1.     The\u00a0Applicant\u00a0filed\u00a0a\u00a0RTI\u00a0Application\u00a0dt.22.2.11\u00a0with\u00a0the\u00a0PIO,\u00a0O\/o\u00a0DC(South)\u00a0seeking\u00a0information\u00a0<\/p>\n
       against \u00a0 eight \u00a0 points \u00a0 including \u00a0 the \u00a0 following \u00a0 whether \u00a0 it \u00a0 is \u00a0fact \u00a0 that \u00a0 any \u00a0 activity \u00a0 other \u00a0 than\u00a0<\/p>\n
       agriculture\/diary\/poultry\u00a0on\u00a0agricultural\u00a0land\u00a0attracts\u00a0provision\u00a0of\u00a0section\u00a081\u00a0of\u00a0DLR\u00a0Act,\u00a01954\u00a0and\u00a0<\/p>\n
       whether\u00a0land\u00a0in\u00a0unauthorized\u00a0colonies\u00a0in\u00a0the\u00a0list\u00a0of\u00a0colonies\u00a0to\u00a0be\u00a0regularized\u00a0by\u00a0Govt.\u00a0are\u00a0being\u00a0<\/p>\n

       The\u00a0SPIO\u00a0 vide\u00a0 his\u00a0letter\u00a0dt.28.2.11\u00a0transferred\u00a0the\u00a0RTI\u00a0Application\u00a0to\u00a0SDM(HK),\u00a0Mehrauli,\u00a0under\u00a0<\/p>\n
       intimation\u00a0to\u00a0the\u00a0Applicant.\u00a0 \u00a0On\u00a0not\u00a0receiving\u00a0any\u00a0further\u00a0reply\u00a0to\u00a0his\u00a0RTI\u00a0application\u00a0The\u00a0Applicant\u00a0<\/p>\n
       filed\u00a0an\u00a0appeal\u00a0dt.13.4.11\u00a0with\u00a0the\u00a0Appellate\u00a0Authority.\u00a0\u00a0\u00a0Ms.Nandini\u00a0Paliwal,\u00a0Appellate\u00a0Authority\u00a0after\u00a0<\/p>\n
       conducting\u00a0a\u00a0hearing\u00a0on\u00a023.5.11\u00a0disposed\u00a0of\u00a0the\u00a0first\u00a0appeal\u00a0directing\u00a0the\u00a0PIO\u00a0to\u00a0provide\u00a0specific\u00a0and\u00a0<\/p>\n
       ‘up\u00adto\u00addate\u00a0information\u00a0with\u00a0details’\u00a0to\u00a0the\u00a0Appellant\u00a0within\u00a0ten\u00a0days\u00a0of\u00a0receipt\u00a0of\u00a0the\u00a0order.\u00a0\u00a0On\u00a0not\u00a0<\/p>\n
       receiving\u00a0any\u00a0reply\u00a0from\u00a0the\u00a0PIO,\u00a0the\u00a0Applicant\u00a0filed\u00a0a\u00a0second\u00a0appeal\u00a0dt.21.6.11\u00a0before\u00a0CIC.<\/p>\n
Decision<\/p>\n
2.     During\u00a0the\u00a0hearing,\u00a0the\u00a0Appellant\u00a0stated\u00a0that\u00a0he\u00a0had\u00a0received\u00a0a\u00a0response\u00a0from\u00a0the\u00a0PIO\u00a0on\u00a022.6.11\u00a0<\/p>\n
       after\u00a0 he\u00a0 had\u00a0 filed\u00a0 the\u00a0 second\u00a0 appeal.\u00a0He\u00a0 \u00a0 sought\u00a0 \u00a0information\u00a0against\u00a0points\u00a0 1\u00a0 to\u00a06\u00a0of\u00a0 the\u00a0RTI\u00a0<\/p>\n
       application\u00a0which\u00a0was\u00a0missing.\u00a0The\u00a0Commission\u00a0accordingly\u00a0reviewed\u00a0the\u00a0information\u00a0sought\u00a0against\u00a0<\/p>\n
       these\u00a0points\u00a0and\u00a0directed\u00a0as\u00a0given\u00a0below:\u00a0\n<\/p>\n
       Point\u00a01<\/p>\n
       The\u00a0Commission\u00a0holds\u00a0that\u00a0information\u00a0sought\u00a0does\u00a0not\u00a0fall\u00a0under\u00a0the\u00a0definition\u00a0of\u00a0‘information’\u00a0as\u00a0<\/p>\n
       given\u00a0\u00a0u\/s\u00a02(f)\u00a0of\u00a0the\u00a0RTI\u00a0Act.\n<\/p>\n
       Points\u00a02\u00a0and\u00a03<\/p>\n
       The\u00a0PIO\u00a0\u00a0is\u00a0directed\u00a0to\u00a0provide\u00a0the\u00a0information\u00a0sought\u00a0against\u00a0these\u00a0queries\u00a0as\u00a0either\u00a0YES\u00a0or\u00a0NO.
