(Oral)\n<\/pre>\n<p>          Chowdhary Ram, aged 92 years, had filed an ejectment<\/p>\n<p>petition to evict the petitioners-tenants from the shop situated at Sutehri<\/p>\n<p>Road, within the municipal limits of Hoshiarpur. The shop was rented out<\/p>\n<p>to one Prem Singh at the rate of Rs.420\/- per month. Prem Singh died<\/p>\n<p>in the month of October 2001. The petitioners-tenants are the legal heirs<\/p>\n<p>of Prem Singh. Chowdhary Ram had two sons, namely Sudarshan<\/p>\n<p>Kumar and Ashok Kumar. The family of both his sons is residing in the<\/p>\n<p>house of Chowdhary Ram. It has been stated that Ashok Kumar had<\/p>\n<p>started various businesses to earn his livelihood and ultimately he<\/p>\n<p>started   running   a    business   of Guest   House at      Dharamshala<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 5538 of 2008                                      2<\/span><\/p>\n<p>(McLeodganj) Himachal Pradesh in partnership with some other person.<\/p>\n<p>It has come in evidence that two children of Ashok Kumar along with his<\/p>\n<p>wife are residing with the landlord-respondent and he is looking after<\/p>\n<p>them and paying their school fee. In the ejectment -petition, a ground<\/p>\n<p>was taken that shop is required for running a Beauty Parlour by the wife<\/p>\n<p>of Ashok Kumar.\n<\/p>\n<p>          Notice was issued and the written statement was filed by the<\/p>\n<p>petitioners-respondents wherein they denied the averments made in the<\/p>\n<p>ejectment petition and stated that the landlord demanded Rs.800\/- as<\/p>\n<p>rent of the shop w.e.f. 1.11.2001 but the petitioners only agreed to pay<\/p>\n<p>Rs.500\/- per month. This infuriated the landlord and he had filed the<\/p>\n<p>ejectment petition. It has been further stated that the landlord has<\/p>\n<p>various other shops and he cannot opt for this particular shop. Both the<\/p>\n<p>Courts below found merit in the       ejectment petition and ordered<\/p>\n<p>ejectment of the petitioners.\n<\/p>\n<p>          Mr. Dhillon appearing for the petitioners (tenants) has stated<\/p>\n<p>that it has come in evidence of landlord Chowdhary Ram that a shop<\/p>\n<p>was lying vacant and yet the ejectment petition has been filed. This<\/p>\n<p>submission was also made before learned Rent Controller. Learned<\/p>\n<p>Rent Controller, after analyzing the evidence, found that the shop which<\/p>\n<p>was vacated, the internal wall of that shop was removed and two shops<\/p>\n<p>were joined into one shop by another son of landlord namely Sudarshan<\/p>\n<p>Kumar.\n<\/p>\n<p>          Learned Rent Controller relied upon judgment rendered in<\/p>\n<p><a href=\"\/doc\/136856\/\">Joginder Pal v. Naval Kishore Bahal<\/a> 2002 (2) Punjab Law Reporter<\/p>\n<p>625 wherein the word &#8220;own use&#8221; has been defined to include not only<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 5538 of 2008                                          3<\/span><\/p>\n<p>dependents of the landlord but also the persons upon whom the landlord<\/p>\n<p>is dependent.\n<\/p>\n<p>          Both the Courts below further found that the premises are<\/p>\n<p>required for running a Beauty Parlour by wife of Ashok Kumar.<\/p>\n<p>Aggrieved against the order passed by learned Rent Controller,           an<\/p>\n<p>appeal was filed. Learned Appellate Court below also placed reliance<\/p>\n<p>upon Joginder Pal&#8217;s case (supra) and subsequent judgments to hold<\/p>\n<p>that it is the need of the landlord which is to be appreciated and held that<\/p>\n<p>the landlord has a bonafide requirement and thereby upheld the order<\/p>\n<p>passed by learned Rent Controller.\n<\/p>\n<p>          Mr. Dhillon, during the course of arguments has further stated<\/p>\n<p>that Mrs. Prem is a Post Graduate (M.A.) and she does not require the<\/p>\n<p>premises for running the Beauty Parlour. He has further stated that the<\/p>\n<p>family is join and, therefore, it cannot be said that the landlord is<\/p>\n<p>dependent upon Mrs. Prem. This Court is conscious that while<\/p>\n<p>exercising revisional jurisdiction it cannot substitute its own opinion with<\/p>\n<p>the opinion of learned Appellate Court below. While exercising revisional<\/p>\n<p>jurisdiction, this Court cannot act as second Appellate Court. The<\/p>\n<p>findings returned by the two Courts below are neither perverse nor<\/p>\n<p>perfunctory. The opinion formulated by the two Courts below is one<\/p>\n<p>opinion which can be formulated from the facts and circumstances of the<\/p>\n<p>case. It has been     stated by Hon&#8217;ble the Apex Court that bonafide<\/p>\n<p>requirement (for own use) is to be construed liberally and the demised<\/p>\n<p>premises cant be got vacated by the landlord not only for his own<\/p>\n<p>dependents but also for the persons on whom he is dependent.<\/p>\n<p>Undisputedly, the landlord is 92 years old. It can be safely inferred that<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 5538 of 2008                                          4<\/span><\/p>\n<p>day-to-day needs of the landlord are being looked after by Mrs. Prem,<\/p>\n<p>wife of his son Ashok Kumar.         Therefore, I find no justification to<\/p>\n<p>interfere in the findings returned by both the Courts below. Hence, this<\/p>\n<p>Court has no option left but to dismiss the present revision petition.<\/p>\n<p>          At this stage, Mr. Dhillon has stated that the petitioners have<\/p>\n<p>no other source of livelihood except the shop which is under their<\/p>\n<p>tenancy and after the death of Prem Singh, his family may be provided<\/p>\n<p>some solace to find some alternative place.\n<\/p>\n<p>          At this stage, Mr. Rahul Sharma, Advocate, appearing for the<\/p>\n<p>Caveator, has stated that no rent has been paid by the petitioners,<\/p>\n<p>therefore, no time be granted to them to make alternative arrangement.<\/p>\n<p>          Taking into consideration that entire family of deceased Prem<\/p>\n<p>Singh is dependent upon the business run by him, I am of the view that<\/p>\n<p>sufficient time be provided to the tenants to make alternative<\/p>\n<p>arrangement.\n<\/p>\n<p>          Mr. Dhillon has stated that entire arrears of the rent shall be<\/p>\n<p>tendered within one month before learned Rent Controller, Hoshiarpur.<\/p>\n<p>On furnishing an undertaking that the shops shall be vacated within the<\/p>\n<p>period of nine months and the rent shall be paid on or before 7th of each<\/p>\n<p>month and on tendering entire arrears of rent, the petitioners shall not be<\/p>\n<p>evicted for nine months.\n<\/p>\n<\/p>\n<p>                                             (Kanwaljit Singh Ahluwalia)<br \/>\n                                                                  Judge<br \/>\nOctober 16, 2008<br \/>\n&#8220;DK&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Raju And Others vs Chowdhary Ram on 16 October, 2008 Civil Revision No. 5538 of 2008 1 In the High Court of Punjab and Haryana, at Chandigarh.
