The  respondent\ndid  not  comply  with\tthe order and  his  detenue  to\t the\neviction  suit\twas  struck out.   Thereafter.\tan  ex-parte\ndecree\tevicting  the  respondent  was\tpassed\tand  it\t was\nconfirmed  by the first appellate Court.  In second  appeal,\nthe  High Court remitted the case to the trial Court on\t the\nground\tthat since  the respondent had\tnot  admitted  the\nappellants to be full owners of the prermises but  contended\nthat  other  co-sharers of the appellant's family  had\talso\nshares\ttherein, there was a denial of the  relationship  of\nlandlord  and  tenant between the parties and so  the  order\nstriking  out  the respondent's defence qua tenant  did\t not\nprevent\t him  from contesting the suit on  the\tquestion  of\ntitle.\nAllowing the appeal to this Court,\nHELD.  The respondent had admitted that he was tenant  under\nthe   appellants  and  had  paid  rent\tto  the\t  appellants\nrecognising  them as his landlords.  It was not therefore  a\ncase  of  denial  of relationship of land  lord\t and  tenant\nbetween the parties.  His plea was only that the  appellants\nbeing  landlords  of a share of the premises  could  not  by\nthemselves  claim a decree of eviction against him.  Such  a\nplea was a plea qua tenant and not dehors it.  The  striking\nout of his defence had thus, the effect of striking out\t all\nthe  defences raised by the respondent qua tenant  including\nhis  defence that the appellants being\tco-sharer  landlords\nwere  not entitled to maintain the suit for eviction. Mukherjee, for the respondent.<br \/>\nThe Judgment of the Court was delivered by<br \/>\nUNTWALIA, J.-,This appeal by the plaintiffs filed by special<br \/>\nleave of this Court against the defendant respondent  arises<br \/>\nout of a suit for eviction instituted by the former  against<br \/>\nthe  latter from the suit premises situated in the  town  of<br \/>\nPatna.\t  According  to\t the-case  of  the  plaintiffs\t the<br \/>\ndefendant  had\tbeen  inducted as a monthly  tenant  of\t the<br \/>\npremises  on a rent of Rs., 135\/- per month.   Subsequently,<br \/>\nas  a  result of a decree in a Parititon Suit  between\tthe<br \/>\nplaintiffs and<br \/>\n<span class=\"hidden_text\"> 1005<\/span><br \/>\ntheir co-sharers the property was allotted to the former and<br \/>\nthey became the absolute owners thereof.  Plaintiffs  wanted<br \/>\nto evict the defendant on the ground of non-payment of rent,<br \/>\nbreach\tof the conditions of the tenency and on\t account  of<br \/>\ntheir  bonafide personal requirements of the suit  premises.<br \/>\nThe  defendant in his defence took the plea that he was\t not<br \/>\nthe tenant of the premises, the tenant was Liberty &amp; Co. and<br \/>\nthat the plaintiffs were not the absolute owners thereof, as<br \/>\nthe  decree  for  partition had been set aside\tin  a  first<br \/>\nappeal filed in the Patna High Court, there were others\t who<br \/>\nalso were the landlords.  Some other pleas were also raised<br \/>\nto resist the suit for eviction.\n<\/p>\n<p>The  suit  was instituted on 27-9-1962.\t On  18-12-1963\t the<br \/>\nPlaintiffs filed a petition under section 1 1 A of the Bihar<br \/>\nBuildings  (Lease,  Rent and Eviction)\tControl\t Act,  1947-<br \/>\nhereinafter  called the Act-for directing the  defendant  to<br \/>\npay the arears of rent as also the current and future  rent.<br \/>\nThe  defendant resisted the, claim of the  plaintiffs  under<br \/>\nsection 11A of the Act on the ground that besides them there<br \/>\nwere  other landlords of the building in question.   But  an<br \/>\norder  under  section 11A of the Act was  made\tagainst\t the<br \/>\ndefendent by the Trial Court on 6-2-1964.  To safeguard\t the<br \/>\ninterest  of  the  defendant the  Court\t directed  that\t the<br \/>\nplaintiffs  would  not\twithdraw the  amounts  deposited  in<br \/>\npursuance  of the order made under section 1 1 A of the\t Act<br \/>\nuntil the disposal of the suit.\t The defendant defaulted  in<br \/>\ncompliance  with  the order.  Hence his defence\t as  against<br \/>\nejectment was struck out by an order of the Trial Court made<br \/>\non 8-7-1964.  The suit was eventually taken up for  ex-parte<br \/>\nhearing\t On 1-7-1967.  The defendant wanted to obstruct\t the<br \/>\nhearing of the suit proceeding ex-parte but failed.<br \/>\nAt  the\t ex-parte  hearing  plaintiff  no.  3  examined\t  as<br \/>\nplaintiffs&#8217;  witness no. 1. He supported their case in\ttoto<br \/>\nincluding their claim that they were the absolute owners  of<br \/>\nthe  building  of which the defendant was the  tenant.\t The<br \/>\nMunsif, third Court, Patna believed the evidence adduced  on<br \/>\nbehalf\tof  the\t plaintiffs and passed\ton  ex-parte  decree<br \/>\ndirecting eviction of the defendant.  The latter went up  in<br \/>\nappeal\twhich  was  dismissed by  Subordinate  Judge,  First<br \/>\nCourt,\tPatna on 21-4-1969.  All arguments raised on  behalf<br \/>\nof the defendant appellant to challenge the ex-parte  decree<br \/>\nfailed.\t He preferred second appeal no. 262\/1969 in the High<br \/>\nCourt of Judicature at Patna.  