SANKARAN, J.\n                     ---------------------------\n                     B.A. No. 1311 of 2010\n                 ------------------------------------\n             Dated this the 22nd day of March, 2010\n\n                            O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under Section 438<\/p>\n<p>of the Code of Criminal Procedure. The petitioners are accused<\/p>\n<p>Nos.1 and 2 in Crime No. 53\/2010 of Badiaduka Police Station,<\/p>\n<p>Kasaragod District.\n<\/p>\n<p>     2.    The offences alleged against the petitioners are under<\/p>\n<p>Sections 324, 332 and 506(ii) read with Section 34 of the Indian<\/p>\n<p>Penal Code.\n<\/p>\n<p>     3. When the Bail Application came up for hearing on<\/p>\n<p>09.03.2010, the following order was passed:<\/p>\n<blockquote><p>                 &#8220;After having heard the learned counsel<\/p>\n<p>           for the petitioners and the learned Public<\/p>\n<p>           Prosecutor, I am of the view that before<\/p>\n<p>           disposing    of    the    Bail   Application,  an<\/p>\n<p>           opportunity should be given to the petitioners<\/p>\n<p>           to appear before the investigating officer.<\/p>\n<p>           Accordingly, there will be a direction to the<\/p>\n<p>           petitioners to appear before the investigating<\/p>\n<p>           officer at 9 A.M. on 15th and 16th March, 2010.<\/p>\n<\/blockquote>\n<blockquote><p>                 Post on 22.03.2010.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">B.A. No. 1311 of 2010              2<\/span><\/p>\n<p>                     It is submitted by the learned Public<\/p>\n<p>              Prosecutor that the petitioners will not be<\/p>\n<p>              arrested until further orders in connection with<\/p>\n<p>              Crime No.53\/2010 of Badiaduka Police Station,<\/p>\n<p>              Kasaragod District.\n<\/p><\/blockquote>\n<blockquote><p>                     The petitioners shall produce copy of this<\/p>\n<p>              order before the investigating officer.<\/p>\n<\/blockquote>\n<blockquote><p>                     Hand over copy to both sides.&#8221;<\/p><\/blockquote>\n<p>      4. It is submitted by the learned counsel for the petitioners<\/p>\n<p>and the learned Public Prosecutor that the petitioners have<\/p>\n<p>complied with the direction contained in the order dated<\/p>\n<p>09.03.2010.\n<\/p>\n<p>      5.     Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioners.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioners, the officer in charge of the police station        shall<\/p>\n<p>release them on bail on their executing bond for Rs.15,000\/-<\/p>\n<p>each with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<p><span class=\"hidden_text\">B.A. No. 1311 of 2010              3<\/span><\/p>\n<blockquote><p>         A) The petitioners      shall    report    before     the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on alternate Mondays, till the final report is filed<br \/>\n             or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The      petitioners  shall    appear    before    the<br \/>\n             investigating officer for interrogation as and when<br \/>\n             required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioners shall not try to influence the<br \/>\n             prosecution    witnesses    or   tamper   with    the<br \/>\n             evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioners shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail.<\/p>\n<p>         E) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.<\/p><\/blockquote>\n<p>        The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                         K.T.
