      In this Petition filed under Sec. 438 Cr.P.C. the petitioner, who
\nis the sole accused in Crime No.208\/2010 of Edacheri Police Station
\nfor an offence punishable under Sec.55(1) of the Abkari Act for
\nallegedly having been found in possession of 750 ml of Indian
\nMade Foreign Liquor, seeks anticipatory Bail.\n<\/p>\n
      2.    The learned Public Prosecutor opposed the application.\n<\/p>\n
      3.    Anticipatory bail cannot be granted in a case involving
\nsuch grave offence.        It is too early to accept the petitioner’s
\ncontention that the petitioner has been falsely implicated.    There is
\nno reason why the petitioner should not surrender before the
\nmagistrate concerned and seek regular bail.        Accordingly, If the
\npetitioner surrenders before the Magistrate concerned within two
\nweeks from today and files an application for regular bail, the same
\nshall be considered and disposed of preferably on the same day on
\nwhich it is filed bearing in mind the decision in Sukumari v. State of
\nKerala<\/a> – 2001 (1) KLT 22.\n<\/p>\n
      With the above observation this Application is disposed of .\n<\/p>\n
