namely Sri.Rupesh B. Naika. The a’ppe’_liaintii’i_n’su’re:fi:’hais~1..1<\/p>\n
challenged in this appeal the legaE._iVty..V_andii’co_r1\u00b0eVct~nie’s:s”‘of the
\norder dated \u00a38\/l\/2008 pass,-ed inpV.l’v”v’i{:i7f\\,\/S-R\/43720-07\/ion the<\/p>\n
file of the Labour Officer  W-i:,l’rl<r1}.eiiri5'_s.viC__ompensation<\/p>\n
Commissioner,  \u00a7:_Kan…nad\u00abai"'  .D_i_sftrict, Karwar<\/p>\n
(hereinafter re'fe'1~–r_ed to'i:as–  n1is'si'0'i1er' for short).\n<\/p>\n

\nCommissioner dir’ec_:ted.ilthi’s appellant insurer to pay to the<\/p>\n
re’spoin’die1iitiiNio’s.ll’~t_o 5 herein (respectively claimants No.1<\/p>\n
 to 5 before ‘ti:-e:”‘l.eariizle’d Commissioner) a total compensation<\/p>\n
i”.~-oifi’R.s.4,2i7—-i_1\u00bb!-ll)\/-“V’yvith interest thereon at the rate of 12%<\/p>\n
 the death of the deceased Narasimha Bovi the<\/p>\n
lot; claimant No.l, father of claimant No.2 and 3,<\/p>\n

son of claimant No.4 and brother of claimant No.5 before<\/p>\n
the learned Commissioner in the said case.<\/p>\n
3) Heard the arguments of Sri.N.R.Kuppel’ur_l’~.;lor<\/p>\n
Sri.B.C.Seeth_ararn Rao, the learned counsel-:_:iio’r5.’.j[the’v…_l”.<\/p>\n
appellant insurer and Srnt.\\\/idya, the_.l.earned”lcvouf;.5el <\/p>\n
the respondent–clairnants. Respondent*.VN’o.i6lil the<\/p>\n
the said Tractor and Trailer has~..fp\u00a7gmain.ed…ab.se_nti”gdesplite
\nreceipt of notice of this appeal.\n<\/p>\n
4) The learned counsel ford\u00bb:the._Vil’appe_llant insurer<\/p>\n
strongly con:t:endsiitliaVt,’VVriVsl<,to.._the Loader employed by the
\nowner ofthe saidTracistor~a:i_d'"Tir'aliler was not covered under
\nthe__ insurpapnlcea poli'c-yd' in\/h_i:ch is marked as Ex.Rl and<\/p>\n
therefor:e\u00ab.the_ learn-ed Commissioner was not justified in<\/p>\n
 on this appellant insurer to pay the<\/p>\n
__"s-a_idUamount..  compensation to the claimants in the said<\/p>\n
 A<\/p>\n

5) Per contra the learned counsel for the
\nrespondent–clairnants strongly contends that a sum of<\/p>\n
Rs.25\/– has been collected by the appellant insurer under<\/p>\n
the policy at Ex.R1 towards the risk to one <\/p>\n
employed by the owner of the said Tractor  aif1d,: ii  <\/p>\n
therefore the present appeal deserves to be”d.2i’snii.ss~e:d.  <\/p>\n
6) The factum of accid_e’nt, the death the
\ndeceased as a result of the said acxci–de”pn.t,i”-the reiiiavti.orz’lship of<\/p>\n
the deceased with the claiir_r1an~t,s5i;;’thiei.V”_\u00bboiWnership and<\/p>\n
insurance  are all not in
\ndispute. Oniiiperusali of Ex.R1 insurance

Schedule of Premium that an additional premium of <\/p>\n
has been collected by the appellant insurer from_.’4’tlae<\/p>\n
of the said Tractor and Trailer towards<\/p>\n
employee. It is established by the:\u00ab.clia_i_niants_..Epthat<\/p>\n
deceased was employed in the sai’dlc:.:i”ractlot*-
\nthe owner thereof as the Loader  as a
\nresult of the injury  i’rl:lv’ltill*.llev:..laceident that
\noccurred while   Tractor and
\nTrailer. Ther’e’fo–1’ei of the learned counsel ‘for
\nthe appellant irisurevr respect of the deceased
\n as””l’a:h..e._i.lsoader in the said Tractor and<\/p>\n
Trailer”not;”‘coiv.ered under Ex.R.1 insurance policy<\/p>\n
 vi ‘cannot be aicce_pt’e\u00e9;1.e<\/p>\n
 Th_e”:.learned counsel for the appellant insurer<\/p>\n
 the word ’employee’ used in the schedule of<\/p>\n
  refers to the driver employed by the owner but not<\/p>\n
(W1-*””‘.\u00bb’*-\u00ab~……\u00bb.\n<\/p>\n
to any other employee. This contention cannot be accepted<\/p>\n
for the reason that another some of Rs.l00\/- ha.s’*fb”ei_enV’<\/p>\n
collected as additional premium in respect of tjhie  ”<\/p>\n
owner-driver.\n<\/p>\n
