JUSTICE HARSHA DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/10\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nthis application, the applicant seeks condonation of delay of 284<br \/>\ndays  that has occurred in filing Second Appeal Stamp No.72\/2011.\n<\/p>\n<p>2.\t\tMr.\n<\/p>\n<p>Ashok Patel, learned advocate for Mr. J.D. Ajmera, learned advocate<br \/>\nfor the applicant has invited attention to the averments made in the<br \/>\napplication to submit that the applicant has sufficiently explained<br \/>\nthe delay that has occasioned in filing the second appeal and as<br \/>\nsuch, the delay deserves to be condoned.\n<\/p>\n<p>3.\t\tThis<br \/>\ncourt has also heard Mr. Ketan Dave, learned advocate appearing on<br \/>\nbehalf of the opponents.\n<\/p>\n<p>4.\t\tHaving<br \/>\nregard to the averments made in the application, in the opinion of<br \/>\nthis court, sufficient cause has been made out so as to condone the<br \/>\ndelay caused in filing the second appeal.  In the circumstances, the<br \/>\napplication is allowed.  The delay caused in filing Second Appeal<br \/>\nStamp No.72\/2011 is hereby condoned.
