DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 07\/09\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tHeard<br \/>\nthe learned advocates for the parties and perused the record.\n<\/p>\n<p>\tDeputation<br \/>\nis an &#8216;exigency of service&#8217; and the petitioners admittedly appointed<br \/>\nwith the respondent-Corporation are ordered to work on deputation in<br \/>\nthe Department of Industry &amp; Mines, State of Gujarat, which<br \/>\ncannot be said to be a &#8216;foreign service&#8217; as defined under the Gujarat<br \/>\nCivil Services [Joining Time, Foreign Service, Deputation out of<br \/>\nIndia, Payment during suspension, dismissal and Removal) Rules, 2002,<br \/>\nmore particularly Rule 36, under Chapter IV, where transfer to<br \/>\nforeign service is not permissible without consent of the employee,<br \/>\nbut the proviso thereto carves out that, in the case of transfer of a<br \/>\ngovernment employee to the service of  body incorporate which is<br \/>\nwholly or substantially owned or controlled by the Government, the<br \/>\nabove provision of obtaining &#8216;consent&#8217;  of an employee for deputation<br \/>\nwill not be applicable. The same is true vice-versa when an employee<br \/>\nof the Corporation is sought to be deputed to a government<br \/>\ndepartment.\n<\/p>\n<p>\tIn<br \/>\nthe above circumstances, the order of status-quo granted earlier<br \/>\nstands vacated.\n<\/p>\n<p>\tS.O.\n<\/p>\n<p>To   24th November 2011.\n<\/p>\n<p>(ANANT<br \/>\nS.
