{"id":210878,"date":"2011-05-10T00:00:00","date_gmt":"2011-05-09T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/chamar-vs-state-on-10-may-2011"},"modified":"2015-04-24T10:16:50","modified_gmt":"2015-04-24T04:46:50","slug":"chamar-vs-state-on-10-may-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/chamar-vs-state-on-10-may-2011","title":{"rendered":"Chamar vs State on 10 May, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Gujarat High Court<\/div>\n<div class=\"doc_title\">Chamar vs State on 10 May, 2011<\/div>\n<div class=\"doc_author\">Author: J.B.Pardiwala,&amp;Nbsp;<\/div>\n<pre>   Gujarat High Court Case Information System \n\n  \n  \n    \n\n \n \n    \t      \n         \n\t    \n\t\t   Print\n\t\t\t\t          \n\n  \n\n\n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t\n\n\n \n\n\n\t \n\nCR.MA\/6113\/2011\t 4\/ 4\tORDER \n \n \n\n\t\n\n \n\nIN\nTHE HIGH COURT OF GUJARAT AT AHMEDABAD\n \n\n \n\n\n \n\nCRIMINAL\nMISC.APPLICATION No. 6113 of 2011\n \n\n \n \n=========================================================\n\n\n \n\nCHAMAR\nKUBERBHAI VASRAMBHAI &amp; 2 - Applicant(s)\n \n\nVersus\n \n\nSTATE\nOF GUJARAT - Respondent(s)\n \n\n=========================================================\n \nAppearance : \nMR\nSN BAROT for Applicant(s) : 1 - 3. \nMR JK SHAH APP for\nRespondent(s) :\n1, \n========================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/05\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP, Mr.J.K.Shah, waives service of notice of rule on behalf<br \/>\n\tof State.\n<\/p>\n<p>Accused-applicants<br \/>\n\thave prayed for anticipatory bail in connection with offences<br \/>\n\tregistered with Mehsana City Police Station, Mehsana, District:<br \/>\n\tMehsana vide C.R.No.I-19 of 2011 for the offences punishable under<br \/>\n\tSections 465, 466, 467, 468, 471, 474, 472, 476 and 120(B) of Indian<br \/>\n\tPenal Code.\n<\/p>\n<p>I<br \/>\n\thave heard learned advocate, Mr.S.N.Barot for the accused-applicants<br \/>\n\tand learned APP, Mr.J.K.Shah, for the respondent-State.\n<\/p>\n<p>Having<br \/>\n\tregard to the rival contentions of the respective Counsels and<br \/>\n\thaving considered the case of the prosecution and the allegations<br \/>\n\tagainst the accused-applicants,<br \/>\n\tI am inclined to exercise my discretion in favour of the<br \/>\n\taccused-applicants considering the following aspects:\n<\/p>\n<p>(I)\tOffences<br \/>\n\tin question relate to some illegality committed way back in the year<br \/>\n\t2002;\n<\/p>\n<p>(II)\tRecord<br \/>\n\tfurther reveals that the persons who derived benefit from the<br \/>\n\talleged bogus order dated 19.4.2002 have been ordered to be enlarged<br \/>\n\ton anticipatory bail by the Sessions Court, Mehsana.\n<\/p>\n<p>(III)<br \/>\n\tPursuant to the order passed by this Court in Criminal Misc.<br \/>\n\tApplication No.3640 of 2011, other co-accused have already been<br \/>\n\tenlarged on anticipatory bail.\n<\/p>\n<p>In<br \/>\n\tview of the fact that other co-accused have already been enlarged on<br \/>\n\tanticipatory bail, mainly beneficiaries of the order, no custodial<br \/>\n\tinterrogation is now necessary in the matter.\n<\/p>\n<p>In<br \/>\n\tthis view of the matter, accused-applicants are ordered to be<br \/>\n\tenlarged on bail in the event of their arrest in connection with the<br \/>\n\toffence registered with Mehsana City Police Station, Mehsana vide<br \/>\n\tC.R. No.I-19 of 2011. They shall be released on bail on furnishing a<br \/>\n\tbond of Rs.10,000\/-(Rupees Ten Thousand Only) each with one surety<br \/>\n\teach of like amount on following conditions that they:\n<\/p>\n<p>(A)\tshall<br \/>\ncooperate with the investigation and make themselves available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>(B)\tshall<br \/>\nremain present at the concerned police station on 18th<br \/>\nMay, 2011 between 9.00 a.m. to 2.00 p.m. <\/p>\n<p>(C)\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>(D)\tshall<br \/>\nat the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>(E)\twill<br \/>\nnot leave India without the permission of the Court and if are<br \/>\nholding a passport, shall surrender the same before the trial Court<br \/>\nwithin a week;\n<\/p>\n<p>(F)\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>It<br \/>\n\twould be open for the Investigating Agency to apply to the competent<br \/>\n\tMagistrate, for police remand of the applicants. The applicants<br \/>\n\tshall remain present<br \/>\n\tbefore the learned Magistrate on the first date of hearing on such<br \/>\n\tapplication and on all subsequent occasion, as may be directed by<br \/>\n\tthe learned Magistrate. This would be sufficient to treat the<br \/>\n\taccused in the judicial custody for the purpose of entertaining<br \/>\n\tapplication of the prosecution for police remand. This is, however,<br \/>\n\twithout prejudice to the right of the accused to seek stay against<br \/>\n\tan order of remand, if ultimately granted, and the power of the<br \/>\n\tlearned Magistrate to consider such a request in accordance with<br \/>\n\tlaw. It is clarified that the applicants, even if remanded to the<br \/>\n\tpolice custody upon completion of such period of police remand,<br \/>\n\tshall be set free immediately, subject to other conditions of this<br \/>\n\tanticipatory bail order.\n<\/p>\n<p>With<br \/>\n\tthese directions, application is allowed.
