-vappearingt\ufb02for: the appellants and i\\\/Ir.Sornashekar, learned<\/p>\n
it it ” licourisel a\ufb01pearing for the respondent.<\/p>\n
V.   The facts leading to this case are as hereunder:<\/p>\n
 .  sum of Rs.1,25,266\/~ was paid by the p1aintiff–co1npany to<\/p>\n
the defendants towards royalty, a sum of Rs.31,392\/– under
\n{V<\/p>\n
three \ufb01xed deposit of Rs.l0,464\/– each was paid and a’*su1n of<\/p>\n
Rs. 1,000\/– was paid towards electricity charges. <\/p>\n
amount was paid by the plaintiff to the defendants  a* <\/p>\n
counter\/ space and a parking area -to do the l_)usinessv–.in car i j<\/p>\n
rental service in the Airport of Banggalore\u00a7’ll  <\/p>\n
space to be allotted by the lgde_fe.ndants.__to   the<\/p>\n
aforesaid deposits were made by.tl’le’pvpla\u00a7_ntiff,l ‘b’ut_unfortunately,
\nthe defendants could   to the plaintiff on
\naccount of the suitinstituted  Rental Service,
\nBangalore, in,   of the City Civil
\nCourt, Bangalarg.  was granted in the said
\nsuit.   till the defendants \ufb01led a memo in
\nthe year   therein –M\/s.Manju Car<\/p>\n
Rental; ‘Service, Bangalore, would be evicted under due process<\/p>\n
 of \u00abjavv. ;’l’.l:C_ont_ending that on account of the interim order<\/p>\n
grant__cr_jl ‘in””eVarl{er:”suit \ufb01led by M\/s.Manju Car Rental Service,<\/p>\n
 _ Bangalore; a~ppellants–defendants could not provide the space to<\/p>\n
  plaintiff and on the ground that the plaintiff has suffered<\/p>\n
 _ account of not providing space to it, the plaintiff has<\/p>\n
if  \ufb01led a suit for recovery of a sum of Rs.3,05,654\/– along with<\/p>\n
“interest at 18% pa f;\/<\/p>\n

5. Appellants~–defendants on service of notice, contested the<\/p>\n
suityaccepting the amount of Rs.2,01,794\/– which paid as<\/p>\n
deposits to provide the space to the plaintiff to <\/p>\n
car rental service and also admitted that the   , <\/p>\n
provided to the plaintiff on account ofttinistitutioln of :’suit,_l>y<\/p>\n
M \/ s.Manju Car Rental Service,\u00bbBangalore,l”in \/  ;<\/p>\n
and the appellants further   respondent.
\nplaintiff has not sustained ‘   appellants
\nrequest the Courtpto disrniss  also resisted
\nthe suit on the  ‘\ufb01ledilby the plaintiff was<\/p>\n
barred by lirftitatgiolnll sirlcejthe  isvfvinlstituted in the year 1995<\/p>\n
to recover the fs’ecuri’ty  -paid in the month of March,<\/p>\n
1990. Ame suiti-sf ‘net tiledfvvithin the period of three years, it<\/p>\n
was cgoritended appellants that the suit \ufb01led by the<\/p>\n
 pp’lai_ntiff   by limitation.\n<\/p>\n
  pleadings of the parties, the trial Court<\/p>\n

\nl the advance royalty, security deposit and electricity

iii) Whether the plaintiff is entitled for interest at 18%
\npa. as claimed on items 9(a) to 9[c)? H\n<\/p>\n
iv) Whether the suit is bad for non–joinder~~oi<\/p>\n
party i.e. M\/s.l\\\/Ianju Taxi Service’.?W_T’~–.,.  in<\/p>\n
v) Whether the defendants; that-I’c–or1tract”VcVou?.d it<\/p>\n

7. In:’order\u00ab  _  contentions, on behalf of
\nplaintiff,vVV’xone._ was examined as P.W.1 and he<\/p>\n
relied upon ‘E:1:s.Pl. to  on behalf of defendants, no oral<\/p>\n
 Q1\u00bb d.:\u00a7ci1I1.1er1t,ary eyic}e–nce was let in. The Trial Court, after<\/p>\n
.Ccon.side,rin,:g’theiievidence let in by the parties held issue No.1 in<\/p>\n
af\ufb01rmative, ‘issire No.2 innegative and in regard to issue No.3<\/p>\n
 Tthe held that the respondent–plaintiff is entitled to claim<\/p>\n
V’ :.intere’s.t from 17.03.1994, issue No.4 and 6 in negative, issue<\/p>\n
  affirmative. Ultimately, the suit came to be decreed only<\/p>\n
 a sum of Rs.2,0l,’794\/- with interest at 6% p.a. from the<\/p>\n
6,.\n<\/p>\n
question is when actually the cause of action arose for the
\nplaintiff to institute the suit. So far as this point is concerned,<\/p>\n
it is not in dispute that the appellants <\/p>\n
security deposit from the plaintiff did not inforin’-the  <\/p>\n
take back the security deposit paidbyfit’ on ‘acc-:0ufn’t”.of_thVe suit if<\/p>\n
instituted by M\/s.Manju Car Rentaiifi\ufb01erkrices. .’Eve11 <\/p>\n
when the space was not  to   the
\ndefendants, in all faimesatyhthe  beinga public sector
\nundertaking of the Uniofnfffoff   refunded the
\namount to the pvlaintiff   knowledge that it
\ncannot  llllitliout doing so, the<\/p>\n
defendants have ..security deposit amount. Be that<\/p>\n
as it may, it cisiithefcase, of plaintiff that the defendants went<\/p>\n
_ on prgonlising they’ Vpfaiintiff to provide space after evicting<\/p>\n
  Rental Services since in the year 1994 a memo<\/p>\n
defendants in the suit \ufb01led by M\/s.Manju Car<\/p>\n
 _ Rental  as per Ex.P18. Therefore, the suit filed by the<\/p>\n

“f:”12V,; These facts are not in dispute. When this factual aspects<\/p>\n
7,are not in dispute, we are of the opinion that there was no cause<\/p>\n
of action for the plaintiff to file the suit earlier as the defendants<\/p>\n

at no point of time refused to allot the space which was<\/p>\n

are of the opinion that the Trial Court is justi\ufb01ed-.’in  <\/p>\n
