Petitioner is challenging Ext.P11 order issued by the<\/p>\n<p>revisional authority under the Kerala Building Tax Act, 1975,<\/p>\n<p>wherein Ext.P10 petition submitted seeking restoration of the<\/p>\n<p>revision petition is rejected. Against the assessment of Building<\/p>\n<p>Tax, the petitioner had filed appeal before the Revenue<\/p>\n<p>Divisional Officer and during pendency of that appeal, the<\/p>\n<p>petitioner had remitted 25% of the tax assessed. Ext.P8 is the<\/p>\n<p>receipt evidencing such payment. The revision petition against<\/p>\n<p>the order in appeal was filed during October 2008. According to<\/p>\n<p>the petitioner he had remitted another 25% of the amount on<\/p>\n<p>7.11.2008 as evidenced by Ext.P7 receipt. But the revisional<\/p>\n<p>authority without noticing such remittance had rejected the<\/p>\n<p>revision petition as evidenced by Ext.P9 dt. 6.3.2009. Therefore<\/p>\n<p>the petitioner submitted Ext.P10 interim application seeking<\/p>\n<p>restoration of the appeal pointing out that 50% of the tax amount<\/p>\n<p>assessed, which is pre-requisite for considering the revision, has<\/p>\n<p>already been paid.      But through Ext.P11 that petition was<\/p>\n<p>dismissed holding that the revision petition once dismissed could<\/p>\n<p><span class=\"hidden_text\">W.P.(C).32864\/09-C               2<\/span><\/p>\n<p>not be considered again and further alleging that there is delay<\/p>\n<p>in filing Ext.P10.\n<\/p>\n<p>       2.   It is evident from the facts stated above that Ext.P9<\/p>\n<p>order rejecting the revision petition was happened to be issued<\/p>\n<p>only because the remittance made through Ext.P7 was not<\/p>\n<p>noticed.      Therefore it is evident that there was proper<\/p>\n<p>compliance of the pre-requisite condition of deposit of tax, for<\/p>\n<p>entertaining the revision petition.\n<\/p>\n<p>       3.   Under the above circumstances Ext.P9 and P11 orders<\/p>\n<p>are hereby quashed.
