     The claimants are the appellants. The<\/p>\n
appeals pertain to acquisition of land in Amballur<\/p>\n
village for the purpose of construction of a KSRTC<\/p>\n
bus station. The relevant section 4(1) notification<\/p>\n
was published on 09\/07\/99. The Land Acquisition<\/p>\n
Officer awarded land value at the rate of<\/p>\n
Rs.20,040\/- per Are corresponding to Rs.8,232\/-<\/p>\n
per cent. Before the Reference Court, there were<\/p>\n
altogether four cases and the Reference Court<\/p>\n
conducted a joint trial of all the cases. The<\/p>\n
evidence before the Reference Court consisted of<\/p>\n
LAA.282\/04 & con. cases       -2-\n<\/p>\n<\/p>\n
     documents Exts.A1 to A7; Exts.B1 to B5; the oral<\/p>\n
     evidence of PWs.1 to 3 and RWs.1 and 2. Reports<\/p>\n
     submitted by the Advocate Commissioner on the<\/p>\n
     basis of a local inspection conducted with respect<\/p>\n
     to the properties under acquisition and the<\/p>\n
     properties covered by the documents relied on by<\/p>\n
     the claimants and the basis document was marked<\/p>\n
     as     Ext.C1.     The plan   prepared    by    the<\/p>\n
     Commissioner was marked as Ext.C2. The learned<\/p>\n
     Subordinate Judge found on the basis of the<\/p>\n
     evidence that there was no comparison between<\/p>\n
     the properties covered by the basis document and<\/p>\n
     the properties under acquisition. It was also found<\/p>\n
     that the acquired property was situated very near<\/p>\n
     to the Amballur junction on National Highway 47<\/p>\n
     and that none of the documents produced by the<\/p>\n
LAA.282\/04 & con. cases       -3-<\/p>\n
\n<\/blockquote>\n
     claimants reveal the correct market value of the<\/p>\n
     properties at the time of acquisition since the<\/p>\n
     documents do not pertain to wetlands. At the<\/p>\n
     same time, it was held by the learned Subordinate<\/p>\n
     Judge that a sum of Rs.3,350\/- per cent will be<\/p>\n
     required for reclaiming the lands under acquisition<\/p>\n
     to the levels of the National Highway. The learned<\/p>\n
     Subordinate Judge relied mainly on the oral<\/p>\n
     evidence adduced by RW1, the Secretary of the<\/p>\n
     Requisitioning Authority, the Pudukad Grama<\/p>\n
     Panchayath to conclude that the charges for<\/p>\n
     reclamation will be Rs.3350\/- per cent.<\/p><\/blockquote>\n
\n<\/blockquote>\n
           2. In fact, Ext.B1 bill     issued to the<\/p>\n
     Panchayath by their contractor for reclaiming the<\/p>\n
     lands under acquisition was also relied on very<\/p>\n
     much by the learned Subordinate Judge. The<\/p>\n

\n<\/blockquote>\n
     learned Subordinate Judge noticed that Ext.B4<\/p>\n
     document relied on by the Panchayath and the<\/p>\n
     Government itself reveal that the value of<\/p>\n
     corresponding dry land is Rs.16,500\/- per cent.<\/p>\n
     Therefore, what was done was to deduct a sum of<\/p>\n
     Rs.3350\/- from Rs.16,500\/- per cent and conclude<\/p>\n
     that the correct market value of one cent of land<\/p>\n
     is Rs.13,150\/- as on the date of the transaction<\/p>\n
     covered by Exts.B2 to B5. The learned Judge<\/p>\n
     added 24% towards the passage of more than two<\/p>\n
     years’ till the date of proclamation of the relevant<\/p>\n
     notification and accordingly, concluded that the<\/p>\n
     correct market value at the relevant time is<\/p>\n
     Rs.16306\/-.<\/p><\/blockquote>\n
\n<\/blockquote>\n
           3. The main argument of the learned counsel<\/p>\n
     for the appellant\/Panchayath was that the court<\/p>\n

\n<\/blockquote>\n
     below was not justified in adopting the method of<\/p>\n
     deducting reclamation charges from the value of<\/p>\n
     corresponding dry lands for arriving at the value<\/p>\n
     of wet lands. According to the learned counsel,<\/p>\n
     the best method as recognized by judicial<\/p>\n
     precedents is the method of determining market<\/p>\n
     value of land on the basis of comparable sales<\/p>\n
     documents. The submissions of the learned<\/p>\n
     counsel          were  stiffly    opposed      by<\/p>\n
     Mr.K.G.Balasubramanian, the learned counsel for<\/p>\n
     the claimants. Mr.Balasubramanian submitted that<\/p>\n
     the properties were situated almost on the very<\/p>\n
     Amballur junction on National Highway 47. This<\/p>\n
     junction, according to the learned counsel, is a<\/p>\n
     very important road junction and it is at this<\/p>\n
     junction that the road coming from places like<\/p>\n

