The said notice has been issued on the<br \/>\n     premises that the amount of L.T.C. has been obtained by<br \/>\n     producing    false certificates of travelling, without<br \/>\n     giving an opportunity of hearing.\n<\/p>\n<p>     2.This Court has issued notice for final hearing on<br \/>\n     the respondents on 03.06.2003 making it returnable on<br \/>\n     09.06.2003.   After service of notice, learned AGP Mr.<br \/>\n     Nagesh Sood appears on behalf of respondent No.1 and<br \/>\n     learned advocate Mr. Mahesh Bariya appears on behalf of<br \/>\n     respondent No.3 while nobody appears on behalf         of<br \/>\n     respondent No.2. Therefore, RULE.     Mr.    N.C.   Sood,<br \/>\n     learned AGP waives service of notice of rule on behalf of<br \/>\n     respondent No.1 and learned advocate Mr.   Mahesh Bariya<br \/>\n     waives service of notice of rule on behalf of respondent<br \/>\n     No.3.. With the consent of all the learned Counsel for<br \/>\n     the parties, this matter is taken up for final hearing.<br \/>\n     Since all these petitions are arising from the common<br \/>\n     facts and issue involved is also common, they are being<br \/>\n     dealt with together by this common judgment.\n<\/p>\n<p>     3.At the time of hearing of these petitions,<br \/>\n     learned advocate Mr. Anant S. Dave, appearing on behalf<br \/>\n     of the petitioners submits that in large number of<br \/>\n     identical matters raised upon identical notices, this<br \/>\n     Court has passed an order directing the respondents to<br \/>\n     give suitable installments to the petitioners to pay the<br \/>\n     amount of penalty subject to the payment of principle<br \/>\n     amount within specified time limit and also subject to<br \/>\n     filing appropriate undertakings.   Learned advocate Mr.<br \/>\n     Anant S.   Dave has produced before me a copy of one such<br \/>\n     order passed by this Court (Coram :- Jayant Patel, J.) on<br \/>\n     28.03.2003 in Special Civil Application No.     1577\/2003<br \/>\n     and other allied matters.\n<\/p>\n<p>     4.After   having   heard   the  learned advocates<br \/>\n     appearing for the respective parties and after having<br \/>\n     gone through the contents of the petition and the<br \/>\n     documents attached therewith as well as after having<br \/>\n     perused the earlier order passed by this Court, I am of<br \/>\n     the view that the present group of petitions being<br \/>\n     identical with the earlier matters, similar directions<br \/>\n     are required to be given.       Accordingly,  following<br \/>\n     directions are given.\n<\/p>\n<p> 4.1) All   the   petitioners    shall  file   separate<br \/>\n        undertaking to this Court that they shall not<br \/>\n        raise any objection in future regarding the<br \/>\n        recovery of the amount of penalty directly by<br \/>\n        appropriating 33% of the salary       and   other<br \/>\n        perquisites i.e.     actual pay until they are in<br \/>\n        service and they shall also not raise          any<br \/>\n        objection to the balance recovery to be made in<br \/>\n        case the concerned petitioners are retiring in<br \/>\n        normal course and they shall not raise any<br \/>\n        objection for recovery of such amount from the<br \/>\n        retiral benefits.     The said undertaking shall<br \/>\n        also include that the concerned petitioner shall<br \/>\n        deposit the principle amount of LTC on or before<br \/>\n        30.06.2003 and such undertaking shall be filed<br \/>\n        within a period of two weeks from today before<br \/>\n        this Court by each of the petitioners separately<br \/>\n        and the copy of the said undertaking shall be<br \/>\n        produced by the petitioners before the concerned<br \/>\n        authorities.\n<\/p>\n<p>4.2) The   concerned   petitioner   shall   also file<br \/>\n        undertaking as per circular dated       3.10.1988<br \/>\n        before authority on or before 25.06.2003.