Civil Application praying for extension<br \/>\n\tof time upto statutory time limit for approaching the higher forum.\n<\/p>\n<p>Heard<br \/>\n\tMs.P. J. Joshi, learned advocate appearing for the applicant,<br \/>\n\tMr.P.C.Chaudhari, learned advocate appearing for the opponent No.3<br \/>\n\tand Ms.Jirga Jhaveri, learned AGP appearing on behalf of the<br \/>\n\topponent No.1.\n<\/p>\n<p>The<br \/>\n\tDivision Bench of this Court has passed an order on 6th<br \/>\n\tMay, 2010 in Letters Patent Appeal No.678 of 2010 whereby on the<br \/>\n\trequest of Ms.Joshi, the Labour Court was directed not to disburse<br \/>\n\tthe amount before 1st June, 2010. The Division Bench of<br \/>\n\tthis Court has further made it clear that the remaining part of the<br \/>\n\torder  shall operate in the meantime. Ms.Joshi has submitted that<br \/>\n\tthe applicant wants to challenge the order dated 6th May,<br \/>\n\t2010 before the Apex Court. However, because of the vacation as well<br \/>\n\tas bulky record of Special Civil Application and Letters Patent<br \/>\n\tAppeal, it is not possible for the applicant to approach the Apex<br \/>\n\tCourt within the prescribed time limit and hence, the time may be<br \/>\n\textended.\n<\/p>\n<p>Mr.P.\n<\/p>\n<p>\tC. Chaudhari, learned advocate appearing on behalf of the opponent<br \/>\n\tNo.3, on the other hand, has opposed this application and submitted<br \/>\n\tthat the opponent   union has shown its willingness to file an<br \/>\n\tundertaking before the Labour Court to repay the amount disbursed in<br \/>\n\tfavour of the workmen in case the order of this Court is reversed by<br \/>\n\tthe Apex Court and hence, no prejudice will be caused to the<br \/>\n\tapplicant.\n<\/p>\n<p>Having<br \/>\n\tconsidered the submissions of the learned advocates for the parties,<br \/>\n\tthe Court is of the view that because of the vacation and bulky<br \/>\n\trecord of the proceedings, further time is required to be granted<br \/>\n\tupto 30th June, 2010. The Labour Court is, therefore,<br \/>\n\tdirected not to disburse the amount in favour of the workmen upto<br \/>\n\t30th June, 2010. It is made clear that  the other<br \/>\n\tdirection of the order dated 6th May, 2010 issued by the<br \/>\n\tDivision Bench of this Court  would  remain and they are required to<br \/>\n\tbe complied with by the applicant and opponent No.2.\n<\/p>\n<p>This<br \/>\n\tapplication is accordingly disposed of.
