This appeal is by the defendants. We notice that
\nthe appeal was filed by defendant No.1 and
\nNo.2. We also notice that during the  —
\nappeal both the original defendants
\nand their legal representatives’ ha\\,r.\u00a7Tigl31’r1\u00a7p’?\/fox,<\/p>\n
Respondents are the plaintiffsf’ _<\/p>\n
2. The suit is \ufb01ledfffbfyl for partition
\nand separate   \/\/’v:3ni “Share in Suit
\nschedule”  and  “i’ewa1*hed Trial Judge on
\ncontest      ”  n<\/p>\n

— ‘ he pjrdpositus is one Puttarangappa and he had<\/p>\n
‘four soiisf The eldest son according to the parties was of<\/p>\n

 “dispute arose inter se is between A.N.Puttarangappa<\/p>\n
and three sons i.e., plaintiff, defendant No.1 and<\/p>\n

proceedings were initiated and ultimately it culminated<\/p>\n
in R.A.No.11\/1978 wherein defendant No.2 had given <\/p>\n

up his right in respect of his share in the suit schediile

many as ‘five issues  V. ”\n<\/p>\n

   con’e.lusion that the plaintiff has proved the<\/p>\n
relin’quishr:’icen’tV deed stated to have been executed by<\/p>\n
‘i._gdefendaint No.2 and also the plaintiff has proved the<\/p>\n

6. Learned counsel appearing for the legal<\/p>\n
representatives of defendant No.2 would contend that \ufb02<\/p>\n
the judgment and decree warrants interference for more<\/p>\n
than one reason.\n<\/p>\n

\nthe View that the appeal..itselfr1’na.jg’riot.be rnaintainable.
\nWe do not propose to gofintio of the case<\/p>\n
inasmuch as appeal  Sdismissed for<\/p>\n
another reason} _  l<\/p>\n
9.    appeal was \ufb01led by original<\/p>\n
.~.&_defe_n’d.a:n_t  questioning the judgment and<\/p>\n
i”‘._e\u00a2\u00a2ree, -v\u00abapp_eal is filed in the year 1997. Thereafter<\/p>\n
the appeal’ha.sF’met with several causalities inasmuch as<\/p>\n
‘V.appeai..v\u00a7fas dismissed for no:n–prosecution on more than<\/p>\n
“ilthlrelejoccasions. When the matter was listed before the<\/p>\n
  Court on 26.8.2008. none appeared for the appellants,<\/p>\n
hence, appeal was dismissed for non–prosecutior1.<\/p>\n
Thereafter applications were filed recalling the order.<\/p>\n
This Court allowed the said applications pursuant to an X?<\/p>\n
order dated 17.10.2008 recalling the order of dismissal<\/p>\n
on payment of costs of $1.000\/–. It appears the
\ncost was not deposited. Hence, the matter waS_..rei”‘\u00ab
\nbefore the Court on 20.11.2008. This  H
\nthe conditions imposed for restorati:on._v
\nwere not complied. Hence.’

\n28.6.2008. it appears  once again<\/p>\n
\ufb01led recalling of  We notice that<\/p>\n
the said appliveatiolns dwere once again dismissed for<\/p>\n
non–pros’ecu’tion  0′    9.20 1 0. The present<\/p>\n

10. Indeed, the said applications for recalling the<\/p>\n
order of dismissal is seriously opposed by Mr.G.D<\/p>\n
Ashwathanarayana. He submits that the question of<\/p>\n

recalling the order would not arise inasmuch as the 2%<\/p>\n

\nonly by the legal representatives of defendant
\nsubmits that insofar as the legal  ~

\ncontention of Mr. Cr.D.’__  to be
\nnoticed that the suit   and separate
\npossession.  up a Will
\nstated to haye   bequeathing
\n1\/3″‘ Sllare  of the issues before the<\/p>\n
learned Trial ,  ” at-‘*’as whether the plaintiff-<\/p>\n
.-vv.respVorident Vvhals”‘*prHoVevd the Will. The learned Trial<\/p>\n
  a finding that the Will is proved in<\/p>\n
accordance’ ‘litfiifll law.\n<\/p>\n
axl2.”‘vIpndeed, we are of the View that there cannot be<\/p>\n
V’ l..coni’licting decrees in respect of same subject matter<\/p>\n
.ff\u00ab’ina.srnAuch_ as in one set of proceedings it cannot be held<\/p>\n
 the Will is proved and another set of proceedings<\/p>\n
assuming that we examine the matter to hold that the 1%<\/p>\n

Will is proved. We also notice that in a suit for partition
\nall the persons who were parties to the origirial
\nproceedings should be the parties to appeal  H<\/p>\n

Patwardhan<\/a> reported in Mys. LJ 1973 (1) 294 has<\/p>\n
held that respondents were in the possession of joint<\/p>\n

\nrespondent without bringing his LRS on record

T  litigant who is not a vigilant but is an indolent person.<\/p>\n
l x We also notice that the appeal has been dismissed for<\/p>\n
more than couple of occasions for non–prosecu1:ion.

entertaining these applications would not arise. <\/p>\n
