Learned Standing Counsel is present<br \/>\nfor the respondents. None appears on behalf of the private<br \/>\nrespondents.\n<\/p>\n<p>The petitioner is permitted to implead Sub Divisional Magistrate,<br \/>\nNakud, Saharanpur as respondent no. 5 in this writ petition. Let<br \/>\nnecessary correction be made during the course of the day.\n<\/p>\n<p>Supplementary affidavit has been filed today. Let the same be<br \/>\ntaken on record. By means of this writ petition and supplementary<br \/>\naffidavit the petitioner seeks to challenge the impugned orders<br \/>\ndated 16.4.2009 passed by Commissioner, Saharanpur Division,<br \/>\nSaharanpur and order dated 7.1.2008 passed by the Sub Divisional<br \/>\nMagistrate, Nakud, Saharanpur.\n<\/p>\n<p>Heard Sri Amarjeet Singh learned counsel for the petitioner and<br \/>\nlearned Standing Counsel for the respondents. Counter and<br \/>\nrejoinder affidavits have been exchanged.\n<\/p>\n<p>The petitioner claims that he was a fair price shop dealer of village<br \/>\nDaidnor, Block Nakud, District Saharanpur and is aggrieved by the<br \/>\norder dated 16.4.2009 passed by Commissioner, Saharanpur<br \/>\nDivision, Saharanpur in Appeal No. 29\/07-08 under the Essential<br \/>\nCommodities Act whereby the appeal filed by the petitioner has<br \/>\nbeen rejected and the order dated 7.1.2008 passed by the Sub<br \/>\nDivisional Magistrate, Nakud, Saharanpur has been confirmed.\n<\/p>\n<p>Learned counsel for the petitioner has submitted that the only<br \/>\nreason for cancellation of his fair price shop dealership was that<br \/>\nthe petitioner had indulged in irregularities and was selling<br \/>\nkerosene oil at Rs. 11 instead of Rs. 10.50. He submits that no<br \/>\nspecific incident has been reported even in the report of the<br \/>\nEnquiry Officer and general allegations have been made to which<br \/>\nhe was required to show cause.\n<\/p>\n<p>According to Sri Amarjeet Singh the impugned orders have been<br \/>\n passed primarily on the basis that the petitioner has not been able<br \/>\nto produce evidence that he has not committed any irregularity.<br \/>\nAccording to him when no specific charge with respect to an<br \/>\nidentified card holder or incident was made against the petitioner<br \/>\nthere was no occasion for him to reply to such non existent charge.\n<\/p>\n<p>Learned Standing Counsel has tried to justify the impugned orders<br \/>\nby saying that complaints were received against the petitioner and<br \/>\nan enquiry was conducted by the inspector. He states that in an<br \/>\nenquiry it was found that the petitioner is indulging in irregular<br \/>\ndistribution of foodgrains and is charging Rs. 11 instead of Rs.<br \/>\n10.50 for kerosene oil. He submits that the enquiry which was<br \/>\nconducted has found those irregularities of the petitioner and hence<br \/>\nthe impugned orders based thereupon cannot be said to be illegal.\n<\/p>\n<p>Having considered the submission of learned counsel for the<br \/>\nparties and perused the record from both the impugned orders it is<br \/>\nquite clear that allegations were made in a complaint against the<br \/>\npetitioner but such allegations were of a general nature by saying<br \/>\nthat in several months the petitioner has not distributed foodgrains<br \/>\nto card holders. Neither the card holders nor the name of the card<br \/>\nholder has been mentioned in the said complaint. Even the<br \/>\ncomplaint with respect to the months is general and no date has<br \/>\nbeen given. It is stated that in several months he has committed<br \/>\nthose irregularities. Out of 12 complainants 11 complainants filed<br \/>\naffidavits before the authority in favour of the petitioner.<br \/>\nConsequently even if one complainant was persisting with the<br \/>\ncomplaint he ought to have given specifics of the irregularities<br \/>\ncommitted by the petitioner. A general allegation that the<br \/>\npetitioner is committing the irregularities in distribution of<br \/>\nfoodgrains cannot be made a ground for cancellation of his fair<br \/>\nprice shop agreement which is admittedly a contract between the<br \/>\nparties. If there is no breach of the contract it cannot be cancelled.\n<\/p>\n<p>In so far as the allegations that the petitioner is selling kerosene oil<br \/>\nat Rs. 11 per litre instead of Rs. 10.50 litre it is not supported by<br \/>\nany specific instance or evidence and it is a general allegation. The<br \/>\nappellate authority has also dittoed the findings of the Sub<br \/>\nDivisional Magistrate in its order and has not given any reason as<br \/>\nto how and when the petitioner had committed an irregularity, in<br \/>\nthe absence of any such reason the impugned order appears to be<br \/>\narbitrary.\n<\/p>\n<p>Moreover fair price shop dealership of the petitioner has been<br \/>\ncancelled also on the ground that the petitioner has not been able<br \/>\nto give satisfactory explanation. If the petitioner was required to<br \/>\n give explanation to a charge framed or alleged against him the<br \/>\ncharge or allegations could be replied. The show cause notice was<br \/>\ngeneral in nature and the petitioner has replied accordingly.<br \/>\nConsequently it cannot be said that the licence of the fair price<br \/>\nshop of the petitioner should be cancelled because his explanation<br \/>\nis not satisfactory.\n<\/p>\n<p>For the aforesaid reasons the impugned orders cannot be up held.<br \/>\nThe impugned order dated 16.4.2009 passed by Commissioner,<br \/>\nSaharanpur Division, Saharanpur in Appeal No. 29\/07-08 and the<br \/>\norder dated 7.1.2008 passed by the Sub Divisional Magistrate,<br \/>\nNakud, Saharanpur are hereby set aside.
