SHAH\n\t\t\n\t\n\n \n\nDate\n: 12\/05\/2009 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>Rule.\n<\/p>\n<p>\tMs. Calla, learned AGP waives service of notice of Rule on behalf of<br \/>\n\tthe respondent State. With the consent of the parties, the matter is<br \/>\n\ttaken up for final hearing today.\n<\/p>\n<p>By<br \/>\n\tway of this petition under Article 226 of the Constitution of India,<br \/>\n\tpetitioner has prayed for an appropriate writ, direction and order<br \/>\n\tdirecting the respondents to consider the case of the petitioner for<br \/>\n\tcompassionate appointment.\n<\/p>\n<p>It<br \/>\n\tis the case on behalf of the petitioner that father of the<br \/>\n\tpetitioner has died on 22.2.2007 while in service. That immediately<br \/>\n\ton 23.3.2007 petitioner applied for compassionate appointment and<br \/>\n\this application has been rejected by the respondent authorities on<br \/>\n\tthe ground that  the family of the applicant is getting monthly<br \/>\n\tpension and, therefore, as per the policy \/ G.R dated 29.3.2007, the<br \/>\n\tpetitioner is not entitled to compassionate appointment as the<br \/>\n\tfamily cannot be said in pathetic condition. Hence, the petitioner<br \/>\n\thas preferred the present Special Civil Application under Article<br \/>\n\t226 of the Constitution of India.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tTrivedi, learned advocate for Shri HM Padhya, learned advocate<br \/>\n\tappearing on behalf of the petitioner has vehemently submitted that<br \/>\n\tthe respondent authorities have materially erred in rejecting the<br \/>\n\tapplication of the petitioner for compassionate appointment relying<br \/>\n\tupon the resolution \/ policy dated 29.3.2007. It is submitted that<br \/>\n\tthe application of the petitioner for compassionate appointment was<br \/>\n\trequired to be considered considering the policy \/ Government<br \/>\n\tResolution which was prevailing at the time when the petitioner<br \/>\n\tsubmitted application i.e. as on 23.3.2007. It is submitted that<br \/>\n\tprior to the Government Resolution dated 29.3.2007 there was no<br \/>\n\tincome criteria and, therefore, the action of the respondent in<br \/>\n\trejecting the application of the for compassionate appointment<br \/>\n\trelying upon the subsequent resolution\/policy deserves to be quashed<br \/>\n\tand set aside and the respondents are directed to consider the case<br \/>\n\tof the petitioner considering the policy\/ Government Resolution on<br \/>\n\tcompassionate appointment which was prevailing at the time when the<br \/>\n\tpetitioner was submitted application i.e. 23.3.2007.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tTrivedi, learned advocate for Shri HM Padhya, learned advocate<br \/>\n\tappearing on behalf of the petitioner has heavily relied upon the<br \/>\n\tdecision of the learned Single Judge of this Court in Special Civil<br \/>\n\tApplication No. 24534 of 2007, confirmed by the Division Bench vide<br \/>\n\torder dated 5.9.2008 as well as another decision of the learned<br \/>\n\tSingle Judge in Special Civil Application No. 5430 of 2004 confirmed<br \/>\n\tby the Division Bench in Letters Patent Appeal No. 49 of 2008 vide<br \/>\n\torder dated 4.2.2008, by which the Division Bench has directed the<br \/>\n\trespondents to consider the application for compassionate<br \/>\n\tappointment considering the policy \/ Government Resolution which was<br \/>\n\tprevailing at the time when the application was submitted for<br \/>\n\tcompassionate appointment.  By making above submissions and relying<br \/>\n\tupon the above decisions, it is requested to allow present Special<br \/>\n\tCivil Application.\n<\/p>\n<p>Petition<br \/>\n\tis opposed by Shri JK Shah, learned AGP by submitting that looking<br \/>\n\tto the retiral benefit received by the petitioner and his family<br \/>\n\tmembers and amount of family pension, it cannot be said that the<br \/>\n\tfinancial position of the petitioner and his family is so pathetic<br \/>\n\twhich warrant appointment on compassionate ground and, therefore,<br \/>\n\tapplication of the petitioner is rightly rejected.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocates appearing on behalf of the respective<br \/>\n\tparties and it is not in dispute that the petitioner submitted<br \/>\n\tapplication for appointment on compassionate ground on 23.3.2007 .<br \/>\n\tIt is also not in dispute that while rejecting the application of<br \/>\n\tthe petitioner for compassionate appointment the respondent has<br \/>\n\trelied upon the Government Resolution dated 29.3.2007. As held by<br \/>\n\tthe Hon&#8217;ble Supreme Court as well as this Court in catena of<br \/>\n\tdecisions, more particularly, decisions of the learned Single Judge<br \/>\n\tin Special Civil Application No. 24534 of 2007, confirmed by the<br \/>\n\tDivision Bench of this Court in Letters Patent Appeal, application<br \/>\n\tis required to be decided and considered  considering the policy\/G.R<br \/>\n\tprevailing at the time when the application is submitted not<br \/>\n\tconsidering the Policy\/Resolution prevailing at the time when the<br \/>\n\tapplication is decided. It is also not in dispute that prior to the<br \/>\n\tGovernment Resolution dated 29.3.2007 there was no income criteria.<br \/>\n\tUnder the circumstances, the impugned decision of the respondent in<br \/>\n\trejecting the application of the petitioner for compassionate<br \/>\n\tappointment considering the Government Resolution dated 29.3.2007,<br \/>\n\tdeserves to be quashed and set aside and the application of the<br \/>\n\tpetitioner for compassionate appointment is required to be<br \/>\n\tconsidered considering the policy\/resolution prevailing as on<br \/>\n\t23.3.2007 i.e. the day on which the application of compassionate<br \/>\n\tappointment was submitted.\n<\/p>\n<p>For<br \/>\n\tthe reasons stated above, petition succeeds. The impugned decision \/<br \/>\n\tcommunication rejecting the application of the petitioner for<br \/>\n\tcompassionate ground is hereby quashed and set aside and the matter<br \/>\n\tis remanded to the appropriate authority to reconsider the<br \/>\n\tapplication of the petitioner for appointment on compassionate<br \/>\n\tground, considering the policy\/G.R prevailing as on 23.3.2007. The<br \/>\n\trespondents are directed to consider the case of the petitioner<br \/>\n\tconsidering the policy\/G.R  of the compassionate appointment which<br \/>\n\twas prevailing as on 23.3.2007 and such decision to be taken by the<br \/>\n\trespondent authority within a period of three months from today and<br \/>\n\tcommunicate the outcome of the same to the petitioner forthwith.<br \/>\n\tRule is made absolute to the aforesaid extent. No costs.
