Mr.S.C.Herold Singh\n\t\t\t    Government Advocate\n\t\t\t*******\n:ORDER\n<\/pre>\n<p>******<\/p>\n<p>\t\tHeard Mr.P.Senthurpandian, learned counsel for the petitioner and<br \/>\nMr.S.C.Herold Singh, learned Government Advocate for the respondents.\n<\/p>\n<p>\t\t2. The Writ Petition is filed by the petitioner seeking to challenge<br \/>\nthe order of the first respondent, Director General of Police, dated 15.01.2006,<br \/>\nwho, in turn, has confirmed the order of punishment imposed by the fourth<br \/>\nrespondent, Deputy Commissioner of Police, dated 07.09.1999.\n<\/p>\n<p>\t\t3. When the Writ Petition came up for hearing on  08.02.2007, notice<br \/>\nof motion was ordered and on notice from this Court, the third respondent has<br \/>\nfiled a counter-affidavit dated Nil (March, 2007).\n<\/p>\n<p>\t\t4. The petitioner was imposed with a penalty of reduction in time<br \/>\nscale of pay by two stages for two years with cumulative effect. The reason for<br \/>\nimposition of the penalty was that while he was escorting an accused, by name<br \/>\nKundu @ Karuppasamy, who was involved in a criminal case in Crime No.295 of 1999<br \/>\non the file of Tirunelveli Junction Police Station, in an auto-rickshaw, he took<br \/>\nhim to a place unauthorizedly on 11.04.1999. The petitioner was escorted the<br \/>\naccused from the sub jail, Tirunelveli to Tirunelveli Medical College Hospital<br \/>\nand the petitioner has facilitated bringing the wife of the accused, after<br \/>\nsending a boy to her house. The statements were recorded from the wife and<br \/>\nanother relative as well as from the auto drivers. Charges under Rule 3(b) of<br \/>\nthe Tamil Nadu Police Subordinate Service (Discipline and Appeal) Rules, 1955<br \/>\nwere framed and an enquiry was conducted against the petitioner. In that<br \/>\nenquiry, six witnesses were examined. During the enquiry, the wife and the<br \/>\nrelative of the accused as well as the auto-rickshaw drivers were examined as<br \/>\nP.Ws.1 to 4, who turned hostile. Nevertheless the Deputy Commission of Police,<br \/>\nthe fourth respondent herein, on the basis of the testimony of P.W.5 and P.W.6<br \/>\nas well as the documentary evidence, found the petitioner guilty. It was on that<br \/>\nbasis, the minor penalty came to be imposed.\n<\/p>\n<p>\t\t5. The petitioner preferred a statutory appeal before the Deputy<br \/>\nInspector General of Police, Tirunelveli and the same was rejected on<br \/>\n10.02.2000. Subsequently, the petitioner preferred a review petition to the<br \/>\nsecond respondent. The second respondent, on considering the review petition,<br \/>\nwhile confirming the findings recorded against the petitioner, modified the<br \/>\npunishment of reduction in time scale of pay by two stages for two years, but<br \/>\nhowever, without cumulative effect.\n<\/p>\n<p>\t\t6. The petitioner, thereafter, submitted a mercy petition to the<br \/>\nfirst respondent. The first respondent, on a speaking order dated 15.01.2006,<br \/>\nrejected his mercy petition. As against this penalty order, the Writ Petition<br \/>\nhas been filed.\n<\/p>\n<p>\t\t7. In the counter-affidavit, it was stated that even though the<br \/>\nrelatives of the accused went back from their statement, the statement made by<br \/>\nP.W.5 and P.W.6 and the document in Ex.P.8 are sufficient to hold the petitioner<br \/>\nguilty.\n<\/p>\n<p>\t\t8. The learned counsel for the petitioner, by placing reliance upon<br \/>\na judgment of a Division Bench of this Court in the State of Tamil Nadu, etc.<br \/>\nand others vs. S.Mahalingam and others  reported in 2005 Writ L.R. 786, would<br \/>\ncontend that in order to prove a charge, there must be independent witnesses,<br \/>\neven though the evidence of official witnesses must be corroborated by<br \/>\nindependent witnesses.\n<\/p>\n<p>\t\t9. In that case, the Court was concerned with major penalty of<br \/>\ndismissal of Government servant for having received bribery amount. In that<br \/>\ncontext, the Court was concerned about independent witnesses. The said decision<br \/>\ncannot have any application to the facts on hand. Even though a minor penalty<br \/>\nwas imposed on the petitioner, he was dealt with the procedure for imposition of<br \/>\nmajor penalty and, therefore, it cannot be said that he did not have a<br \/>\nsufficient safe guard in the enquiry held against him. On the contrary for<br \/>\nimposition of a minor penalty, the charges were framed under Rule 3(b) of the<br \/>\nTamil Nadu Police Subordinate Service (Discipline and Appeal) Rules, 1955. There<br \/>\nwas no necessity even to conduct any elaborate enquiry and it is sufficient that<br \/>\non receipt of explanation, the authority can impose a penalty.\n<\/p>\n<p>\t\t10. In the present case, the petitioner had the benefit of an<br \/>\nappeal, review and mercy petition before the hierarchy of officers and  the<br \/>\nreviewing authority modified the penalty by converting the penalty having a<br \/>\ncumulative effect into non-cumulative effect.\n<\/p>\n<p>\t\t11. The Supreme Court, vide judgment in <a href=\"\/doc\/752285\/\">V.S.P. v. Goparaju Sri<br \/>\nPrabhakara Hari Babu<\/a> reported on 2008(5) SCC 569, has held that this Court has a<br \/>\nlimited jurisdiction to go into the proportionality of punishment. A well<br \/>\nreasoned order of the departmental authority cannot be interfered with on the<br \/>\nbasis of sympathy and sentiments. Once the formalities of an enquiry is<br \/>\ncompleted and the charges are proved, the Courts ought not to have disturbed the<br \/>\npenalty.\n<\/p>\n<p>\t\t12. Further, in <a href=\"\/doc\/417002\/\">Praveen Bhatia v. Union of India<\/a>  reported in<br \/>\n2009(4) SCC 225, the Supreme Court has held that judicial review of penalty is<br \/>\nextremely limited and the Court can interfere only when the relevant factors are<br \/>\nnot taken into account.\n<\/p>\n<p>\t\t13. In the light of the above, this Court is not inclined to<br \/>\ninterfere with the impugned order and hence, the Writ Petition stands dismissed.<br \/>\nConsequently, the connected miscellaneous petitions are closed.
