2.    This   is   an   appeal   against   the   order   dated   28.09.2007 <\/p>\n
      of   the   Division   Bench   of   the   Calcutta   High   Court   in <\/p>\n
      Writ Petition No. 7987 (W) of 2002.\n<\/p>\n
3.    The facts  very briefly  are  that during  the British  rule, <\/p>\n
      Victoria   Memorial   Hall   was   built   in   the   memory   of <\/p>\n
      Queen   Victoria   in   Central   Kolkata.                      After <\/p>\n
      independence,  this  monument   continues  to  be  known <\/p>\n
      for   its   beautiful   architecture   and   green   surroundings.\n<\/p>\n
                                      2<\/span><\/p>\n
      To   the   north   of   the   Victoria   Memorial   Hall   is   a   huge <\/p>\n
      stretch of land known as `the Maidan’ which is covered <\/p>\n
      by green grass and interspersed with a large number of <\/p>\n
      trees, bushes and shrubs.  At the end of about 2 kms.\n<\/p>\n
      of   this   greenery   is   the   Esplanade   where   another <\/p>\n
      monument known as the `Sahid Minar’ stands, and by <\/p>\n
      the   side   of   the  Sahid   Minar  is   a   bus   terminus.     To <\/p>\n
      protect and preserve the Victoria Memorial Hall and its <\/p>\n
      green   surroundings,   a   public   interest   litigation   (Writ <\/p>\n
      Petition No. 7987(W) of 2002) was filed in the Calcutta <\/p>\n
      High Court by the respondent nos. 1 to 5.\n<\/p>\n
4.        After   hearing   all   concerned   parties   and   considering <\/p>\n
      the concerned affidavits and counter-affidavits  as well <\/p>\n
      as   recommendations   of   expert   bodies   including   the <\/p>\n
      National         Environmental            Engineering         Research <\/p>\n
      Institute   (for   short   `NEERI’),   the   High   Court  inter   alia <\/p>\n
      directed in the impugned order that the bus terminus <\/p>\n
      at   Esplanade   be   shifted   to   a   distant   place   within   six <\/p>\n
      months.     Aggrieved  by   this   direction   in   the   impugned <\/p>\n
      order, the State of West Bengal is in appeal before us.\n<\/p>\n
                                     3<\/span><\/p>\n
5.    Learned   counsel   for   the   appellant   submitted   that   the <\/p>\n
      High   Court   could   not   have   issued   directions   to   the <\/p>\n
      State Government to shift the bus terminus located at <\/p>\n
      Esplanade, which had been in existence for more than <\/p>\n
      six decades only on the recommendation of NEERI.  He <\/p>\n
      submitted that lakhs of people every day arrive at and <\/p>\n
      depart from the bus terminus at Esplanade and this is <\/p>\n
      because the bus terminus is located  in a central area <\/p>\n
      of   Kolkata.     He   submitted   that   shifting   of   the   bus <\/p>\n
      terminus   from   Esplanade   will   thus   cause   immense <\/p>\n
      inconvenience   to   the   traveling   public.     He   further <\/p>\n
      submitted that the bus terminus is situated 2 kms. to <\/p>\n
      the north of Victoria Memorial Hall and does not at all <\/p>\n
      damage   this   historic   monument.     The   High   Court, <\/p>\n
      therefore,   was   not   right   in   thinking   that   for <\/p>\n
      preservation   of   the   Victoria   Memorial   Hall,   shifting   of <\/p>\n
      the bus terminus was necessary.\n<\/p>\n
6.    The   respondent   no.2,   who   appeared   in-person   on <\/p>\n
      behalf   of   respondent   no.   1,   on   the   other   hand,   relied <\/p>\n
      on   the   recommendation   of   NEERI   that   the   bus <\/p>\n
      terminus at Esplanade area should be shifted from the <\/p>\n
                                        4<\/span><\/p>\n
      existing   location.   He   submitted   that   the   High   Court <\/p>\n
      was, therefore, right in directing the shifting of the bus <\/p>\n
      terminus   from   Esplanade   within   six   months.     He <\/p>\n
      submitted that this is not a fit case in which this Court <\/p>\n
      should   interfere   with   the   impugned   order   of   the   High <\/p>\n
      Court.\n<\/p>\n
7.    We have considered the submissions made on behalf of <\/p>\n
      the   appellant   and   the   respondents   and   we   find   that <\/p>\n
      NEERI   has   suggested   some   long   term   measures   for <\/p>\n
      preservation  of  the  Victoria  Memorial Hall in Para  5.2 <\/p>\n
