{"id":21129,"date":"1998-06-04T00:00:00","date_gmt":"1998-06-03T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/requests-to-consider-the-release-of-doctors-who-are-under-prolonged-on-4-june-1998"},"modified":"2018-09-04T15:53:44","modified_gmt":"2018-09-04T10:23:44","slug":"requests-to-consider-the-release-of-doctors-who-are-under-prolonged-on-4-june-1998","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/requests-to-consider-the-release-of-doctors-who-are-under-prolonged-on-4-june-1998","title":{"rendered":"Requests To Consider The Release Of Doctors Who Are Under Prolonged &#8230; on 4 June, 1998"},"content":{"rendered":"<div class=\"docsource_main\">Lok Sabha Debates<\/div>\n<div class=\"doc_title\">Requests To Consider The Release Of Doctors Who Are Under Prolonged &#8230; on 4 June, 1998<\/div>\n<\/p>\n<pre><\/pre>\n<p>     Title: Requests to consider the release of doctors who are under prolonged detention and need to take steps to implement the Human Organ Transplant Act, 1994. <\/p>\n<p><a class=\"marker_ref\" href=\"\/search\/?formInput=DR.%C2%A0%20SAROJA%20V.\">DR.\u00a0 SAROJA V.<\/a>:\u00a0 Mr.\u00a0 Chairman, Sir, I raise this question consequent upon the<br \/>\n new items\u00a0 that\u00a0 appeared\u00a0 in\u00a0 The Hindustan Times on 3.6.98 and 4.6.98.\u00a0 This<br \/>\n dialysis is a very important life-saving procedure for the patients\u00a0 suffering<br \/>\n from end-stage\u00a0 kidney\u00a0 diseases.\u00a0\u00a0\u00a0 So, I would like to draw the attention of<br \/>\n this august House to it.\u00a0 This is\u00a0 the\u00a0 procedure\u00a0 which\u00a0 is\u00a0 adopted\u00a0 by\u00a0 the<br \/>\n nephrologists before\u00a0 the patients are taken up for kidney transplant.\u00a0 Though<br \/>\n this is an intermediate procedure, yet this is the procedure we\u00a0 adopt\u00a0 before<br \/>\n the transplant\u00a0 surgery\u00a0 is\u00a0 carried\u00a0 out.\u00a0\u00a0 A news item has appeared that the<br \/>\n nephrologists are\u00a0 boycotting\u00a0 this\u00a0 dialysis.\u00a0\u00a0\u00a0 The\u00a0\u00a0 Secretary\u00a0\u00a0 of\u00a0\u00a0 Delhi<br \/>\n Nephrologists\u00a0 Society has rightly pointed out that trading in human organs is<br \/>\n deplorable.\n<\/p>\n<p>But it is equally condemnable to equate the doctors who save lives to criminals without even establishing a prima facie case. Today&#8217;s newspaper says that not only the private medical centres, but also the Government institutions are supporting this boycott because four doctors are under prolonged detention. I would like to make a request on behalf of the medicos. Will this Government consider the release of doctors who are under prolonged detention? Simultaneously, an inquiry may be initiated into this matter. Then, immediate steps should be taken to implement the Human Organ Transplant Act which was brought forward by the Government of India in the year 1994.\n<\/p>\n<p><a class=\"marker_ref\" href=\"\/search\/?formInput=MR.%20CHAIRMAN%20\">MR. CHAIRMAN <\/a>: You may please pass on your request to the hon. Minister concerned. You need not read the whole thing.\n<\/p>\n<p><a class=\"marker_ref\" href=\"\/search\/?formInput=DR.%20SAROJA%20V.\">DR. SAROJA V.<\/a>: Sir, the main point is, this Act is not clear on the issue of unrelated donors. That is the problem which the doctors are facing now. So, I would request the hon.
