This application under Section--482 Cr.P.C. has been \ufb01led by\nthe petitioner-Chirantan Sahu with a prayer to quash the proceeding\nin G.R. Case No.223(A) of 2003 (Arising out of Sohela P.S. Case No. 103\nof 2003) pending before the learned J .M.F.C., Sohela inter alia on the\nground that two of the co--accused persons who have faced trial for\noffences under Sections.399, 402 I.P.C. and had been acquitted by the\nlearned Assistant Sessions Judge, Padmapur videi judgment dated\n8.10.2004<\/pre>\n<p> in S.T. Case No.150 of 2004.\n<\/p>\n<p>2. Mr. B.B. Routray, learned counsel appearing for the<br \/>\npetitioner placed reliance on a judgment of this Court in the case of<br \/>\n<a href=\"\/doc\/1326575\/\">Kanhu Behera v. State of Orissa,<\/a> 2005(II) OLR 386 and stated that<br \/>\nsince no prima facie case has been made out against the petitioner<br \/>\nand the co-accused persons who faced trial have been acquitted,<br \/>\nchance of conviction of the petitioner being totally bleak, the order of<br \/>\ncognizance and the proceeding against the petitioner in the aforesaid<br \/>\ncriminal proceeding pending before the J.M.F.C., Sohela may be<br \/>\nquashed.\n<\/p>\n<p>3. The learned Standing Counsel appearing on behalf of the<br \/>\nState submitted that the petitioner though was named as a co-accused<br \/>\nin the F.I.R. and was also named as an accused in the charge sheet<br \/>\nsubmitted in the case, he remained as an absconder and, therefore,<br \/>\ndid not face trial and should not be permitted to take advantage of an<br \/>\norder of acquittal passed in the case of co-accused persons.\n<\/p>\n<p>4. Considering the submissions made by the learned counsel<br \/>\nfor the respective parties and also on perusing the judgment in S.T.<br \/>\nCase No.150 of 2004 dated 8.10.2004, rendered by the Assistant<br \/>\nSessions Judge, Padmapur, I am of the considered view that even<br \/>\nthough an absconder ought not to be normally extended the bene\ufb01t of<br \/>\nthe judgment rendered in the case of a co-accused, but on perusing<br \/>\nthe judgment, as noted hereinabove, it is found that, P.W.11, a Police<br \/>\nSub&#8211;Inspector not only was the informant but was also the<br \/>\nInvestigating Officer. This fact itself is adequate for the purpose of<br \/>\nquashing the criminal proceeding. It is well settled in law that no<br \/>\npolice officer ought to be permitted to act both as an &#8220;informant&#8221; as<br \/>\nwell as the &#8220;Investigating Officer&#8221;, since the rules of natural justice<br \/>\nclearly require that in the event of police officer become the informant,<br \/>\nhe should not conduct the investigation into the said case, since the<\/p>\n<p>said case police officer would have to give evidence as a witness in<\/p>\n<p>course of trial. In this case P.W.11&#8217;s evidence and his F.I.R. as well as<br \/>\nthe \ufb01ling of charge sheet on completion of the investigation becomes<br \/>\nthe basis of the trial.\n<\/p>\n<p>5. Apart from the above, the trial court has taken into account<br \/>\nthe fact that, the prosecution evidence regarding the alleged<br \/>\n&#8220;preparation of dacoity&#8221; is based on the alleged confession of a co-<br \/>\naccused, Shankar (who had faced trial) which evidence is clearly not<br \/>\nadmissible. There exists no other evidence to show that the accused<br \/>\npersons were making any preparation of committing dacoity apart<br \/>\nfrom the confession of the co-accused. Reliance was correctly placed<br \/>\nby the learned counsel for the petitioner on a judgment of the Supreme<br \/>\nCourt in the case of <a href=\"\/doc\/1763485\/\">Chaturi Yadav and others v. State of Bihar,<\/a><br \/>\n1979 Criminal Law Journal 1090 in this regard. Further, since P.W.l1<br \/>\nadmitted that he had \ufb01rst effected the seizure of iron rod and iron<br \/>\npipes at the cremation ground on the alleged confession of the accused<br \/>\nShankar leading to recovery of the said articles, obviously the F.I.R.<br \/>\nitself had not been drawn up at that point of time and, therefore, no<br \/>\ninvestigation could be said to have been taken prior to \ufb01ling of the<br \/>\nF.I.R. Therefore, since the said co&#8211;accused Shankar was admittedly<br \/>\nnot in the custody of police as an &#8220;accused&#8221; at the time of leading to<br \/>\nrecovery as required under law, any recovery or confession before the<br \/>\npolice regarding the occurrence is clearly not admissible under Section<br \/>\n27 of the Evidence Act.\n<\/p>\n<p>6. Considering the aforesaid circumstances and the evidence of<br \/>\nthe present case, I am of the considered View that no real purpose<br \/>\nwould be served by directing the continuance of the criminal<br \/>\nproceeding against the present petitioner, since the chance of<br \/>\nconviction of the petitioner is totally bleak. Apart from the aforesaid<br \/>\nfact, from the judgment passed by the trial court as referred in above,<\/p>\n<p>it is clear therefrom that, noprima facie case has been made out<\/p>\n<p>against the petitioner for the alleged offences and the principal<br \/>\naccused persons who purportedly made the confession before the<br \/>\nP.W.11&#8211;Investigating Officer and had purportedly led to the recovery of<br \/>\nvarious material objects connected to the alleged crime have already<br \/>\nbeen acquitted, after a full \ufb02edged trial.\n<\/p>\n<p>7. Therefore, the G.R. Case I\\lo.223(A) of 2003 (Arising out of<br \/>\nSohela P.S. Case No.103 of 2003) pending before the learned<br \/>\nJ.M.F.C., Sohela is directed to be quashed against the present<br \/>\npetitioner-Chirantan Sahu. 0<\/p>\n<p>Accordingly, the CRLMC is allowed in terms of the direction<\/p>\n<p>noted hereinabove.\n<\/p>\n<p>SON&#8217; 1.