      of   its   report.     The   relevant   portion   of   Para   5.2   of   the <\/p>\n
      report of NEERI  is quoted hereinbelow:\n<\/p>\n
      “5.2    LONG-TERM MEASURES<\/p>\n
      Diversion   of   Heavy   Road   Traffic   on   the   Road <\/p>\n
      Encircling the VM Monument.\n<\/p>\n
      The   pollution   from   auto   exhaust   is   the   most <\/p>\n
      important   causative   factor   when   the   Victoria <\/p>\n
      Memorial            protection              from         atmospheric <\/p>\n
      environment is considered.   Therefore, the traffic <\/p>\n
      on   roads   around   the   VM   should   be   minimum <\/p>\n
      particularly   complete   banning   of   heavy   traffic.\n<\/p>\n
      Bus   terminus   at   Esplanade   Area   (Commercial) <\/p>\n
      should also be shifted from the existing location.”\n<\/p>\n
                                    5<\/span><\/p>\n
8.    It   will   be   clear   from   the   recommendation   of   NEERI, <\/p>\n
      quoted   above,   that   shifting   of   the   bus   terminus   at <\/p>\n
      Esplanade   area   has   been   suggested   by   NEERI   as   a <\/p>\n
      long-term measure and not as an immediate measure.\n<\/p>\n
      A   bus   terminus,   where   lakhs   of   people   arrive   and <\/p>\n
      depart through different buses, if shifted immediately, <\/p>\n
      will   cause   a   lot   of   inconvenience   to   the   traveling <\/p>\n
      public.     Moreover,   before   the   bus   terminus   is   shifted <\/p>\n
      from   Esplanade,   another   suitable   place   has   to   be <\/p>\n
      found   out   to   which   the   bus   terminus   can   be   shifted <\/p>\n
      and   various   conveniences   have   to   be   provided   for   the <\/p>\n
      traveling   public   at   the   new   bus   terminus.     All   this <\/p>\n
      cannot   be   done   within   a   period   of   six   months.     The <\/p>\n
      High Court, therefore, was not justified in directing in <\/p>\n
      the   impugned   order   that   the   bus   terminus   at <\/p>\n
      Esplanade be shifted within six months.\n<\/p>\n
9.      The   recommendation   of   the   NEERI,   quoted   above, <\/p>\n
      however,   is   emphatic   that   auto   exhaust   is   the   most <\/p>\n
      important   causative   factor   polluting   the   atmospheric <\/p>\n
      environment   around   Victoria   Memorial   Hall.     For   this <\/p>\n
      reason,   NEERI   has   recommended   that   the   traffic   on <\/p>\n
                                     6<\/span><\/p>\n
       roads   around   the   Victoria   Memorial   Hall   should   be <\/p>\n
       minimum   and   the   bus   terminus   at   Esplanade   area <\/p>\n
       should   be   shifted   from   the   existing   location.     Hence, <\/p>\n
       even though the bus terminus is located 2 kms. away <\/p>\n
       from   Victoria   Memorial   Hall   the   auto-exhaust   from   a <\/p>\n
       large   number   of   buses   at   the   bus   terminus   would <\/p>\n
       pollute   the   atmospheric   environment   around   the <\/p>\n
       Victoria Memorial Hall.  In M.C. Mehta v. Union of India  <\/p>\n
       &   Ors.<\/a>   [(1997)   2   SCC   353],   this   Court   has   directed <\/p>\n
       relocation   industries   from   Taj   Trapezium   Zone   (TTZ) <\/p>\n
       for   protection   and   preservation   of   the   Taj   Mahal   in <\/p>\n
       Agra.     The   recommendation   by   NEERI   that   the   bus <\/p>\n
       terminus   should   be   shifted   from   Esplanade   area   as  a <\/p>\n
       long-term measure to protect and preserve the Victoria <\/p>\n
       Memorial   Hall,   deserves   serious   consideration,   not <\/p>\n
       only   to   preserve  the   monument   but   to   de-congest   the <\/p>\n
       city.\n<\/p>\n
10.        We   accordingly   modify   the   impugned   order   of   the <\/p>\n
       High   Court   and   direct   the   State   Government   to <\/p>\n
       consider   and   take   appropriate   action   on   the   NEERI <\/p>\n
       report   recommending   relocation   of   the   bus   terminus <\/p>\n

       away from the Esplanade.  The appeal is allowed to the <\/p>\n
       extent indicated above. No order as to costs.\n<\/p>\n

2.     These Special Leave Petitions under Article 136 of the <\/p>\n
       Constitution   are   directed   against   the   orders   dated <\/p>\n
