No. 4344<br \/>\n                   of 2007, has preferred this Appeal under Clause 10 of the Letters<br \/>\n                   Patent so far as the learned single Judge has observed, &#8220;The<br \/>\n                   petitioner may, on the basis of his approval of service from<br \/>\n                   October, 1978, can now get his revised retirement benefit by<br \/>\n                   treating the aforesaid period towards the qualifying service<br \/>\n                   but, nothing more will be admissible to him.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                                    Learned advocate Mr. Sarvdeo Singh has appeared<br \/>\n                   for the appellant. He has submitted that the aforesaid observation<br \/>\n                   was uncalled for as the appellant is still continuing in service. He<br \/>\n                   has further submitted that the aforesaid observation is capable of<br \/>\n                   being interpreted to deny increment, promotion etc. to the<br \/>\n                   appellant. He has submitted that the retiral benefits was not the<br \/>\n                   subject matter of the writ petition. In fact, pending the petition the<br \/>\n                   grievance of the petitioner was redressed. On the date of the<br \/>\n                   impugned order the cause of action did not survive.\n<\/p><\/blockquote>\n<blockquote><p>                                    In above view of the matter, learned advocate Mr.<br \/>\n                   Singh seeks leave to withdraw the writ petition.\n<\/p><\/blockquote>\n<blockquote><p>                                    Leave is granted.\n<\/p><\/blockquote>\n<blockquote><p>                                    The writ petition is disposed of as withdrawn.<br \/>\n                                    Letters Patent Appeal stands disposed of.<\/p><\/blockquote>\n<p>                                                         (R.M.
