Justice KURIAN JOSEPH\n\n Dated :07\/07\/2009\n\n O R D E R\n                  S.R.BANNURMATH, C.J. &amp;\n                    KURIAN JOSEPH,J.\n      -------------------------------------------------\n                 W.A.No.1662 of 2008\n      --------------------------------------------------\n          Dated this the 7th day of July, 2009\n\n                         JUDGMENT\n<\/pre>\n<p>S.R.Bannurmath,C.J.\n<\/p>\n<p>     Aggrieved by the judgment of the learned single<\/p>\n<p>Judge dated 28-3-2008, the writ petitioner has approached<\/p>\n<p>this court in the present appeal. The appellant-petitioner<\/p>\n<p>had taken loan from the Industries Department and for<\/p>\n<p>non-payment of the same, recovery proceedings under the<\/p>\n<p>Kerala Revenue Recovery Act was initiated and in the year<\/p>\n<p>1975 a portion of the land to an extent of 38.50 cents out<\/p>\n<p>of 56 cents was proposed to be sold in public auction and<\/p>\n<p>for want of bidders the sale was concluded on behalf of the<\/p>\n<p>Government itself. Nearly two decades thereafter, that is<\/p>\n<p>in the year 1994, the appellant has filed the present<\/p>\n<p>representation Ext.P4 requesting restoration of possession<\/p>\n<p>W.A.No.1662 of 2008<\/p>\n<p><span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>of the entire land on realisation of the entire arrears due from<\/p>\n<p>him. Noticing the fact that there was inordinate delay and<\/p>\n<p>laches on the part of the appellant and failure on his part to<\/p>\n<p>even appear before the Board of Revenue as well as<\/p>\n<p>challenging the order of the Board of Revenue, the learned<\/p>\n<p>single Judge dismissed the writ petition. However, as it was<\/p>\n<p>contended that though the total extent of the land is 56 cents,<\/p>\n<p>the entire extent has been sold illegally to the 6th respondent<\/p>\n<p>and taking into consideration the fact that the sale was in<\/p>\n<p>respect of 38.5 cents, the learned single Judge has given<\/p>\n<p>liberty to the appellant to institute appropriate civil<\/p>\n<p>proceedings against the 6th respondent or any person in<\/p>\n<p>occupation of the remaining extent of land which was not<\/p>\n<p>subject matter of the sale. On perusal of the entire material<\/p>\n<p>and after hearing learned Senior Counsel, we do not find any<\/p>\n<p>possible or acceptable ground for the inordinate delay in<\/p>\n<p>W.A.No.1662 of 2008<\/p>\n<p><span class=\"hidden_text\">                              -:3:-<\/span><\/p>\n<p>approaching the authorities or the court. As such we find no<\/p>\n<p>merit in the appeal.