\n<\/blockquote>\n
     Chimmini which have importance not only in<\/p>\n
     terms of irrigation, but also in terms of tourism<\/p>\n
     meets National Highway 47. He submitted that at<\/p>\n
     the relevant time, there was a boom in the real<\/p>\n
     estate market in this area. According to him, the<\/p>\n
     method adopted by the learned Subordinate Judge<\/p>\n
     cannot be branded as unscientific. The learned<\/p>\n
     Subordinate Judge has relied on Ext.B1 file which<\/p>\n
     pertain to the reclamation of the very property by<\/p>\n
     the Panchayath and also the oral evidence of RW1<\/p>\n
     who was none other than the Panchayath<\/p>\n
     Secretary. He submitted that the Requisitioning<\/p>\n
     Authority was not correct in describing the<\/p>\n
     property as wet land. The property was already<\/p>\n
     partially     reclaimed. Therefore,  the  appeals<\/p>\n
     preferred by the claimants should be allowed.<\/p>\n<\/blockquote>\n

           4. We have considered the rivals submissions<\/p>\n
     addressed at the Bar. We find merit in the<\/p>\n
     submissions of the learned counsel for the<\/p>\n
     Panchayath that the best method for determining<\/p>\n
     the market value of acquired land is the method<\/p>\n
     relying on the land value revealed by sales<\/p>\n
     documents pertaining to comparable properties.<\/p><\/blockquote>\n
\n<\/blockquote>\n
     But, in the instant case, the learned Subordinate<\/p>\n
     Judge found that none of the documents produced<\/p>\n
     whether it be by the claimants or by the<\/p>\n
     Government        or the  Requisitioning Authority<\/p>\n
     pertains to a property which is comparable to the<\/p>\n
     property under acquisition. It was under such<\/p>\n
     circumstances that the learned Subordinate Judge<\/p>\n
     resorted to the method of deducting reclamation<\/p>\n
     charges from the value of corresponding dry<\/p>\n

\n<\/blockquote>\n
     lands. The value of corresponding dry lands was<\/p>\n
     arrived at by the learned Subordinate Judge<\/p>\n
     relying not on the documents produced by the<\/p>\n
     claimants, but on the documents produced by the<\/p>\n
     Government and the Requisitioning Authority<\/p>\n
     namely Exts.B2 to B5. Ext.B1 file contained<\/p>\n
     papers pertaining to reclamation of the property<\/p>\n
     under acquisition. It was the evidence of RW1 that<\/p>\n
     authority expended a sum of Rs.3,350\/- per cent<\/p>\n
     for reclaiming the lands under acquisition to the<\/p>\n
     level of the National Highway. The learned<\/p>\n
     Subordinate Judge relies on Exts.B2 to B5 and<\/p>\n
     also Ext.B1 as well as the oral evidence of RW1<\/p>\n
     after finding that it is not safe to rely on any of<\/p>\n
     the documents produced by the claimants. We are<\/p>\n
     not          very    much       impressed       by<\/p>\n

\n<\/blockquote>\n
     Sri.Balasubramanian’s argument that the learned<\/p>\n
     Subordinate Judge has not taken into account the<\/p>\n
     commercial potentialities of the lands under<\/p>\n
     acquisition. We do not agree. In fact, the learned<\/p>\n
     Subordinate       Judge took  into   account   the<\/p>\n
     potentiality and possibility of the lands under<\/p>\n
     acquisition which at that time were only wet lands<\/p>\n
     for being reclaimed and utilised for purposes for<\/p>\n
     which dry lands are utilised including the purpose<\/p>\n
     which was sought to be accomplished by the<\/p>\n
     Panchayath i.e the construction of a bus station.<\/p><\/blockquote>\n
\n<\/blockquote>\n
     According to us, the appellants\/claimants cannot<\/p>\n
     have any legitimate grievance regarding the<\/p>\n
     market value fixation. We are approving the rate<\/p>\n
     fixed by the learned Subordinate Judge since we<\/p>\n
     find that the properties were situated very near to<\/p>\n

     the Amballur junction as already stated. These<\/p>\n
     appeals will fail and they are dismissed, but in the<\/p>\n
     circumstances, without any order as to costs.<\/p>\n<\/blockquote>\n
