Civil Suit no. 290\/2002.  For that, there is delay of 107 days<br \/>\n\tin filing first appeal.  Therefore, in civil application no.<br \/>\n\t9236\/2008 prayer is made to condone aforesaid delay in the interest<br \/>\n\tof justice.\n<\/p>\n<p>During<br \/>\n\tpendency of Civil Application no. 9236\/2008 and prior to that<br \/>\n\trespondent no. 9 and 10 expired, those who were claimants.\n<\/p>\n<p>Therefore,<br \/>\n\tState Government has filed present application with a prayer to<br \/>\n\tbring heirs and legal representative of respondent no. 9 and 10.<br \/>\n\tThis application is supported with affidavit of R. J. Gohil, TDO<br \/>\n\tPaddhari.  Along with civil application, death certificates of<br \/>\n\trespondent no. 9 ?  Veljibhai Arjabhai Moliya  and  respondent no.<br \/>\n\t10 -Shamjibhai Chakubhai Shingala are placed on record.\n<\/p>\n<p>Considering<br \/>\n\theirs and legal representative  respondent no. 9 and 10, whose names<br \/>\n\tare mentioned in present application, they are necessary to be join<br \/>\n\tas party respondents in place of original respondent no. 9 Valjibhai<br \/>\n\tand 10 Shamjibhai.  The detail is given in application.\n<\/p>\n<p>Considering<br \/>\n\tsubmissions made by both learned advocate appearing for respective<br \/>\n\tparties and averment made in this application supported with<br \/>\n\taffidavit and also death certificates of both respondents.
