      Revision      is    directed        against       the order<\/p>\n
dated  22.3.2006      in     O.P.(Electricity)           No.315\/02<\/p>\n
passed by the Additional District Judge (Ad hoc-<\/p>\n
II), Ernakulam.        The respondent in the revision<\/p>\n
petition   (hereinafter           referred         to    as  ‘the<\/p>\n
claimant’) filed the above original petition under<\/p>\n
Section 10 and 16 of the Indian Telegraph Act and<\/p>\n
Section 51 of the Indian Electricity Act claiming<\/p>\n
enhanced  compensation          for     the     trees    cut  and<\/p>\n
removed and also towards the diminution of land<\/p>\n
value of her property on account of drawing of<\/p>\n
electric  lines      through       that      property     by  the<\/p>\n
revision petitioner (hereinafter referred to as<\/p>\n
‘the Board’).      Towards the compensation for the<\/p>\n
trees cut and removed for drawing of the line, the<\/p>\n
Board  had   assessed        and     paid      compensation    of<\/p>\n
C.R.P.No.301 of 2007<\/p>\n
                       :: 2 ::\n<\/p>\n
Rs.33,190\/- to the claimant.   Contending that the<\/p>\n
compensation paid is unreasonable and inadequate<\/p>\n
the claimant preferred the above original petition<\/p>\n
(O.P.(Electricity) No.315\/02).  The Board resisted<\/p>\n
that   application   contending  that   just   and<\/p>\n
reasonable compensation had already been paid.<\/p>\n
      2.   In the enquiry over the claim raised,<\/p>\n
the claimant was examined and Ext.A1 was marked on<\/p>\n
her side.    On the side of the Board only the<\/p>\n
detailed valuation statement was got marked.   An<\/p>\n
Advocate Commissioner deputed by the court, after<\/p>\n
conducting local inspection, filed a report and<\/p>\n
plan which were exhibited as Ext.C1.  The electric<\/p>\n
lines were admittedly drawn through the property<\/p>\n
of the claimant having an extent of 18.6 cents of<\/p>\n
land comprising a residential building. The report<\/p>\n
of the Advocate Commissioner, Ext.C1, disclosed<\/p>\n
that the line was drawn cut across through the<\/p>\n
C.R.P.No.301 of 2007<\/p>\n

middle of the property.     Though the Commissioner<\/p>\n
had assessed the land value at Rs.75,000\/- per<\/p>\n
cent noting the importance of the locality wherein<\/p>\n
a temple and other public offices are situate<\/p>\n
closeby, the court below relying on a sale deed<\/p>\n
executed over 7 cents of land situate closeby,<\/p>\n
fixed the land value at Rs.20,000\/- per cent.<\/p>\n
Fixing the amount for injurious affection on the<\/p>\n
land for drawing of the line at 30% and taking<\/p>\n
note that the line had been drawn across the<\/p>\n
property, the learned District Judge concluded<\/p>\n
that the entire land was injuriously affected and<\/p>\n
in  that  view   of  the  matter,  compensation of<\/p>\n
Rs.1,11,900\/- was awarded to the claimant for the<\/p>\n
diminution of the land value of her property.<\/p>\n
      3.   Admittedly, the Board had assessed the<\/p>\n
compensation for the trees cut and removed at 10%<\/p>\n
annuity   return   and thus   fixed  the  same  at<\/p>\n
C.R.P.No.301 of 2007<\/p>\n
                        :: 4 ::\n<\/p>\n
Rs.33,190\/-. Taking note of the guidelines and the<\/p>\n
judicial pronouncements rendered by this court in<\/p>\n
ascertaining and fixing compensation towards the<\/p>\n
value of the trees, the court below fixed annuity<\/p>\n
return at 5% and re-assessed the compensation.  On<\/p>\n
such   re-assessment,      additional  compensation<\/p>\n
towards the trees cut and removed was found to be<\/p>\n
Rs.20,000\/- and it was accordingly awarded.     The<\/p>\n
learned counsel for the Board contended that the<\/p>\n
principle enunciated by this court for fixation at<\/p>\n
5% annuity return had been found to be not correct<\/p>\n
by the Apex Court in the decision in K.S.E.B. v.<\/p>\n
Livisha and others {2007(3) K.L.T. 1} and so much<\/p>\n
so, the compensation fixed by the court below was<\/p>\n
not correct.    Similarly, it is further contended<\/p>\n
that the land value fixed and also the percentage<\/p>\n
of injurious affection determined was also on the<\/p>\n
higher side.   In Livisha’s case the Apex Court has<\/p>\n
C.R.P.No.301 of 2007<\/p>\n
                        :: 5 ::\n<\/p>\n
held  that    the   importance  of  the  locality,<\/p>\n
closeness of the public office etc., have also to<\/p>\n
be considered in fixing the compensation for the<\/p>\n
diminution of land due to the drawing of the<\/p>\n
electric line through the property.<\/p>\n
      4. I find that the learned District Judge<\/p>\n
has taken the relevant factors with reference to<\/p>\n
Ext.A1 title deed over the adjoining land in<\/p>\n
fixing the land value.       30% of the land value<\/p>\n
fixed towards injurious affection in the given<\/p>\n
facts of the case cannot be stated to be excessive<\/p>\n
where it is seen that the overhead lines had cut<\/p>\n
across through the middle of the property. I find,<\/p>\n
stated there is any impropriety in the fixation of<\/p>\n
the compensation towards diminution of the land<\/p>\n
value by the court below. Enhanced compensation<\/p>\n
awarded for the trees cut and removed, is found to<\/p>\n
be just and reasonable. In exercise of revisional<\/p>\n
C.R.P.No.301 of 2007<\/p>\n
                          :: 6 ::\n<\/p>\n
jurisdiction interference with an order passed by<\/p>\n
the inferior court is permissible only if there is<\/p>\n
jurisdictional infirmity which if not be corrected<\/p>\n
would result in miscarriage of justice.     There is<\/p>\n
no jurisdictional infirmity in the orders passed<\/p>\n
by the court below and no ground is made out for<\/p>\n
exercise of revisional jurisdiction in the present<\/p>\n
case.\n<\/p>\n
      Civil Revision Petition lacks merit and is<\/p>\n
dismissed.\n<\/p>\n<\/p>\n
