BASANT, J.\n\n\n             ````````````````````````````````````````````````````\n\n                       B.A. No. 624 OF 2008 C\n\n             ````````````````````````````````````````````````````\n\n             Dated this the 4th day of February, 2008\n\n\n                                O R D E R\n<\/pre>\n<p>             Application   for   anticipatory   bail.   Petitioner<\/p>\n<p>apprehends   arrest   on   the   allegation   that   he   has   committed<\/p>\n<p>non-bailable offences.  The petitioner was not in a position to<\/p>\n<p>ascertain   the   details   of   the   crime,   if   any,   registered   against<\/p>\n<p>him   and   accordingly   the   petitioner   has   come   to   this   Court<\/p>\n<p>seeking anticipatory bail.\n<\/p>\n<\/p>\n<p>      2.     The   learned   Public   Prosecutor   submits   that   the<\/p>\n<p>petitioner   need   not   apprehend   any   such   arrest   for   non-<\/p>\n<p>bailable   offences.     Crime   No.566\/07   of   the   Kalpakancherry<\/p>\n<p>police station has already been registered.   Investigation into<\/p>\n<p>that   crime   is   now   complete.     Final   report   has   already   been<\/p>\n<p>filed   alleging   offences   punishable   under   sections   448,   427<\/p>\n<p>and 323 IPC.  All offences alleged are bailable.  Petitioner can<\/p>\n<p>appear   before   the   investigating   officer   or   the   learned<\/p>\n<p>BA.624\/08<\/p>\n<p><span class=\"hidden_text\">                                   : 2 :<\/span><\/p>\n<p>Magistrate   and   claim   bail   under   section   436   Cr.P.C.     No<\/p>\n<p>directions   under   section   438   Cr.P.C.   are,   in   these<\/p>\n<p>circumstances,   necessary,   submits   the   learned   Public<\/p>\n<p>Prosecutor.\n<\/p>\n<\/p>\n<p>       3.    I find merit in the opposition by the learned Public<\/p>\n<p>Prosecutor.     The   learned   counsel   for   the   petitioner   also<\/p>\n<p>accepts that if that be so, no further directions under section<\/p>\n<p>438 Cr.P.C. are necessary.\n<\/p>\n<\/p>\n<p>       4.
