03\/   30.09.2011                  Heard learned counsel for the petitioner<\/p>\n
                       and the State.\n<\/p>\n
                                  2. At the relevant time, petitioner served<\/p>\n
                       as District Superintendent of Education, Buxar. By<\/p>\n
                       the impugned notification, bearing Memo No. 535<\/p>\n
                       dated 9.9.2004, Annexure-1, she has been inflicted<\/p>\n
                       with punishment of censure and non-payment of<\/p>\n
                       full salary beyond the subsistence allowance during<\/p>\n
                       the period of suspension in the light of the enquiry<\/p>\n
                       report dated 20.10.2003, Annexure-5 wherefrom it<\/p>\n
                       appears that petitioner was proceeded against for<\/p>\n
                       eight charges and she has been exonerated of the<\/p>\n
                       seven charges, but held partially guilty of charge<\/p>\n
                       no.8 that she accepted the joining of the two
\n                    2<\/span><\/p>\n
teachers who were under unauthorized absence<\/p>\n
without the approval of the District Magistrate or<\/p>\n
the Education Establishment Committee.<\/p>\n
          3.    It is submitted on behalf of the<\/p>\n
petitioner that as she has been exonerated of the<\/p>\n
seven charges levelled against her and found<\/p>\n
partially guilty of charge no.8 only, she should<\/p>\n
have been paid full salary for the suspension<\/p>\n
period. In this connection, it is further pointed out<\/p>\n
that from the enquiry report itself, it will appear<\/p>\n
that the defence of the petitioner that the joining of<\/p>\n
the two teachers was accepted under the orders of<\/p>\n
the District Magistrate, was accepted by the<\/p>\n
Enquiry Officer, yet petitioner has been held<\/p>\n
partially guilty of the said charge as the joining of<\/p>\n
the two teachers was to be accepted only for the<\/p>\n
purposes of subjecting them to departmental<\/p>\n
proceeding, but petitioner allowed them to<\/p>\n
discharge the duties of teacher after accepting their<\/p>\n
joining, which was held to be a procedural mistake<\/p>\n
and in appreciation of such fact, full salary ought to<\/p>\n
have been released for the suspension period.
\n                   3<\/span><\/p>\n
          4.   As the petitioner has been found<\/p>\n
partially guilty of charge no.8 levelled against her,<\/p>\n
before proceeding to withhold the salary beyond<\/p>\n
the subsistence allowance, the authorities should<\/p>\n
have issued notice under sub-rule (2) of Rule 97 of<\/p>\n
the Bihar Service Code and considered her<\/p>\n
response to such notice.\n<\/p>\n
          5.   Accordingly, I set aside paragraph<\/p>\n
no.2 of the impugned notification dated 9.9.2004,<\/p>\n
Annexure-1 directing the Director (Administration)<\/p>\n
to issue notice to the petitioner to show cause as to<\/p>\n
why her salary beyond the subsistence allowance<\/p>\n
for the period of suspension be not withheld and<\/p>\n
after considering her response, pass appropriate<\/p>\n
order in the matter. Notice in compliance of this<\/p>\n
order be issued to the petitioner as early as<\/p>\n
possible, in any case within two months from the<\/p>\n
date of receipt\/ production of a copy of this order<\/p>\n
before   the    Director    (Administration)     and<\/p>\n
appropriate final order be passed within a<\/p>\n
reasonable time of the receipt of the reply, which<\/p>\n
the petitioner should file within two weeks of the
\n                              4<\/span><\/p>\n
         receipt of the notice. While considering the show<\/p>\n
         cause reply, the authorities should consider the fact<\/p>\n
         that Collector while directing the petitioner to<\/p>\n
         accept the joining of the two teachers never asked<\/p>\n
         the petitioner that the joining of the two teachers is<\/p>\n
         to be accepted for the limited purpose i.e. for<\/p>\n
         subjecting them to departmental proceeding. If that<\/p>\n
         was the intention, Collector should have clarified<\/p>\n
         in his order that after accepting the joining of the<\/p>\n
         two teachers, their joining report be put up for<\/p>\n
         further orders.\n<\/p>\n
                   6.      The writ petition is, accordingly,<\/p>\n
         disposed of.\n<\/p>\n<\/p>\n
