On\t May 21, 1956, 1\/3rd<br \/>\nshare of  Smt. Shahida\tKhatoon was declared evacuee. In the<br \/>\nproceedings  initiated\t under\tthe   Custodian\t of  Evacuee<br \/>\nProperty Act,  1950, under  section 7  declaration,  it\t was<br \/>\nrecorded as  evacuee property  and thereafter  the appellant<br \/>\nhad purchased  the same.  In the  consolidation\t proceedings<br \/>\nunder the  Consolidation Act the objections came to be filed<br \/>\nby the\trespondent. The\t appellant claimed  that he  was  in<br \/>\nadverse possession and that, therefore, he is entitled to be<br \/>\nrecorded as  a sirdar  in one  khata and  Bhumidar in  other<br \/>\nkhata. Though  the Consolidation  Officer and the Settlement<br \/>\nOfficer on appeal upheld the finding but in revision the Dy.<br \/>\nDirector upset\tthe finding  and held that the appellant was<br \/>\nto in  adverse possession.  That order\tcame to\t be made  on<br \/>\nNovember 18,  1965. Calling  in\t question  that\t order,\t the<br \/>\nappellant had  filed a\twrit petition.\tThe respondent\talso<br \/>\nfiled another  writ petition  against a part of the order of<br \/>\nthe Dy.\t Director wherein  in respect of Khata No. 90 it was<br \/>\nheld that  she was  not entitled to the declaration that she<br \/>\nwas the sirdar. Both the writ petitions were dismissed. When<br \/>\nspecial\t appeal\t  was  filed,\tthe  Division  Bench,  while<br \/>\nreversing the finding of the single Judge that the appellant<br \/>\nhad adverse  possession as  recorded by the Dy. Director. On<br \/>\nthe finding with regard to the title in Khata No. 90, it was<br \/>\nheld that  since the  respondent was  not impleaded  in\t the<br \/>\nproceedings of\tthe U.P.  Zamindari Abolition  Act the claim<br \/>\nsettlement made, did not bind her she being in possession as<br \/>\nthe sirdar and accordingly, she was entitled to the benefits<br \/>\nof consolidation.  Thus this appeal by special leave against<br \/>\nthe order  of the  Division Bench  dated July  30,  1974  in<br \/>\nSpecial Appeal No. 1038 of 1969 etc.<br \/>\n     Shri  Francis,   learned  counsel\t for  the  appellant<br \/>\ncontended that\tthe High Court and the Dy. Director were not<br \/>\nright in recording the finding that the appellant was not in<br \/>\nadverse possession  in the face of the proceedings initiated<br \/>\nby the\tAsstt. Director of the Custodian of Evacuee Property<br \/>\nand sale thereof by them. The question whether the appellant<br \/>\nis in  adverse possession  is a\t finding of fact recorded by<br \/>\nthe Dy.\t Director as  upheld by\t the Division  Bench.  Under<br \/>\nthose circumstances,  we cannot go into the question for the<br \/>\nfirst time  in this  appeal.  In  respect  of  Khata  No.218<br \/>\nrelating, to  1 bigha  9 biswas, it being a finding of fact,<br \/>\nwe cannot interfere with the same.\n<\/p>\n<p>     It is  then contended  that in  view of the judgment of<br \/>\nthe Full  Bench of the Allahabad High Court in Avdhesh Singh<br \/>\nv. Bikarma  Ahir [AIR  1975 Allahabad 324], the appellant is<br \/>\nentitled to  the relief\t on second  point, in  view  of\t the<br \/>\nfinding No.1 as recorded by the Full Bench. We find that the<br \/>\ncontention is  not  wholly  sound.  It\tis  to\tbe  read  in<br \/>\nconjunction with  the finding  on point\t No.2 referred to by<br \/>\nthe larger Bench of 5 Judges. The Full Bench recorded thus;\n<\/p>\n<blockquote><p>     &#8220;Finality of Compensation Statement<br \/>\n     under Section 240-J, U.P. Zamindari<br \/>\n     Abolition\tand   Land  Reforms  Act<br \/>\n     extinguishes the  rights and  title<br \/>\n     of the  land-holder  and  the  land<br \/>\n     holder is\tdebarred from showing in<br \/>\n     collateral or  separate proceedings<br \/>\n     that the  land is\tnot held  by  an<br \/>\n     Adhivasi, except in cases where the<br \/>\n     provisions of the Act have not been<br \/>\n     followed or  where the Compensation<br \/>\n     Statement\thas   been  prepared  in<br \/>\n     disregard\t of    the   fundamental<br \/>\n     principles\t of  judicial  procedure<br \/>\n     (Katikara\t Chintamani    Dora   v.<\/p><\/blockquote>\n<blockquote><p>     Guatreddi Annamanaidu,  AIR 1974 SC<br \/>\n     1069). If\tthe requirements  of the<br \/>\n     Act have  not been complied with or<br \/>\n     the   fundamental\t principles   of<br \/>\n     judicial\tprocedure    have   been<br \/>\n     disregarded,    the    Compensation<br \/>\n     Statement signed  and sealed by the<br \/>\n     Compensation Officer  under Section<br \/>\n     240-J  (2)\t  of  the   Act\t can  be<br \/>\n     assailed in collateral proceedings.<br \/>\n\t  The\tCompensation   Statement<br \/>\n     signed  and  sealed  under\t Section<br \/>\n     240-J  (2)\t of  the  Act  is  final<br \/>\n     between the  land\tholder\tand  the<br \/>\n     State alone.<\/p><\/blockquote>\n<blockquote><p>\t  The land-holder  against  whom<br \/>\n     Compensation Statement  has  become<br \/>\n     final   and    who\t  has\treceived<br \/>\n     compensation has no locus standi to<br \/>\n     reagitate his  rights in respect of<br \/>\n     the land in question.&#8221;<\/p><\/blockquote>\n<p>     Though on\tfinding No.(1)\tit was held that finality of<br \/>\nCompensation Statement\tunder  Section\t240-J  of  the\tU.P.<br \/>\nZamindari Abolition  and Land  Reforms Act  extinguishes the<br \/>\nrights and  title of  the land-holder and the land-holder is<br \/>\ndabarred from  showing in collateral or separate proceedings<br \/>\nthat the  land is  not held  by an Adhivasi, except in cases<br \/>\nenumerated later.  The Compensation  Statement as  found  in<br \/>\npoint No.2  signed and\tsealed under  Section 240-J is final<br \/>\nbetween the  land-holder and the State alone. In the absence<br \/>\nof Adhivasi  being a party to those proceedings, any finding<br \/>\nrecorded would\tnot  bind  the\tAdhivasi.  The\tHigh  Court,<br \/>\ntherefore, has\theld that  the Adhivasi\t was entitled  to be<br \/>\nrecognized under  the Act. This being the finding, though on<br \/>\npoint No.1  the appellant may have a case, on point No.2, he<br \/>\ncannot get the relief.\n<\/p>\n<p>     The appeals are accordingly dismissed.
