Justice V.GIRI\n\n Dated :26\/08\/2009\n\n O R D E R\n                       V.GIRI, J.\n         ----------------------------------------\n                W.P.(C).No.17111 of 2009\n         ----------------------------------------\n        Dated this the 26th day of August, 2009.\n\n\n                      JUDGMENT\n<\/pre>\n<p>        The petitioner claims right, title and<\/p>\n<p>interest over an extent of 50 cents of paddy land,<\/p>\n<p>which devolved on him on the death of his father,<\/p>\n<p>who got assignment as per deed No.1102\/92 of<\/p>\n<p>Nellaya Registrar&#8217;s Office. According to him, his<\/p>\n<p>predecessor was cultivating paddy in the land for<\/p>\n<p>long years. Respondents 4 and 5 purchased an<\/p>\n<p>adjacent land. It is alleged that they are doing<\/p>\n<p>real estate business. They converted the paddy<\/p>\n<p>land   into  dry    land.       This,    the    petitioner<\/p>\n<p>apprehends, will affect his land.          He has filed<\/p>\n<p>Ext.p1 petition before the Revenue Divisional<\/p>\n<p>Officer against respondents 4 and 5.                  The<\/p>\n<p>petitioner also alleges that the attempt of<\/p>\n<p>respondents 4 and 5 is to acquire the property of<\/p>\n<p>the petitioner. He has moved the Civil Court and<\/p>\n<p>W.P.(C).No.17111 of 2009<\/p>\n<p>                         :: 2 ::\n<\/p>\n<p>Ext.P2 order of injunction has been passed.<\/p>\n<p>Thereafter,    the    6th   respondent, father of<\/p>\n<p>respondents 4 and 5, filed a complaint before the<\/p>\n<p>Village Officer, Thottipal, alleging that the<\/p>\n<p>petitioner is illegally converting his paddy land.<\/p>\n<p>Ext.P5 stop memo was issued by the Village<\/p>\n<p>Officer.    This has been challenged in this writ<\/p>\n<p>petition.\n<\/p>\n<p>         2. A stop memo, if at all, can only be<\/p>\n<p>issued by the Revenue Divisional Officer. Ext.P5<\/p>\n<p>shall, therefore, treated as a show cause notice<\/p>\n<p>and the same, along with the objections of the<\/p>\n<p>petitioner shall be forwarded by the Village<\/p>\n<p>Officer to the Revenue Divisional Officer within<\/p>\n<p>two weeks from the date of receipt of a copy of<\/p>\n<p>this judgment. Thereupon, the petitioner and the<\/p>\n<p>6th respondent shall be heard and final orders<\/p>\n<p>shall be passed within one month by the Revenue<\/p>\n<p>W.P.(C).No.17111 of 2009<\/p>\n<p>                             :: 3 ::\n<\/p>\n<p>Divisional Officer.
