The<br \/>\nrespondent No.1 has, in his said affidavit dated 23.7.2008, stated<br \/>\nthat the office of respondent No.1 has issued summons to the<br \/>\nrespondents No.2 and 3 intimating that if the payment is not made<br \/>\nthen auction process will be commenced. It is also mentioned that the<br \/>\nprocess of recovery of dues by way of land revenue takes about 2 to 3<br \/>\nmonths time and therefore, the respondent No.1 needs about 3 months<br \/>\ntime to complete the process of auction and recovery. Mr. Mehta for<br \/>\nthe petitioner is agreeable with the said request for 3 months time<br \/>\nby respondent No.1. He submitted that the petition may be disposed<br \/>\noff with appropriate direction to the respondents in view of the<br \/>\naffidavit made by the respondent No.1.\n<\/p>\n<p>\tSo<br \/>\nfar as respondent No.2 is concerned, the cause list shows that the<br \/>\nnotice by the court has been refused.\n<\/p>\n<p>\tIn<br \/>\nview of the aforesaid submissions by the learned counsel of the<br \/>\nrespective parties, the respondent No.1 is directed to complete the<br \/>\nprocess of recovery of amount in question by way of land revenue by<br \/>\nfollowing necessary procedure in accordance with law on or before<br \/>\n24th October, 2008.\n<\/p>\n<p>\tWith<br \/>\nthe aforesaid observation and direction, present petition is disposed<br \/>\noff. Notice discharged. Ad-interim relief, if any, granted earlier<br \/>\nstands vacated forthwith.
