(J)\n\nCITATION:\n 1979 AIR  418\t\t  1979 SCR  (2) 338\n 1979 SCC  (1) 248\n\n\nACT:\n     Right  to\ta  licence-when\t the  bye  laws\t permit\t the\nlicencing authority to. grant or to refuse licences, whether\nsaid to\t offend Art, 19(1) (a) of the Constitution of India,\n1950.\n\n\n\nHEADNOTE:\n     Dismissing the special leave petition, the Court,\n^\n     HELD: 1.  No butcher,  baker or  circus manager can say\nthat he\t has the  unqualified right to get a licence on mere\napplication. It is open to the licencing  Council-Indeed, is\nobligatory  on\t its  part-to  take  note  of  all  relevant\ncircumstances and  then decide\twhether, in  the  particular\nspot chosen by the particular applicant, a licence should be\ngranted or not. [339C-D]\n     2. Various\t factors enter\tthe verdict  and  the  local\nauthorities are\t the best  judge of the factual factors, not\nthe Court  especially, the  Supreme Court  at the third tier\nThe factual  factors may  be many,  like  the  proximity  to\nschools, public\t institutions  and  also  residents  of\t the\nlocality plus  the reaction  or impact on those institutions\nand residents,\tthe unreasonableness to grant licence to the\nsame person  or one  for the father and another for the son,\nthe need  for an  extra shop, other considerations which are\ngermane from  peace-keeping and welfare-oriented view-points\netc. Certainly\tgranting  a  lease  solely  because  someone\noffers a  large donation  to the  Municipality\tmay  not  be\ncorrect. [339D. G, 340B]\n     3. No  doubt Municipal  discretion should\tbe exercised\nrationally,  not   religiously\tnor  ritually  and  judicial\ndiscretion should  go into anxiously, not impetuously nor in\ndisregard of  the pragmatic guideline that local authorities\nare the\t best judges  of local\tconditions.  Of\t course,  if\nirrelevant criteria  or\t perverse  application\tvitiate\t the\ndecision, courts  will guardian\t the  rule  of\tlaw  against\nlittle tyrants\ttrampling  over\t people's  rights  or  local\nfactions fouling the council s verdict. [340C-D]\n     In the  instant case, the ground on which the Municipal\nbody, has  refused licence  is not  irrelevant and cannot be\ndescribed as  unreasonable within  the meaning of Art. 19(6)\nof the constitution. Mudgal<br \/>\nfor the Respondent.\n<\/p>\n<p><span class=\"hidden_text\">339<\/span><\/p>\n<p>     The order or the Court was delivered by<br \/>\n     KRISHNA IYER,  J.\tThe  petitioner&#8217;s  counsel,  in\t his<br \/>\nfighting submission,  argues that  his client&#8217;s\t fundamental<br \/>\nright to  a licence  for a meat shop has been flouted by the<br \/>\nlittle Limdi Municipality, founding himself on a decision of<br \/>\nthis Court  in Mohd. Faruk, v. M. P. State(1). That decision<br \/>\nhardly helps.  There a byelaw was challenged as violative of<br \/>\nArt 19(1)(g).  Here there  is no law whatever which bans the<br \/>\ngrant of  meat\tlicences.  Indeed,  there  are\tthree  other<br \/>\nlicensed meat  stalls and  the petitioner himself had a meat<br \/>\nlicence in  a shop  leased to  him by  the same Municipality<br \/>\nearlier which by efflux of time had expired. The law vests a<br \/>\ndiscretion to  he reasonably  exercised in  the\t content  of<br \/>\ncitizen&#8217;s  fundamental\t right.\t The  ground  on  which\t the<br \/>\nMunicipal body\thas refused  licence here  is not irrelevant<br \/>\nand cannot  be described  as unreasonable within the meaning<br \/>\nof Art.\t 19(6) of  the Constitution. The bye-laws permit the<br \/>\nmunicipality, as  the licensing\t authority, to\tgrant or  to<br \/>\nrefuse licences. No butcher, baker or circus manager can say<br \/>\nthat he\t has the, unqualified right to get a licence on mere<br \/>\napplication. It\t is open to the licensing council indeed, is<br \/>\nobligatory  on\tits  part  to  take  note  of  all  relevant<br \/>\ncircumstances and  then decide\twhether, in  the  particular<br \/>\nspot chosen by the particular applicant&#8221; a licence should be<br \/>\ngranted. Various  factors enter\t the verdict  and the  local<br \/>\nauthorities are the best judge of these factual factors, not<br \/>\nthe court, especially this Court sitting at the third tier.\n<\/p>\n<p>     The, Limdi\t Municipality is  stated to  be a  small one<br \/>\nwith a population of around 25000. It is admitted that there<br \/>\nare three  licensed meat  vendors including  one who  is the<br \/>\nfather of the petitioner. The claim of the petitioner is for<br \/>\na fourth  licence. It  is quite\t conceivable that the fourth<br \/>\nmay be\tsupernumerary. It  is quite  understandable that the<br \/>\nmunicipality may  think that  it is  not reasonable to grant<br \/>\nlicence to the same person or one for the father and another<br \/>\nfor the\t son. Moreover,\t we cannot  dismiss as irrelevant or<br \/>\nobnoxious the consideration the strong feelings of the local<br \/>\npeople resulting in law and order problems. The proximity to<br \/>\nschools, public\t institutions  and  also  residents  of\t the<br \/>\nlocality plus  the reaction  or impact on those institutions<br \/>\nand residents maybe germane from peace-keeping and welfare<br \/>\noriented view-points.  We agree that local bodies should not<br \/>\nsuccumb\t  to   religious   susceptibilities   or   fanatical<br \/>\nsentiments  in\tsecular\t India\tand  refuse  licences  where<br \/>\nfundamental rights  have to  be respected.  Even so, in the,<br \/>\ntotality of circumstances present in the present case, it is<br \/>\nnot possible  for us  to postulate  that there\thas been  an<br \/>\nabuse of  discretion or\t a perverse  use of  power. In\tthis<br \/>\nview, we decline to interfere. Certainly, the munici<br \/>\n(1) [1978] I SCR 156.\n<\/p>\n<p><span class=\"hidden_text\">340<\/span><\/p>\n<p>pal authority  will take  care to  be alert and alive to the<br \/>\nfundamental right of citizens and not refuse licences merely<br \/>\nscared by mob sentiment or panicked by religious reaction.\n<\/p>\n<p>     In the instant case there is a composite lease-cum<br \/>\ncum-lease of  a meat  shop and licence for carrying on trade<br \/>\nin mutton.  There is  no  obligation  on  the  part  of\t the<br \/>\nmunicipality to grant a lease of its property to any one who<br \/>\nasks for  it merely  for the asking. Granting a lease solely<br \/>\nbecause\t some\tone  offers   a\t large\t donation   to\t the<br \/>\nmunicipality. as  nearly happened  here, may not be correct,<br \/>\nwhich this local body will note. If the refusal of the lease<br \/>\nor its\trenewal cannot\tbe faulted, the question of grant of<br \/>\nthe licence  does not  arise. In this view also we ( find it<br \/>\ndifficult to accede to the argument of the petitioner.\n<\/p>\n<p>     We agree  that municipal discretion should be exercised<br \/>\nrationally,  not  religiously  nor  ritually,  but  we\talso<br \/>\nrealize that  judicial discretion  should go into anxiously,<br \/>\nnot impetuously\t nor in disregard of the pragmatic guideline<br \/>\nthat  local   authorities  are\tthe  best  judges  of  local<br \/>\nconditions.
