       The petitioner is working as H.S.A.(Physical Science) in<\/p>\n
St.Rita’s High School, Ponnurunni under the corporate management<\/p>\n
of the first respondent. According to the petitioner, she is the next<\/p>\n
eligible teacher to be appointed as Headmistress in any of the<\/p>\n
schools under the corporate management of the first respondent.<\/p>\n
However, respondents 3 and 4 were appointed as Headmistress of<\/p>\n
St.Mary’s High School, Vallarpadam and Headmaster of St.Joseph’s<\/p>\n
High School, Chathiath respectively.<\/p>\n
       2. The reliefs prayed for in the Writ Petition are the following:<\/p>\n
       “(i)   To declare that the petitioner is the next eligible<\/p>\n
              teacher to be promoted as HM in the 1st<\/p>\n
              respondent’s school run by the educational<\/p>\n
              agency before effecting promotion to 3rd and 4th<\/p>\n
              respondents.\n<\/p>\n

                                     :: 2 ::\n<\/p>\n<\/p>\n
      (ii)  To declare that the action of the 1st respondent in<\/p>\n
            promoting 3rd and 4th respondents is unjust, unfair,<\/p>\n
            illegal and void ab initio.\n<\/p>\n<\/p>\n
      (iii) Restrain     the  3rd   and     4th  respondents in<\/p>\n
            discharging their public duty as HM of the 1st<\/p>\n
            respondent’s respective schools run by the<\/p>\n
            educational agency.\n<\/p>\n<\/p>\n
      (iv)  The 2nd respondent may be directed not to<\/p>\n
            approve the promotion of 3rd and 4th respondents.<\/p>\n
      (v)   Declare that the petitioner is entitled to be<\/p>\n
            promoted as HM of any of the schools of 1st<\/p>\n
            respondent educational agency forthwith.<\/p>\n
      (vi)  Such other relief as deem fit necessary in the<\/p>\n
            interest of justice to the petitioner.”<\/p>\n
      3. According to the petitioner, she is senior to respondents 3<\/p>\n
and 4. According to the learned counsel appearing for the fourth<\/p>\n
respondent, the fourth respondent is senior to the petitioner.<\/p>\n
Learned counsel for the first respondent submitted that the schools<\/p>\n
under the corporate management of the first respondent have<\/p>\n
minority status and therefore, the Manager need not appoint the<\/p>\n

\nsenior most teacher as the Headmaster.         It is sufficient if a fair<\/p>\n
selection procedure is adopted and eligible persons are appointed as<\/p>\n
Headmaster.     The learned senior counsel appearing for the first<\/p>\n
respondent submitted that such a procedure was followed and<\/p>\n
qualified persons (respondents 3 and 4) were appointed as<\/p>\n
Headmasters.\n<\/p>\n<\/p>\n
       4. Learned senior counsel appearing for the first respondent<\/p>\n
also raised an objection that there is an effective alternative remedy<\/p>\n
for the petitioner to file an appeal under Rule 44 of Chapter XIV A of<\/p>\n
the Kerala Education Rules and therefore, the Writ Petition is not<\/p>\n
maintainable.\n<\/p>\n<\/p>\n
       5. Rule 44 of Chapter XIV A of the Kerala Education Rules<\/p>\n
provides that a teacher aggrieved by the appointment of a<\/p>\n
Headmaster shall have the right of appeal to the Department. In the<\/p>\n
present case, the District Educational Officer, Ernakulam is the<\/p>\n
authority to approve the appointment of Headmasters. The proposal<\/p>\n
for approval of appointment of respondents 3 and 4 would be<\/p>\n
forwarded to the District Educational Officer and he has to consider<\/p>\n

                                    :: 4 ::\n<\/p>\n
\nthe question of approval of appointment of respondents 3 and 4. In<\/p>\n
that process, he is bound to consider the appeal filed by the<\/p>\n
petitioner under Rule 44 of Chapter XIV A of the Kerala Education<\/p>\n
Rules.\n<\/p>\n<\/p>\n
       6. The learned counsel for the petitioner also submitted that<\/p>\n
even assuming that the minority status of the institution under the<\/p>\n
first respondent is accepted, it has to be shown before the<\/p>\n
educational officer that a fair process of selection was adhered to by<\/p>\n
the management in the matter of appointment of respondents 3 and<\/p>\n
4. This is a matter to be looked into by the District Educational<\/p>\n
Officer.\n<\/p>\n<\/p>\n
       7.  The learned Government Pleader submitted that the<\/p>\n
appointment of respondents 3 and 4 have not been approved and<\/p>\n
the approval was declined by the District Educational Officer on the<\/p>\n
ground that the minority status of the educational institution was not<\/p>\n
established by producing relevant documents.<\/p>\n
       8.  If the District Educational Officer has already declined<\/p>\n

                                    :: 5 ::\n<\/p>\n
\napproval of the appointment of respondents 3 and 4, nothing<\/p>\n
survives in this Writ Petition.    However, the petitioner would be<\/p>\n
entitled to file a formal appeal under Rule 44 of Chapter XIV A of the<\/p>\n
Kerala Education Rules before the District Educational Officer. No<\/p>\n
further directions are necessary in the Writ Petition.<\/p>\n
       Accordingly, the Writ Petition is closed with the above<\/p>\n
observations.\n<\/p>\n<\/p>\n
