The nature of work performed by the<br \/>\n\tpetitioner is permanent in nature. However, inspite of repeated<br \/>\n\trequests made by the petitioner, neither his service is regularized<br \/>\n\tnor is he employed on permanent basis. The action of the respondent<br \/>\n\tin not regularizing the services of the petitioner and not giving<br \/>\n\tregular pay-scale to the petitioner is bad in law and therefore,<br \/>\n\tpresent petition.\n<\/p>\n<p>Heard<br \/>\n\tthe learned advocates for the respective parties and perused the<br \/>\n\trelevant record. From the facts and circumstances of the case, it is<br \/>\n\tclear that the appointment of the petitioner is not a regular one<br \/>\n\tand not done in accordance with the rules and regulations.\n<\/p>\n<p>In<br \/>\n\tthe context of the present case, it would be relevant to refer to a<br \/>\n\tdecision of the Apex Court in the case of Secretary, State of<br \/>\n\tKarnataka &amp; Ors. v. Umadevi &amp; Ors., (2006) 4 S.C.C. 1,<br \/>\n\twherein, it has been held that Courts should not issue directions<br \/>\n\twith regard to absorption, regularization, or permanent continuance<br \/>\n\tof temporary, contractual, casual, daily-wage or ad-hod employees<br \/>\n\tappointed \/ recruited and continued for long in public employment<br \/>\n\tdehors the constitutional scheme of public employment, unless the<br \/>\n\trecruitment itself was made regularly and in terms of the<br \/>\n\tconstitutional scheme.\n<\/p>\n<p>Looking<br \/>\n\tto the facts of the present case and the principle laid down by the<br \/>\n\tApex Court in the above cited decision, the present petition does<br \/>\n\tnot deserve to be entertained.\n<\/p>\n<p>In<br \/>\n\tview of the above, the present petition fails and is, accordingly,<br \/>\n\tdismissed. Rule is discharged with no order as to costs.
