However, when the matter was<br \/>\ncalled out yesterday, i.e. on 1st September 2005, this<br \/>\nCourt passed following order:\n<\/p>\n<p>?SHeard Shri H.M<br \/>\nPrachhak, learned Additional Public Prosecutor for the State and Shri<br \/>\nP.M.Thakkar, learned senior advocate with Mr.Dipak Thakkar<br \/>\nfor the respondents.\n<\/p>\n<p>Shri Prachhak, learned<br \/>\nAdditional Public Prosecutor requests for time to seek instructions<br \/>\nfrom his counterpart at the District Court, Surendranagar.\n<\/p>\n<p>The matter stands<br \/>\nadjourned to 2nd September 2005.??\n<\/p>\n<p>\tIt<br \/>\nis pertinent to note that the order passed by the Sessions Judge,<br \/>\nSurendranagar in Criminal  Misc.Application<br \/>\nNo.103 of 2005 is dated 27th May 2005. Clause 6 of the<br \/>\nconditions as imposed alongwith the order<br \/>\nrefers that the order shall remain in force for a period of 90 days<br \/>\nfrom the date of the order, but the applicants shall apply for<br \/>\nobtaining regular bail within a period 10 days from the date of their<br \/>\narrest.\n<\/p>\n<p>\tIt<br \/>\nis an admitted position that this application is filed by the State<br \/>\nof Gujarat on 24th August 2005 and upon hearing learned<br \/>\nAdditional Public Prosecutor, this Court passed an oral order dated<br \/>\n25th August 2005 as under:\n<\/p>\n<p>?SHeard ld.APP Mr. LR<br \/>\nPujari for the petitioner State. Considering the gravity of the<br \/>\noffence and other circumstances placed on record and the amount<br \/>\ninvolved in the financial scam, the present Cri. Misc. Application<br \/>\nchallenging the impugned order granting anticipatory bail dated<br \/>\n27.05.2005 granted in favour of the respondents accused passed by the<br \/>\nld. Sessions Judge, Surendranagar in Cri. Mis. Application<br \/>\nNo.103\/2005 requires consideration.\n<\/p>\n<p>Hence, notice to the<br \/>\nrespondents returnable on 01.09.2005.\n<\/p>\n<p>In the meanwhile, the<br \/>\noperation and execution of the impugned order granting anticipatory<br \/>\nbail dated 27.05.2005 granted in favour of the respondents accused<br \/>\npassed by ld. Sessions Judge, Surendranagar in Cri. Misc. Application<br \/>\nNo.103\/2005, is placed under suspension till the returnable date.\n<\/p>\n<p>D.S. Permitted.??\n<\/p>\n<p>\tIt<br \/>\nis clear from the record of the case that when the order dated 25th<br \/>\nAugust 2005 was passed, 90 days, a duration of anticipatory bail as<br \/>\ngranted by the learned Sessions Judge, Surendranagar stands over.<br \/>\nTherefore, learned Additional Public Prosecutor having taken<br \/>\ninstructions from his counterpart from the District Court,<br \/>\nSurendranagar has fairly stated that the order dated 25th<br \/>\nAugust 2005 will have no effect, since the period of 90 days is<br \/>\nalready over and challenge to the impugned order dated 27.05.2005<br \/>\ndoes not exist any more. He has further submitted that if remedy is<br \/>\navailable under the law, the State authority can move an appropriate<br \/>\nCourt for cancellation of the bail granted by the trial Court or the<br \/>\nsubordinate Court.\n<\/p>\n<p>\tShri<br \/>\nP.M.Thakkar, learned senior advocate appearing for the opponents<br \/>\nargued that the accused have right to move a fresh application for<br \/>\nanticipatory bail or to ask for extension<br \/>\nof time as the case may be and since the subject matter of the<br \/>\npresent case does not remain in existence<br \/>\nas the challenge by the State on the grounds mentioned therein, the<br \/>\norder dated 25th August 2005 staying the execution of<br \/>\nearlier order dated 27th May 2005 passed by the learned<br \/>\nSessions Judge, Surendranagar does not require any adjudication.\n<\/p>\n<p>\tHaving<br \/>\nheard the learned counsel for the parties, I am of the opinion that<br \/>\nthe arguments of both the parties reveal one fact that duration of<br \/>\nanticipatory bail of 90 days as prescribed<br \/>\nin Clause No.6 of the order dated 27th May 2005 by the<br \/>\nlearned Sessions Judge, Surendranagar in Criminal Misc.Application<br \/>\nNo.103 of 2005 is already over and, therefore, the order dated 25th<br \/>\nAugust 2005 has become infractuous and it has no bearing in view of<br \/>\nthe grounds on which the impugned order came to be challenged.\n<\/p>\n<p>\tIn<br \/>\nthe circumstances, this application is disposed of with the aforesaid<br \/>\nobservations.
