C No.225 of 2008\n          ------------------------------------------------\n          Dated this the 16th day of January, 2009\n\n                            ORDER\n<\/pre>\n<p>    There   is        appearance                only       for R1.<\/p>\n<p>Respondent 2, 4 and 5 are served and there is<\/p>\n<p>no  appearance      for      them.         Notice         to R3 is<\/p>\n<p>returned again with the report &#8220;not known&#8221;.<\/p>\n<p>Hence, substitute service is asked for by the<\/p>\n<p>counsel for the petitioner vide I.A.104\/09.<\/p>\n<p>Counsel for the first petitioner submits that<\/p>\n<p>the third respondent is the brother of the<\/p>\n<p>first respondent and that in this Transfer<\/p>\n<p>Petition it is not necessary that he also<\/p>\n<p>should be served when all others are served.<\/p>\n<p>Hence, notice to R3 is dispensed with.<\/p>\n<p>    2. Heard arguments of counsel on both<\/p>\n<p>sides. The prayer of the petitioners is for<\/p>\n<p>transfer of O.P.540\/08, O.P.285\/08, O.P.299\/08<\/p>\n<p>and M.C.128\/08 pending on the file of the<\/p>\n<p>Family Court, Kottayam at Ettumanoor to the<\/p>\n<p><span class=\"hidden_text\">Tr. P. C No.225 of 2008           -2-<\/span><\/p>\n<p>       Family Court, Pathanamthitta at Thiruvalla.<\/p>\n<p>              3. The first respondent is the wife of<\/p>\n<p>       the       first    petitioner.   Counsel  for   the<\/p>\n<p>       petitioners submits that the transfer sought<\/p>\n<p>       for to the Family Court, Thiruvalla will be<\/p>\n<p>       more convenient for the petitioners as well as<\/p>\n<p>       to the respondents. Counsel for the first<\/p>\n<p>       respondent\/wife submits that such a transfer<\/p>\n<p>       is     not      at all  convenient   to the   first<\/p>\n<p>       respondent\/wife.         The   counsel   for    the<\/p>\n<p>       petitioners was asked as to whether the first<\/p>\n<p>       petitioner is paying maintenance to the first<\/p>\n<p>       respondent. He had practically no reply to<\/p>\n<p>       submit to the said query. The attempt of the<\/p>\n<p>       first petitioner\/husband is only to see that<\/p>\n<p>       the      first    respondent\/wife  is  harassed  by<\/p>\n<p>       getting a transfer of the case from Ettumanoor<\/p>\n<p>       to Thiruvalla without even paying maintenance<\/p>\n<p>       for her and there is no offer even made on<\/p>\n<p>       behalf of the petitioners by their counsel<\/p>\n<p><span class=\"hidden_text\">Tr. P. C No.225 of 2008           -3-<\/span><\/p>\n<p>       that the first petitioner will pay the entire<\/p>\n<p>       amounts due to the first respondent by way of<\/p>\n<p>       maintenance and will bear the expenses of the<\/p>\n<p>       first respondent&#8217;s coming over to the Family<\/p>\n<p>       Court,        Thiruvalla for  the conduct  of  the<\/p>\n<p>       cases.\n<\/p>\n<p>              4. In the circumstances, I see no merit<\/p>\n<p>       in the application for transfer.