A learned Judge of that Court<br \/>\nsitting singly allowed the appeal and remitted the case back<br \/>\nto  the\t Trial Court for a fresh trial\tand  decision  after<br \/>\nallowing opportunity to the parties to adduce their evidence<br \/>\nin  the\t light\tof  the Judgment of  the  High\tCourt.\t The<br \/>\nplaintiffs  appellants challenge the propriety and  legality<br \/>\nof the High Court Judgment passed in the second appeal.<br \/>\nThe  High Court rejected some of the contentions  raised  of<br \/>\nbehalf\tof  the defendant to challenge the legality  of\t the<br \/>\norder made under section 1 1 A of the Act as also the  order<br \/>\nstriking  out his defence as against ejectment.\t But it\t has<br \/>\ntaken  the  view following the full Bench  decision  of\t the<br \/>\nPatna  High  Court  in the case of  Mahabir  Ram  v.  Shiva<br \/>\nShanker Prasad and other(1) that since the defendant had not<br \/>\nadmitted  the plaintiffs to be his 16 annas  landlord  there<br \/>\nwas a denial of relationship of landlord and tenant  between<br \/>\nthe  parties and as such the order striking out the  defence<br \/>\nis against ejectment of the defendant qua<br \/>\n(1)  A.I.R. 1968 Patna 415.\n<\/p>\n<p><span class=\"hidden_text\">1006<\/span><\/p>\n<p>tenant could not prevent him from contesting the suit on the<br \/>\nquestion of title.  In our opinion the High Court has fallen<br \/>\ninto an error of law in applying the ratio of the Full Banch<br \/>\ndecision of the High Court referred to above to the facts of<br \/>\nthe instant case.\n<\/p>\n<p>The  defence  set up by the defendant that he  was  not\t the<br \/>\ntenant but the tenant was Liberty &amp; Co. was a mere pretence.<br \/>\nThe High Court has also not thought it fit to remit the case<br \/>\nback because of this defence.  The defendant was carrying on<br \/>\nthe business in the assumed name of Liberty &amp; Co. which\t was<br \/>\nnot  any  legal\t entity\t or  a\tperson\tdifferent  from\t the<br \/>\ndefendant.\n<\/p>\n<p>The defendant had admitted that he was the tenant under\t the<br \/>\nplaintiffs  but\t was merely asserting that there  were\tsome<br \/>\nmore  landlords of the premises in question.  It was  not  a<br \/>\ncase  of  denial  of relationship  of  landlord\t and  tenant<br \/>\nbetween the parties.  In the case of Mahabir Ram A.I.R. 1968<br \/>\nPatna 415, the tenant had denied the title of the plaintiffs<br \/>\nand set up a title in himself.\tIn the instant case the plea<br \/>\nof  the\t defendant  has\t been  that  the  plaintiffs   being<br \/>\nlandlords  of the suit premises for a moiety of share  could<br \/>\nnot  alone claim a decree for eviction against him.  Such  a<br \/>\nplea set up by the defendant to resist the suit for eviction<br \/>\nwas  a plea qua tenant and not dehors it.  The striking\t out<br \/>\nof  the defence on 8-7-1964 had the, effect of striking\t out<br \/>\nall defence raised by the defendant qua tenant including his<br \/>\ndefence that the plaintiffs alone being\t co-sharer-landlords<br \/>\nwere not entitled to maintain the suit for eviction.  It may<br \/>\nalso be added that the learned Munsif in. his order dated 8-<br \/>\n7-1964\tstriking out the defence, which order was  confirmed<br \/>\nby  a Bench of the High Court in Civil Revision No.  824  of<br \/>\n1964  decided on 21-4-1964, bad pointed out on the basis  of<br \/>\nthe defendant&#8217;s statements in his written statement as\talso<br \/>\nin  his rejoinder to the plaintiffs&#8217; petition under  section<br \/>\n11A  of the Act that the defendant had admitted that he\t was<br \/>\npaying rent to the plaintiffs and had recognised them to  be<br \/>\ntheir  landlords.   In\tthat view of  the  matter  also\t the<br \/>\nplaintiffs were the landlords of the suit premises  occupied<br \/>\nby the defendant within the meaning of clause (d) of section<br \/>\n2  of  the  Act. In either view of the matter  there  is  no<br \/>\nescape\tfor  the, defendant in this case that  his  entire<br \/>\ndefence\t in the suit was in his capacity as a tenant and  on<br \/>\nits striking out it was struck out as a whole.\tThe  hearing<br \/>\nof  the suit ex-parte was, therefore, legal and valid.\t The<br \/>\ncontrary view taken by the High Court is erroneous in law.<br \/>\nMr.  H.\t B.  Datar,  learned  counsel  for  the\t  respondent<br \/>\nendeavoured  to\t persuade us to remit back the case  to\t the<br \/>\nHigh  Court for the rehearing of the second appeal in  order<br \/>\nto  find  out  whether\tthe exparte  decree  passed  on\t the<br \/>\nevidence  adduced was sustainable, in law.  We did not\tfeel<br \/>\npersuaded  to  accede to this request of the counsel  as  on<br \/>\nperusal\t of the judgment of the Trial Court as also  of\t the<br \/>\nfirst appellate Court we found no error of law in them.\t The<br \/>\nsuit for eviction was rightly decreed.\n<\/p>\n<p>In the result this appeal is allowed but without costs.\t The<br \/>\njudgment of the High Court is set aside.\n<\/p>\n<p>V.P.S.\n<\/p>\n<p>Appeal allowed.\n<\/p>\n<p>1 0 0 7<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Bela Das &amp; Ors vs Samarendra Nath Bose on 11 December, 1974 Equivalent citations: 1975 AIR 398, 1975 SCR (2)1004 Author: N Untwalia Bench: Untwalia, N.L.
