Ahmedabad on dated 29.07.2011 as<br \/>\nthe law laid down by the Apex Court., dated 29\/07\/2011&#8221;.<br \/>\n What is further prayed is that, &#8220;Be pleased to<br \/>\ndirect the respondent to comply the law establish by the<br \/>\nConstitutional Bench of Hon&#8217;ble Supreme Court of India in case of<br \/>\nJaipur Jilla Sahakari Sangh U\/s.33 (2) (b) of Industrial Disputes<br \/>\nAct, 1947 and to reinstate the petitioner on his original post<br \/>\nwith continuity of service and with full back wages.&#8221;\n<\/p>\n<p>2.\t\tLearned Advocate Mr.Acharya<br \/>\nfor the petitioner files an affidavit for placing further documents<br \/>\nbefore this Court. Along with affidavit, he has placed a copy of<br \/>\norder dated 01\/10\/2010 which is titled as &#8216;dismissal order&#8217;.  Second<br \/>\nparagraph of that order reads as under:\n<\/p>\n<p>&#8220;In<br \/>\nthis circumstances, it is presumed that you have no explanation to<br \/>\nsecond show cause notice and therefore you are dismissed from your<br \/>\nservices of Max Vigil Security with effect from 1st<br \/>\nOct.2010.  A cheque No.869327 dated 1st<br \/>\nOct.2010 of SBI, RTO Branch, Ahmedabad of Rs.7124\/- (Rupees seven<br \/>\nthousand one hundred and twenty four only) for one month notice pay<br \/>\nis attached, as per section 33 (2) (b) of Industrial Disputes Act,<br \/>\n1947.&#8221;\n<\/p>\n<p>3.\t\tAlongwith that learned<br \/>\nAdvocate for the petitioner has also produced order dated 14\/09\/2000<br \/>\nissued by the Ministry of Labour, Government of India.  Learned<br \/>\nAdvocate for the petitioner invited attention of the Court to the<br \/>\nwithdrawal application filed by the respondent herein which is<br \/>\nproduced at Annexure &#8211; D (Page No.23).  Learned Advocate for<br \/>\nthe petitioner also invited attention of the Court to order passed on<br \/>\n29\/07\/2011 by the Presiding Officer, CGIT cum Labour Court, Ahmedabad<br \/>\nin Approval Application (CGITA) No.1 of 2011 &#8211; Annexure &#8211; E<br \/>\n(Page No.25) whereby Exh.11 application is allowed and approval<br \/>\napplication is dismissed as withdrawn.\n<\/p>\n<p>4.\t\tLearned<br \/>\nAdvocate for the petitioner is not able to show to this Court that<br \/>\nany reference is pending against the respondent herein.  If that is<br \/>\nso, how come an application<br \/>\nfor approval was filed by the present respondent. It appears that<br \/>\nthere is no reference pending as on date against the present<br \/>\nrespondent and if that is so there was no question of filing any<br \/>\napproval application and there is nothing wrong in withdrawing that<br \/>\napplication.\n<\/p>\n<p>4.1\t\tIf<br \/>\nunder misconception, any application is filed, that will not give any<br \/>\nright to the present petitioner.  Learned Advocate for the petitioner<br \/>\nmade available for perusal a decision of the Hon&#8217;ble the Supreme<br \/>\nCourt in the matter of &#8216; Jaipur Zila Sahakari Bhoomi<br \/>\nVikas Bank Ltd., Vs. Ram Gopal Sharma &amp; Ors.,&#8217;<br \/>\nreported in 2002 I LLJ 834.  But, on the face of it, that will have<br \/>\nno application to the facts of the present case as well as there is<br \/>\nno reference pending against the respondent herein.\n<\/p>\n<p>5.\t\tIn view of the above, present<br \/>\npetition is not only misconceived but is without any substance.
