4. The trial court has found that, I.A No.7 has been
\nfiled after the commencement of trial and that, there is<\/p>\n
twisting of facts by the plaintiff to suit his convenienc.\u00a7:-:::.”\u00bb..Et<\/p>\n
has further found that, there is no due diligence  <\/p>\n
of the piaintiff and hence, the prayer in LA  be<\/p>\n
ailowed.\n<\/p>\n

7. The only material reason stated in the affidavit<\/p>\n
in support of LA No.7 is that, the mistake in the schedule is<\/p>\n
not intentional, but on account of previous counsel—-___not<\/p>\n
mentioning the appropriate schedule. It is <\/p>\n
there is no due diligence. The defendants 2 &   <\/p>\n
written statement on 28.03.2006 have”-cate’gorVi.ca’i:vlyf <\/p>\n
that, the 2″” defendant purchased   blearing <\/p>\n
Nos.176\/1 8?. 175\/2 under the’-re’gistered…sal,ej’\u00bb_.de-ed””dated ‘ 0<\/p>\n
09.09.1992 from its prev_ious,low-nae-rs””\u00bband hie”-was put in
\npossession of both the items’ oi’:_\u00a7rope’ArtVi_e_5Lon that day and
\nthe entries in revenue  his name and that,<\/p>\n
\\  V.\n<\/p>\n
he has Qvbtaimed”–‘De.r_n1issi..o’ri-pt.the Deputy Commissioner to
\nmake use’o.f4’14 gu.nt”aS  in Survey No.176\/2 for non~<\/p>\n
agricujturai purposes and the same was granted on<\/p>\n
 “o’7\u00ab..:’:o.1saf4fit has been further stated that, 2″” defendant<\/p>\n
s’ti,bsequenti,\u00a7\/1 oi>t~ained licence to carry out construction in<\/p>\n
 _ acco”rdan,.c’e  the plan, on the alienated portion of the<\/p>\n
 ,V,l”and,_bea’ring Survey No.176\/2 and the same was granted on<\/p>\n
2289.1-1–.*’i1995 and thereafter, hetook up construction and<\/p>\n
completed it and has occupied the house so constructed<\/p>\n

along with his family members and stayed there till 2005<\/p>\n
and subsequently leased out to a tenant. It hasbeen<\/p>\n
further stated that, he sold distinct portions in  <\/p>\n
