DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/05\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\nrevision application is preferred against the order dated 20.03.2009<br \/>\npassed by the learned Judge, Family Court No.2, Ahmedabad in Criminal<br \/>\nMisc. Application No.3187 of 2007 by which the applicant-husband is<br \/>\ndirected to pay Rs.1,500\/- p.m. towards maintenance to the<br \/>\nrespondent-wife in exercise of powers under Section 125(1) of the<br \/>\nCode of Criminal Procedure, 1973 from the date of the order passed in<br \/>\nHMP No.5 of 2007 with costs of Rs.3,000\/-.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the applicant submits that respondent No.2-wife is also<br \/>\nserving and earning Rs.7,000\/- p.m. and the applicant has to maintain<br \/>\nhis parents and awarding maintenance of Rs.1,500\/- is<br \/>\ndisproportionate to his monthly expenses.  In view of the above,<br \/>\nlearned advocate for the applicant submits that the impugned order<br \/>\ndeserves to be quashed and set aside.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the respondent-wife submits that bare minimum amount of<br \/>\nRs.1,500\/- p.m. out of salary of Rs.7,000\/- p.m.<br \/>\nis awarded towards maintenance.  On the contrary, the same is on<br \/>\nlesser side, which does not  require any interference in exercise of<br \/>\nrevisional powers.\n<\/p>\n<p>\tConsidering<br \/>\nthe facts and circumstances of the case and on perusal of the record<br \/>\nof the case, impugned order passed by the learned Family Court<br \/>\nawarding Rs.1,500\/- p.m. to respondent-wife cannot be said to be in<br \/>\nany manner unjust, illegal, contrary to law when the husband had<br \/>\nmonthly income of Rs.7,000\/-.  So far as monthly salary of the<br \/>\nrespondent as a teacher is concerned, it shall have no bearing for<br \/>\nexercise of powers under Section 125(1) of the Code.  No case is made<br \/>\nout to interfere with the order impugned in this revision<br \/>\napplication.\n<\/p>\n<p>\tAccordingly,<br \/>\nthis revision application stands dismissed.\n<\/p>\n<p>[Anant<br \/>\nS.