\n<\/p>\n<p>4.3) If the principle amount of LTC is deposited on or<br \/>\n        before 30.06.2003 and if such undertaking as per<br \/>\n        above para 4.1 is filed before this Court and the<br \/>\n        copy of the same is       produced   before    the<br \/>\n        authorities, and if further undertaking is filed<br \/>\n        before concerned authority as per above para 4.2<br \/>\n        then in that case, the authorities shall recover<br \/>\n        twice the amount of LTC as penalty by directly<br \/>\n        appropriating 33% of the actual pay of the<br \/>\n        concerned employees and only 67% of the actual<br \/>\n        pay shall be actually paid to the concerned<br \/>\n        petitioners. Such recovery shall continue until<br \/>\n        the amount of penalty is fully recovered and if<br \/>\n        any of the concerned petitioners is retiring<br \/>\n        before   the   amount is fully recovered, the<br \/>\n        concerned authorities shall recover the said<br \/>\n        balance   amount   from   the   retiral benefits<br \/>\n        including the provident fund, gratuity, etc.    by<br \/>\n        directly appropriating towards the balance amount<br \/>\n        of penalty.\n<\/p>\n<p>4.4) Until   the principle amount of LTC and the<br \/>\n        penalty, as observed earlier, is fully recovered,<br \/>\n        the authorities shall not take any action for<br \/>\n        criminal   prosecution or departmental inquiry<br \/>\n         against the employees concerned as per circular<br \/>\n        dtd. 3.10.1988.       It is made clear that upon<br \/>\n        failure    of    the   concerned   petitioners   of<br \/>\n        depositing the principle amount of LTC and upon<br \/>\n        raising dispute regarding recovery of penalty<br \/>\n        inspite of the aforesaid undertaking to this<br \/>\n        Court and to the        concerned   authority   the<br \/>\n        aforesaid directions shall automatically stand<br \/>\n        vacated in case of concerned petitioner and the<br \/>\n        authorities shall be at liberty to lodge criminal<br \/>\n        prosecution against the concerned petitioners in<br \/>\n        accordance with law and the authorities shall<br \/>\n        also    be    at   liberty    to take departmental<br \/>\n        proceedings including that of suspension of the<br \/>\n        employees concerned.       The aforesaid liberty to<br \/>\n        the employer\/authorities shall be in addition to<br \/>\n        the liability of the concerned petitioners, as<br \/>\n        the case may be, for breach of the undertaking<br \/>\n        and for the proceedings under the Contempt of<br \/>\n        Court Act.\n<\/p>\n<p>5.Though    this   Court has given the aforesaid<br \/>\ndirections keeping in mind the earlier order passed by<br \/>\nthis Court in similar such matters, it is high time to<br \/>\ntake a serious view of the matter as no person is allowed<br \/>\nto claim L.T.C. from his employer without incurring such<br \/>\nexpenses. The petitioners in these group of petitions<br \/>\nhave surrendered themselves without facing any inquiry or<br \/>\napprehended criminal proceedings, by agreeing to the<br \/>\npayment of the principle amount as well as the penalty<br \/>\nleviable on them. Since the petitioners have shown their<br \/>\nwillingness to pay up the amount as demanded in the<br \/>\nnotice, the Court is not expressing any opinion as to<br \/>\nwhether the petitioners have in fact travelled or not and<br \/>\nsince this Court has granted the benefit of payment by<br \/>\ninstallments and they were      absolved   from   further<br \/>\nproceedings    because of the said order, this Court<br \/>\nrestrains itself from passing any order on that point so<br \/>\nas   to   give the similar treatment to the present<br \/>\npetitioners who are also put in        similar   set    of<br \/>\ncircumstances. The fact, however, remains that the Court<br \/>\nis deprecating the recurrence of such events in future.\n<\/p>\n<p>6.All these petitions are disposed of in terms of<br \/>\nthe aforesaid directions.
