No.203 of 211\n            ====================================\n          Dated this the   28th day of January,    2011\n\n\n                             O R D E R\n<\/pre>\n<p>      Petitioners are accused in C.C. No.1647 of 2009 of the court<\/p>\n<p>of learned Judicial First Class Magistrate, Irinjalakuda for offence<\/p>\n<p>punishable under Sections 406 and 498A read with Section 34 of<\/p>\n<p>the Indian Penal Code arising from the final report submitted by<\/p>\n<p>the police in Crime No.205 of 2009 of Puthukkad Police Station.<\/p>\n<p>Prosecution case is that petitioners subjected respondent No.2 to<\/p>\n<p>cruelty physically and mentally to coerce her to get more dowry,<\/p>\n<p>misappropriated    gold    ornaments     and  money   and   thereby<\/p>\n<p>committed the offence.      Though various contentions are raised in<\/p>\n<p>the petition at the time of hearing learned counsel confined his<\/p>\n<p>submission to a request to grant exemption to the petitioners from<\/p>\n<p>personal appearance in the trial court. In the light of the decision<\/p>\n<p>in <a href=\"\/doc\/178377\/\">TGN Kumar v. State of Kerala<\/a> (2011 [1] KHC 142 (SC)<\/p>\n<p>question whether petitioners are to be exempted from appearance<\/p>\n<p>is a matter which the trial court has to decide on the facts and<\/p>\n<p>materials before it.   Hence I direct that in case any application is<\/p>\n<p>filed by any    of petitioners seeking exemption from personal<\/p>\n<p>CRL.M.C. No.203 of 2011<br \/>\n<span class=\"hidden_text\">                               -: 2 :-<\/span><\/p>\n<p>appearance,   learned   Magistrate  shall consider     the said<\/p>\n<p>application having regard to the circumstances of the case<\/p>\n<p>including  whether it is necessary for  petitioners to appear in<\/p>\n<p>person in court and pass appropriate orders.<\/p>\n<p>      Criminal Miscellaneous Case is disposed of with the above<\/p>\n<p>direction.\n<\/p>\n<\/p>\n<p>                                THOMAS P.
