No.33760 of 2010\n                                  KUMAR RAZA KHAN\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   27.10.2010                  Heard Sushri Neelu, learned counsel for the<\/p>\n<p>                   petitioner and Shri Yogendra Kumar, learned A.P.P. for the<\/p>\n<p>                   State.\n<\/p>\n<p>                                 Learned counsel for the petitioner attempted to<\/p>\n<p>                   convince the Court that materials, even to raise grave suspicion<\/p>\n<p>                   against the petitioner of committing offences for which the<\/p>\n<p>                   learned 4th Additional Sessions Judge, Rohtas at Sasaram<\/p>\n<p>                   directed framing of charges against him and other accused by<\/p>\n<p>                   his order dated 20.7.2010, were not available to him when he<\/p>\n<p>                   was passing that order in Sessions Trial No. 187 of 2010. She<\/p>\n<p>                   also took the Court to the provision of Sections 304(B) of the<\/p>\n<p>                   Indian penal Code and referred to the findings recorded by the<\/p>\n<p>                   learned trial Judge itself that it was a case of suicide and there<\/p>\n<p>                   was some material in the case diary indicating as if the lady<\/p>\n<p>                   might have an unhealthy mind which could have led her to end<\/p>\n<p>                   her life.\n<\/p>\n<p>                                 The learned Additional Sessions Judge while<\/p>\n<p>                   passing the order has referred to a number of paragraphs of the<\/p>\n<p>                   case diary containing the statements of the witnesses which<\/p>\n<p>                   indicated as if there were sufficient materials to indicate that<\/p>\n<p>                   there was a demand of dowry and that the lady was being<\/p>\n<p>                   harassed in that connection which might have led her to commit<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>        suicide.\n<\/p>\n<p>                          As regards the ill-mental health of the lady, as<\/p>\n<p>        argued by the learned counsel, this could be a defence which<\/p>\n<p>        could not be taken into consideration at the time of framing of<\/p>\n<p>        charges as the duty of the court is confined only to look to the<\/p>\n<p>        material which cold indicate sufficient ground for proceeding<\/p>\n<p>        against the accused for presuming that the accused has<\/p>\n<p>        committed some offence. Those materials were available to the<\/p>\n<p>        court in abundance and the order does not appear suffering from<\/p>\n<p>        any illegality.\n<\/p>\n<p>                          The petition appears of no merit.