\n      Point\u00a04<\/p>\n
     The \u00a0 Appellant \u00a0 submitted \u00a0 that \u00a0 he \u00a0 was \u00a0 informed\u00a0 that \u00a0 information \u00a0 is \u00a0 not \u00a0 available. \u00a0 \u00a0 He, \u00a0 however,\u00a0<\/p>\n
     produced\u00a0before\u00a0the\u00a0Commission\u00a0a\u00a0letter\u00a0from\u00a0the\u00a0DCP(South)\u00a0to\u00a0the\u00a0Dy.\u00a0Commissioner\u00a0(South)\u00a0<\/p>\n
     enclosing\u00a0the\u00a0required\u00a0enquiry\u00a0report.\u00a0The\u00a0Appellant\u00a0stated\u00a0that\u00a0while\u00a0he\u00a0has\u00a0received\u00a0the\u00a0enquiry\u00a0<\/p>\n
     report \u00a0 under \u00a0 RTI \u00a0 from \u00a0 the \u00a0 police \u00a0 he \u00a0 now \u00a0 wants \u00a0 an \u00a0 attested \u00a0 copy \u00a0 of \u00a0 \u00a0 the \u00a0 same \u00a0 from \u00a0 the \u00a0 Dy.\u00a0<\/p>\n
     Commissioner,\u00a0South\u00a0\u00a0He\u00a0added\u00a0that\u00a0a\u00a0misleading\u00a0reply\u00a0\u00a0has\u00a0therefore\u00a0been\u00a0sent\u00a0to\u00a0him\u00a0by\u00a0the\u00a0PIO\u00a0<\/p>\n
     in\u00a0his\u00a0reply\u00a0dated\u00a022.6.11.\u00a0\u00a0\n<\/p>\n
     The\u00a0\u00a0Commission,\u00a0based\u00a0on\u00a0the\u00a0letter\u00a0produced\u00a0by\u00a0the\u00a0Appellant\u00a0before\u00a0the\u00a0Commission,\u00a0directs\u00a0\u00a0the\u00a0<\/p>\n
     PIO\u00a0to\u00a0locate\u00a0the\u00a0information\u00a0that\u00a0has\u00a0already\u00a0been\u00a0sent\u00a0to\u00a0their\u00a0office\u00a0by\u00a0DCP\u00a0and\u00a0to\u00a0provide\u00a0the\u00a0<\/p>\n
     same\u00a0 to\u00a0the\u00a0 Appellant.\u00a0 \u00a0 The\u00a0 PIO\u00a0to\u00a0explain\u00a0to\u00a0the\u00a0Commission\u00a0by\u00a024.10.11\u00a0as\u00a0to\u00a0why\u00a0incorrect\u00a0<\/p>\n
     information\u00a0has\u00a0been\u00a0supplied\u00a0against\u00a0this\u00a0point\u00a0to\u00a0the\u00a0Appellant.\u00a0\u00a0\u00a0<\/p>\n
     Point\u00a05<\/p>\n
     The\u00a0 Appellant\u00a0 stated \u00a0 that\u00a0 unauthorized\u00a0 colonies\u00a0 as\u00a0per\u00a0rule\u00a0have\u00a0to\u00a0be\u00a0 treated\u00a0as\u00a0 private\u00a0 land.\u00a0<\/p>\n
     However,\u00a0in\u00a0a\u00a0number\u00a0of\u00a0cases,\u00a0according\u00a0to\u00a0him,\u00a0notices\u00a0have\u00a0been\u00a0issued\u00a0to\u00a0\u00a0these\u00a0colonies\u00a0\u00a0u\/s\u00a081\u00a0<\/p>\n
     of\u00a0DLR\u00a0Act,\u00a01954\u00a0 \u00a0which\u00a0is\u00a0a\u00a0 \u00a0violation\u00a0of\u00a0the\u00a0order\u00a0of\u00a0the\u00a0Urban\u00a0Development\u00a0Department.\u00a0 \u00a0He,\u00a0<\/p>\n
     therefore,\u00a0insisted\u00a0on\u00a0being\u00a0furnished\u00a0with\u00a0o\u00a0no.\u00a0of\u00a0such\u00a0notices\u00a0that\u00a0have\u00a0been\u00a0issued.\u00a0\u00a0<\/p>\n
     The\u00a0Commission\u00a0directs\u00a0the\u00a0PIO\u00a0to\u00a0provide\u00a0this\u00a0information\u00a0as\u00a0available\u00a0on\u00a0record.<\/p>\n
     Point\u00a06<\/p>\n
     Once\u00a0the\u00a0files\u00a0related\u00a0to\u00a0the\u00a0notices\u00a0that\u00a0have\u00a0been\u00a0issued\u00a0are\u00a0located,\u00a0the\u00a0PIO\u00a0is\u00a0directed\u00a0to\u00a0provide\u00a0<\/p>\n
     to\u00a0the\u00a0Appellant,\u00a0copies\u00a0of\u00a0the\u00a0file\u00a0notings\u00a0and\u00a0any\u00a0other\u00a0communication\u00a0available\u00a0in\u00a0this\u00a0file\u00a0in\u00a0respect\u00a0<\/p>\n
     of\u00a0the\u00a0notices\u00a0that\u00a0have\u00a0been\u00a0issued.\n<\/p>\n
     All\u00a0information\u00a0should\u00a0reach\u00a0the\u00a0Appellant\u00a0by\u00a023.10.11\u00a0and\u00a0the\u00a0Appellant.<\/p>\n
3.   The\u00a0Commission\u00a0also\u00a0directs\u00a0the\u00a0PIO\u00a0to\u00a0show\u00a0cause\u00a0as\u00a0to\u00a0why\u00a0a\u00a0penalty\u00a0should\u00a0not\u00a0be\u00a0imposed\u00a0upon\u00a0<\/p>\n

     besides \u00a0 the \u00a0 reasons \u00a0 as \u00a0 to \u00a0 why \u00a0 \u00a0 he \u00a0 has \u00a0 not \u00a0 bothered \u00a0 to \u00a0 appear \u00a0 for \u00a0 the \u00a0 \u00a0 hearing \u00a0 before \u00a0 the\u00a0<\/p>\n