       28.09.2007   and   15.02.2008   of   the   Division   Bench   of <\/p>\n
       the Calcutta High Court in Writ Petition No.7987 (W) of <\/p>\n
       2002.\n<\/p>\n

      trees, bushes and shrubs.  To protect and preserve the <\/p>\n
      Victoria   Memorial   Hall   and   its   green   surroundings,   a <\/p>\n
      public   interest   litigation   (Writ   Petition   No.   7987(W)   of <\/p>\n
      2002)   was   filed   in   the   Calcutta   High   Court   by   the <\/p>\n
      respondent nos. 1 to 5.\n<\/p>\n
4.      After   hearing   all   concerned   parties   and   considering <\/p>\n
      the petitions, affidavits and counter affidavits and the <\/p>\n
      recommendations   of   expert   bodies,   the   High   Court, <\/p>\n
      inter   alia,   directed   in   the   impugned   order   dated <\/p>\n
      28.09.2007   that   parking   of   all   cars   around   the <\/p>\n
      compound of the Victoria Memorial Hall shown as red-\n<\/p>\n
      marked portions in the annexed map and nearby areas <\/p>\n
      would be immediately prohibited and such prohibition <\/p>\n
      would   continue   for   24   hours   every   day   including   the <\/p>\n
      holidays.     A   group   of   persons   describing   itself   as   `the <\/p>\n
      Friends of Victoria Memorial’ then filed an application <\/p>\n
      before the High Court for modification of the aforesaid <\/p>\n
      direction so as to permit morning walkers to park their <\/p>\n
                                    10<\/span><\/p>\n
      cars in the north and south zones of Victoria Memorial <\/p>\n
      Hall   for   two   hours   in   the   early   morning.     The   High <\/p>\n
      Court,   however,   dismissed   the   application   by   the <\/p>\n
      impugned   order   dated   15.02.2008   saying   that   car <\/p>\n
      parking   has   only   been   prohibited   around   Victoria <\/p>\n
      Memorial   Hall   and   persons   desirous   of   morning   walk <\/p>\n
      may go to the Maidan which was lying vacant and may <\/p>\n
      also   walk   by   the   side   of   Ganges   or   the   Eden   Garden <\/p>\n
      area   and   the   area   around   the   grounds   of   Mohun <\/p>\n
      Bagan, East Bengal and Mohammedan Sporting Clubs <\/p>\n
      where there was no restriction of parking the vehicles.\n<\/p>\n
      Aggrieved,   the   petitioner   has   filed  these   Special   Leave <\/p>\n
      Petitions.\n<\/p>\n
5.           We have heard learned counsel for the parties and <\/p>\n
      we   find   from   the   recommendations   of   the   Expert <\/p>\n
      Committee   (annexed   to   the   Special   Leave   Petitions   as <\/p>\n
      Annexure   P1)   that   a   Committee   of   Experts   has <\/p>\n
      observed   that   parking   activities   add   to   pollution   load <\/p>\n
      around   the   Victoria   Memorial   Hall   and   have <\/p>\n
      accordingly recommended that the parking of vehicles <\/p>\n
      on   all   sides   of   the   Victoria   Memorial   Hall   compound <\/p>\n

      should   be   totally   banned.   The   High   Court   appears   to <\/p>\n
      have considered these recommendations of the Expert <\/p>\n
      Committee   and   directed   in   the   impugned   order   dated <\/p>\n
      28.09.2007 that parking around the Victoria Memorial <\/p>\n
      Hall on the red-marked portions of the map would be <\/p>\n
      prohibited.     The   High   Court   has   also   indicated   in   the <\/p>\n
      impugned   order   dated   15.02.2008   that   there   were <\/p>\n
      many   other   places   in   Kolkata,   such   as  Maidan,   the <\/p>\n
      Eden Garden area and the area around the grounds of <\/p>\n
      Mohun   Bagan,   East   Bengal   and   Mohammedan <\/p>\n
      Sporting   Clubs   as   well   as   the   area   by   the   side   of   the <\/p>\n
      river Ganges where there was no restriction of parking <\/p>\n
      the   vehicles.     Those   who   want  to   walk  and   take   their <\/p>\n
      cars   to   the   place   of   their   walk   thus   have   sufficient <\/p>\n
      number of alternative places in Kolkata where they can <\/p>\n
      go for their morning walks.\n<\/p>\n
6.    We   are,   therefore,   not   inclined   to   interfere   with   the <\/p>\n
      impugned   orders   of   the   High   Court   and   accordingly <\/p>\n
      dismiss the Special Leave Petitions with no order as to <\/p>\n
      costs.\n<\/p>\n
