PUBLIC PROSECUTOR\nfor Applicant(s) : 1, \nRULE\nSERVED for Respondent(s) : 1 -\n2. \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 17\/01\/2011\n \n\nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of present application the applicant-State has challenged the<br \/>\n\torder dated 26th May 2010 passed by the learned<br \/>\n\tAdditional Sessions Judge, Dahod in Criminal Revision Application<br \/>\n\tNo.26 of 2010 whereby the respondents-accused were granted regular<br \/>\n\tbail.\n<\/p>\n<p>Heard<br \/>\n\tMr.H.L. Jani, learned Additional Public Prosecutor appearing for the<br \/>\n\tapplicant-State. Mr.Jani has contended that under Section 397 of the<br \/>\n\tIndian Penal Code the learned Judge has allowed the application and<br \/>\n\tboth the respondents-accused were released on bail. He has also<br \/>\n\tcontended that both the respondents-accused are involved in a<br \/>\n\tserious offence of gang rape. He has also contended that without<br \/>\n\tapplication of mind the learned Judge has allowed the application<br \/>\n\tand released the respondents-accused on bail. He, therefore,<br \/>\n\tcontended that the order dated 26th May 2010 passed by<br \/>\n\tthe learned Judge is required to be quashed and set aside and the<br \/>\n\trespondents-accused may be directed to surrender themselves.\n<\/p>\n<p>I<br \/>\n\thave gone through the papers produced before me as well as<br \/>\n\tsubmissions advanced by Mr.Jani, learned Additional Public<br \/>\n\tProsecutor. I have also perused the order passed by the learned<br \/>\n\tJudge.\n<\/p>\n<p>Though<br \/>\n\tthe respondents-accused were served, they are not present before the<br \/>\n\tCourt personally or through advocate. It appears from the papers<br \/>\n\tthat between the period 13th January 2010 and 14th<br \/>\n\tFebruary 2010 respondents-accused were not produced before the lower<br \/>\n\tCourt and they are illegally detained by the investigating agency.<br \/>\n\tIt also appears from the papers that the investigating agency was<br \/>\n\ttotally negligent and due to the fault of the investigating agency,<br \/>\n\tthe said application was allowed by the learned Judge. The learned<br \/>\n\tJudge has observed every aspect of the matter and thereafter passed<br \/>\n\tthe order.\n<\/p>\n<p>In<br \/>\n\tview of above observations, I am of the opinion that present<br \/>\n\tapplication deserves to be dismissed and is hereby dismissed.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
