No.13911 of 2010\n                             SHASHI KANT JHA, Son of Kamla Kant Jha\n                                                Versus\n                                     THE STATE OF BIHAR\n                                              -----------\n<\/pre>\n<p>4\/      13.08.2010             Heard learned counsel for the parties.<\/p>\n<p>                                   Petitioner is an accused in a case under Sections 379 and<\/p>\n<p>                     302 of the Indian Penal Code for stealing idol of the temple and killing<\/p>\n<p>                     the priest.\n<\/p>\n<p>                                   Learned counsel for the petitioner submits that the<\/p>\n<p>                     petitioner has been implicated on the basis of his own confessional<\/p>\n<p>                     statement. He further submits that no one has seen him either killing<\/p>\n<p>                     the deceased or fleeing away with the idol. The petitioner is in custody<\/p>\n<p>                     since 17.12.2008.\n<\/p>\n<p>                                   In the circumstances, petitioner, named above, is directed<\/p>\n<p>                     to be released on bail on furnishing bail bond of Rs. 5,000\/- (Five<\/p>\n<p>                     thousand) with two sureties of the like amount each to the satisfaction<\/p>\n<p>                     of 1st Addl. Sessions Judge, Samstipur in connection with<\/p>\n<p>                     Dalsinghsarai P.S. case no. 322 of 2008 (S.T. No. 185 of 2009) with<\/p>\n<p>                     the condition that one of the bailors would be his own \/ close relative,<\/p>\n<p>                     who will give an undertaking that they would ensure his presence on<\/p>\n<p>                     the date fixed in the proceeding.
