In the facts and circumstances of<br \/>\nthe case and by consent of both the sides, this matter is taken up<br \/>\nfor hearing today.\n<\/p>\n<p>2.\tThis<br \/>\nis an application for anticipatory bail under Section 438 of the Code<br \/>\nof Criminal Procedure in connection with the FIR bearing CR No. I 53<br \/>\nof 2006 registered with Navapura Police Station for the offences<br \/>\npunishable under Sections 467, 468, 420, 120B and 114 of the IPC.\n<\/p>\n<p>3.\tMr<br \/>\nDivyesh Joshi, learned advocate for the petitioner submitted that<br \/>\nconsidering the averments made in the petition and the FIR at<br \/>\nAnnexure-A to the petition, it is a fit case to grant anticipatory<br \/>\nbail.  The learned advocate for the petitioner submitted that if the<br \/>\nprayer as set out in the application is granted, the petitioner would<br \/>\nabide by the terms and conditions imposed by this Court.\n<\/p>\n<p>4.\tMs<br \/>\nManisha Shah, learned Additional Public Prosecutor representing the<br \/>\nState submitted that considering the role attributed to the<br \/>\npetitioner which is reflected in the FIR at Annexure-A to the<br \/>\npetition and the manner in which the offences are committed by the<br \/>\npetitioner, the petition deserves to be rejected.\n<\/p>\n<p>5.\tHaving<br \/>\nconsidered the rival submissions and on perusal of the FIR at<br \/>\nAnnexure-A to the petition, the petitioner is booked for the offences<br \/>\npunishable under Sections 467, 468, 420, 120B and 114 of the IPC.  In<br \/>\nview of the above facts and circumstances of the case and without<br \/>\nentering into merits of the case, I am inclined to exercise my<br \/>\ndiscretion in favour of the petitioner.\n<\/p>\n<p>6.\tIn<br \/>\nthe event of arrest of the petitioner in connection with CR No. I 53<br \/>\nof 2006 registered with Navapura Police Station for the offences<br \/>\npunishable under Sections 467, 468, 420, 120B and 114 of the IPC, he<br \/>\nshall be released on bail on executing a bond of Rs.10,000\/- [Rupees<br \/>\nten thousand only] with one surety of the like amount on the<br \/>\nfollowing conditions that he shall:\n<\/p>\n<p>[a]\tco-operate<br \/>\nwith the investigation and make himself available for interrogation<br \/>\nwhenever and wherever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at the concerned Police Station on 20th<br \/>\nAugust 2008 between 9.00 AM to 3.00 PM.\n<\/p>\n<p>[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any person<br \/>\nacquainted with the facts of the case so as to dissuade them from<br \/>\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n<p>[d]\tat<br \/>\nthe time of execution of bond, furnish his residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]\tnot<br \/>\nleave India without the permission of the Court and, if holding a<br \/>\npassport, he shall surrender the same before the Trial Court within a<br \/>\nweek;\n<\/p>\n<p>[f]\tnot<br \/>\nobstruct or hamper the police investigation and not play mischief<br \/>\nwith the evidence collected or yet to be collected by the police;\n<\/p>\n<p>7.\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand if he considers it proper and just; and the competent Court<br \/>\nwould decide it on merits.\n<\/p>\n<p>8.\tThis<br \/>\norder will hold good, if the petitioner is arrested at any time<br \/>\nwithin 90 days from today.  The order for release on bail will remain<br \/>\noperative only for a period of ten days from the date of his arrest.<br \/>\nThereafter, it will be open to the petitioner to make a fresh<br \/>\napplication for being enlarged on bail in usual course, which, when<br \/>\nit comes up before the competent Court, will be decided in accordance<br \/>\nwith law, having regard to all the attending circumstances and the<br \/>\nmaterials available at the relevant time, without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>9.\tWith<br \/>\nthese directions, this petition is allowed.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
