ORAL JUDGEMENT
\n               (Per : MR.JUSTICE B.J.SHETHNA)<\/p>\n<\/blockquote>\n
1.The petitioners are joint owners of the lands
\nbearing Survey Nos.     133 Piki admeasuring 47 Acre 27
\nGunthas situated at Village Chhadiyali, Taluka Sayla,
\nDistrict Surendranagar.    Record of Rights being Village
\nForm No. 6 is at Annexure-A.\n<\/p>\n
2.It is the case of the petitioners that the
\nRespondents – State Government wanted to construct a dam
\nunder the Dhoriyali – Bhogavo Irrigation Scheme in taluka
\nSayla of district Surendranagar.      For that    purpose
\ndifferent lands were acquired by them and the possession
\nwas also taken over. According to the petitioners the
\nrespondents took away possession of part of the aforesaid
\nlands belonging to them in the year 1986, and remaining
\npart of the land of the petitioners got submerged with
\nthe construction of the time.      Record of Rights being
\nVillage Form No. 7 & 12 is at Annexure-B.\n<\/p>\n
3.The grievance made by the petitioners in this
\npetition   is   that, without following the procedure
\nprovided under the Land Acquisition Act (for short the
\n“Act”) they have obtained physical possession of the land
\nbelonging to the petitioners and have not paid any
\ncompensation so far, though number of occasions they have
\napproached the respondents for due compensation; hence
\nthis petition.\n<\/p>\n
4.It is prayed in this petition that, the action of
\nthe respondents taking away lands of the petitioners
\nwithout following due procedure of law be declared
\nillegal and the respondents be directed to either hand
\nover vacant & peaceful possession of their lands in
\nquestion together with the damages or to pay legal
\ncompensation as per the act for the damages suffered by
\nthem.\n<\/p>\n
5.On 19-2-2000 Division Bench of this Court made
\nrule returnable on 5-3-2000. On March 29, 2001 learned
\nAGP Shri. Mukesh Patel appeared for the respondents and
\nprayed for time to file reply to this petition, the time
\nwas granted upto 17-4-2001 and the matter was ordered to
\nbe listed on 19-4-2001. However, for some or the other
\nreason, it was placed before this Bench only on 7-1-2002.
\nOn the request made by learned counsel for the parties,
\nit was kept for today.\n<\/p>\n
6.It may be stated that, so far no reply affidavit
\nis filed by the respondents in this matter.\n<\/p>\n
 7.There is a controversy regarding possession of
\nthe   land   of   the   petitioners taken over by the
\nrespondents. According to learned AGP Shri.     Sen, the
\npossession still remain with the petitioners, however, he
\ncould not deny the fact that the land of the petitioners
\nhad already been submerged with the construction of the
\ndam.   It is a different matter that because of scanty
\nrainfall for a particular time the land may not remain
\nsubmerged, but that does not mean that the possession of
\nthe land remains with the petitioners. It all depends on
\nthe monsoon. If the monsoon is good then the land is
\nbound to be submerged, which is not in dispute. Under
\nthe circumstances there is no question of granting the
\nfirst prayer made by the petitioners to declare the
\naction on the part of the respondents taking over parts
\nof the land as illegal.      There is also no question of
\ndirecting the respondents to hand over vacant         and
\nphysical possession of the land with damages. However,
\ntheir prayer regarding compensation can be considered by
\nthis Court.   If the land of the petitioners have already
\nsubmerged with the construction of the dam, then, the
\nquestion of taking over actual possession from the
\npetitioners or not would not be of much importance.   The
\nfact remains that the petitioners are not in possession
\nof the their land, which is already submerged in water.\n<\/p>\n
8.Learned counsel Shri. Amin for the petitioners
\nhas annexed copy of the judgment & order dated 20-12-1999
\npassed by the Division Bench of this Court (Coram: M.R.
\nCalla & P.K.     Sarkar, JJ) passed in Special Civil
\nApplication No.    8500 and 8501 of 1999 and submitted
\nthat, this Court may also dispose of the present petition
\nin terms of aforesaid order. However, it was submitted
\nby Shri.   Sen, learned AGP for the respondents that, the
\nfacts of that case was totally different. It was a land
\nin Ahmedabad district whereas in the instant case the
\nland is of Surendranagar district. In that case actual
\npossession of the land was taken over, whreas in the
\ninstant case no such possession has been taken over;
\ntherefore the aforesaid judgment will have no application
\nto the facts of the present case.\n<\/p>\n
9.Whether this petiton would be squarely covered by
\nthe aforesaid Divison bench judgment of this Court or
\nnot, we would not like to go into that quetion. Because,
\nin our considred opinion, when the petitoners have
\npractically lost possession of their land, then, they
\ncannot be atleast deprived of their due compensation. In
\nthat view of the matter, we direct the petitioners to
\nfirst   approach   the   Collector,   Surendranagar   for
\nreasonable compensation of the land. If they make such
\n an application within one month from today, then, learned
\nCollector,    Surendranager,    shall    consider   their
\napplication and decide it as early as possible, and not
\nless than three months from the date of receipt of the
\napplication.   Learned Collector shall determine      the
\namount   payable to the petitioners, considering the
\ncompensation given to the adjacent owners of the lands
\nacquired by the respondents.\n<\/p>\n
10.With these observations and directions    this
\npetition is disposed of.     Rule made absolute to the
\naforesaid extent. No order as to costs.\n<\/p>\n
