itself on merits of the<br \/>\nrules and regulations which have been sanctioned by the State<br \/>\nGovernment. So far as the power of the Board to frame the recruitment<br \/>\nregulation are concerned, the same cannot be disputed. It appears<br \/>\nthat the learned trial Court has held that the said recruitment rules<br \/>\nare against the principles of natural justice as no opportunity of<br \/>\nhearing has been given to the plaintiff and the members. However, it<br \/>\nis to be noted that when statutory rules and regulation are to be<br \/>\nframed there is no question of personal hearing. Inviting objections<br \/>\nto the proposed rules is sufficient. In the present case as stated<br \/>\nabove against the draft rules the plaintiff did submit the objection.<br \/>\nTherefore, it cannot be said that the recruitment rules are in breach<br \/>\nof principles of natural justice. The contrary finding of the learned<br \/>\ntrial Court cannot be sustained and which deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>9.\tEven<br \/>\notherwise considering the decisions relied upon by the learned<br \/>\nAdvocate for the appellant referred to herein above the impugned<br \/>\njudgment and decree passed by the learned trial Court is without<br \/>\njurisdiction and \/ or it can be said that the learned trial Court has<br \/>\nexceeded the jurisdiction vested in it and the same cannot be<br \/>\nsustained.\n<\/p>\n<p>10.\tIn<br \/>\nview of the above and for the reasons stated above, the judgment and<br \/>\ndecree passed by the learned trial Court deserves to be quashed and<br \/>\nset aside and is hereby quashed and set aside. First Appeal is<br \/>\naccordingly allowed.
